  1. RBOS are currently sending me all the nasty letters demanding that I clear my unauthorised overdraft which has reached approximately £128. They say that the case will be going to the court/sheriff officers very soon. The problem that I have is that the £128 overdraft was arrived at purely as a result of charges. I am currently trying to get my charges of approx £4000 back from HBOS so why would I pay £128 to RBOS for an overdraft which is only there because of no funds being in the account to pay a Standing Order for a few months. Should I let them take me to court and then ask them to justify the charges? TF
  2. Hi folks, I am currently trying to reclaim from the Bank of Scotland charges on 3 accounts (plus standard interest) which amount to more than £4000. I have obtained all my statements and added all the charges together and then calculated and added interest. I have now sent them 2 letters and in the last one told them that if I didn't receive a satisfactory response within 10 days that I would start legal action. I received a reply saying that they wouldn't be able to fully investigate until the middle of May, so now I intend to take the matter to a court. I live in Edinburgh and all the accounts are at branches within Edinburgh, every site I look at on the internet tells me that I can only claim up to £750 at a small claims court in Scotland but none tells me how to go about court proceedings to try and reclaim an amount more than this. Any advice or definitive "what to do next" would be appreciated. Or just advice as to where to find a "what to do next" if you live in Scotland. TF
