  1. Hi everyone, after the events with Lloyds the other day I was getting a bit worried, but I thought I should let let you know that Abbey paid up in full yesterday! A cheque for £1360 was paid into my (still open for now!) abbey bank account yesterday! Thank you so much to everyone who has helped me out through the process and helped me keep my nerve! Once I get the money in my hand I shall be making my donation! Thanks again! Rachel x

Right, I've managed to find the account number for my old abbey account, but it means reclaiming charges that go back further than 6 years.However, I have no statements, I don't know when the account was opened (possibly 1999) and I don't know when the account was closed. question 1: how do I word my SAR to get all my statements/information to stop them using delaying tactics, as I'm led to believe that abbey hold information dating back to 1926 question 2: I don't really understand the Limitation Act and how it doesn't really apply anymore... can anyone explain it in (very) simple terms for me... thanks again! I have no statements from the closed abbey account or any other information, is there any way you can think of that I can find out the account number? also, I had a business account with abbey for a VERY short period of time (they were bloomin useless!) can I reclaim charges that account too...? thanks Rachel

  7. Hi everyone, I've submitted my court bundle to abbey and the courts (court date june 28th) so I'm sitting with fingers crossed waiting to hear from them! (thank you everyone who helped me with that!) I have a question though, if this claim is successful, can I repeat the process for another bank account that I used to have with Abbey? The account was closed about 5 years ago, so I'm not sure that that I will be able to, but this account had LOADS of charges applied to it... Thanks Rachel

  9. ... it really doesn't take much! I've received my court date through it reads as follows: 1. The parties must file at court and serve on the other party not later than 14 days before the hearing the following: a copies of all documents upon which they wish to rely. b statements of all witnesses, including the parties upon whose evidence they wish to rely, The statements shall be typed, dated and signed by the witness and state that he/she believes the facts to be true 2 all original documents shall be brought to the hearing etc. so am I right in thinking that point 1a means the basic court bundle? I haven't asked for any witnesses to be used, but do I need to supply a witness statement? Also, do I need to use the case summary template too? so many questions - I'm sorry! Thanks Rachel
  10. After a lot of help and assistance, my court bundle is just about done, but I've just read another thread which states that I need to put a witness statement in the front of my court bundle - can anyone point me in the right direction for a template of this please! Thanks Rachel

  12. ...with my court bundle? saying something along the lines of I am very disappointed that they have failed to settle my claim as i am aware that the courts know that they have failed to take a single case to court and there has been several similar cases where the judge has considered striking out the defence on the grounds of an abuse of process. And that if they wish, they can contact me to discuss a settlement to bring the matter to an end as continuing this claim would be a further waste of time and money. Do you think that may get their backs up and delay things more or should I just go for it as I've got nothing to lose! Rach x

  14. Is there really any need for that sarcasm? I posted here (as well as googling myself) as I thought that there would be people on here who have been through this process and therefore were more reliable than something I would find on a search engine and possibly could result in me making a fool of myself to the courts by quoting the wrong information.
  15. Unfortunately, I work on a very old apple mac and I can only read parts of that file as it's appearing as nonsense on my screen so I'm having to try and create my own court bundle from scratch! Thanks for taking the time to reply anyway!

  18. Hi everyone, I'm new here so please be patient with me! I've just issued court proceedings against abbey to reclaim charges and interest totalling £1150 I've received a letter from the court this morning saying that abbey intend to defend all of the claim and also a letter from abbey asking for details of the charges and interest so they can put together their defence. Should I be scared? Or is this just a stalling technique? please let me know if anyone has any experience of this. Many thanks Rach
