Well everyone, I didn't send letters but phoned to complain several times about the service I'd received etc and got a letter in the post offering £430 compensation (I hadn't provided any info, but told them I was GOING TO CLAIM for £545, hadn't actually done that yet). Brilliant, I'll take that, got a court date with Lloyds and its a joke how long its took Id rather lose £101 and be done with it!

  5. Hello everyone who has helped so far- I think tomorrow is when the 28 days expires- what happens now? I've checked on Moneyclaim and they havent responded. Does this mean I win by default? Or do they literally just wait until the very last minute and then I'll be in court? The heartless bastards stung me for another £30 this week after I went £4 over
  6. So served being 28 days from 9th May if I started the claim at moneyclaim on the 4th?
  7. Hi, I have received a letter from Lloyds saying they know about my claim through the courts, and have nothing to add as it is with their solicitors. Then I checked on moneyclaim and they have acknowledged and now have 28 days to respond. What happens now?! This is a bit of an ordeal, its taken 2-3 months to get to here!
  8. Thats what I'll do- just spoke to an advisor who said there was nothing on the notes system about a claim on there. He's getting the woman handling my complaint to phone me tomorrow, I think I'll send the letter anyway if she doesn't call tomorrow
  9. Now then people. My situation is slightly different than most I've read on here. I ordered statements on 23rd March which wasn't actioned. I eventually, after several complaints, reordered on 13/04 and received statements on 18/04. A woman from complaints department told me Barclays were pre-empting my claim, by fast forwarding the process on the assumption I was actually going to file a claim- I get two letters within a few weeks, promising contact by 8th May after they had more information. This info presumably being the amount they think I will claim for- which amounts to £545. I haven't heard anything yet, and I am calling today. Does anyone know what usually happens in these situations? I got £80 off Egg within a couple of weeks of ordering statements and letters etc, and I have filed £280 with Lloyds TSB on moneyclaim, with their 14 day deadline for acknowledgement coming up, but the procedure for these two has been pretty different from Barclays. I'd appreciate anyone's stories like this, or advice, Cheers
  10. I read somewhere that you should file by default- why should you allow any extra time for the banks? Cheers for this by the way fella! I've read some horror stories about the waiting game on here, mines only for £300
  11. I have submitted the claim on moneyclaim online. The 14 days they have to reply are up on the 23rd May- there's nothing on the claim site yet. What should I expect? How do they get in touch. If on the 23rd there is nothing there, what do I do? Do I just select the option "the defendant has not filed an admission or defence to my claim?" and how does it go from there? help!
  12. Hello everyone. I've posted the claim on moneyclaim today- how long should I expect to wait for a response, and when can I expect to get my money? Egg, bu comparison, paid the money 2 days after my threatening letter!

    This is what I sent by secure message and email: Regarding account number: Reference: FAO Ema Clayton Dear Ms Clayton, Thankyou for your letter dated 19th April regarding my request for repayment of charges. I have great respect for Egg's Genuine Pre-estimate of £20, great respect for Egg's Genuine Pre-estimate of £16 and great respect for all future Genuine Pre-estimates that Egg provide. As a former cardholder I cannot help wondering, if after many years in business Egg has ever tried to reconcile Pre-estimates against Post-event audits. I am confident that a company devoted to justice and truth like Egg will not withhold evidence from the cardholder, that Egg will present evidence in court to show after-the-event costs, as well as before-the-event Genuine Pre-estimates. Therefore I intend to file a claim for the £80 charges and I hereby reject the £16 offer which you made in your previous correspondence. Yours sincerely Matthew O'Connor

    Thanks mate, thats a big help. I'll send a secure email to them now saying what you have illuminated there- by the sounds of it you just have to make out that you are serious about contesting it, and they'll avoid the hassle and pay up...is that about the short and the long of it?

  18. Thanks for the advice- they dragged their heels unbelievably, and so I'm expecting to have to take it to the courts- I'll keep you all informed

    Hi Everyone. I provided Egg with statement evidence that they owed me £80 in charges, but they have replied offering £16 because they reduced their charges from £20 to £16m and that Egg's practise of requiring customers to pay by direct debit meant that the presumption of unfairness in relation to charges over £12 does not apply where exceptional business factors apply, referring specifically to Egg. What should I do? Take it further or just take the pittance on offer? Help!
  20. Hello everyone. First time on CAG, so would just like a few tips on getting my hard earned lolly back off Lloyds- I have written to them with statements for £280. They have replied that they are not going to reimburse me, so I have sent a letter again saying I am going to take them to court. Should I just go ahead and file on the small claims website? And how long can I expect this to go on? I started about 6-7 weeks ago. I'd appreciate any thoughts...!
