  1. well thats why you have to go to court, you will be given the chance there & your [non] past offences will be TIC. Well, that is why i am asking for some help from the forum. Because i am given the chance i want someone to help me and tell me what s the best approach i should take. Should i explain or say "yes you are right, I was speeding so give me the maximum you can!   2. On friday I received a letter saying that i have to go to the court on the 15.01.09 for an speeding offence that i made on 11th october 2008. The charge is that i was doing 94.65 for 1.337 miles so i was doing more than 70mph. First thing is that as I am not from this country but i ve been living here for 9 years (driving only 1 though) and never thought that driving at that speed on an empty Motorway on Sunday afternoon with perfect visibility, the police will treat you the same as you murdered someone or you are a drug dealer. Note quite, if you had murdered someone or had Class A drugs you would have been arrested. It does not matter how long you have been driving or how long you have been in the UK. It is also irrelevent that it was a clear motorway. That would be the only difference if I was dealing with drugs.But they are not hard enough to arrest them. Using some common sense it is not the same if you r doing 95mph in an empty motorway or doing 95 when the traffic is heavy. Anyway, as I told you I was doing 94.65mph for 1.337 miles. I know i can get a good solicitor and fight back on technical things but i cant afford it. I can't afford fines either so I keep to the speed limit. Have you ever seen a RTA? - lots of innocent peole get killed through excessive speed, that's why we have speed limits. If they have the evidence, then you will be wasting you time going to court. Have you requested to see the evidence that they have? No i have not ask them cause i am not from here and my english are not in the level that i would be able to fight some smart arses in the court. To clear something. I DO NOT believe that my average speed was 95mph for 1.337miles. But i admit that i was dring between 80 and 90. Also this was my first time I ve ever been involved in speeding. This is excessive speed, you may get a bigger fine/more points if they prove you were doing over 90. It does not matter that this is your first offence. again using some common sense there is a difference when you are doin something for your first time cause otherwise with the first time you d be disqualified for ever. Now i want to ask a few questions and your help will be appreciated. Why I haven t received a fixed penalty notice and 3 points on my licence? when i asked the officer he said that this would be the case. Because you were doing over 90, they chose to deal with this in court I want to plead guilty cause I know that i was exceeding the 70 limit but is there any template for explaining things such as " it was my first time--I wont be doing it again" in order for them to give me the minimum punishment?? No, it is not a mitigating circumstance (e.g. emergency) ps i asked for some help in order for the punishment to be minimum and not to discuss if i was right speeding or argue that iam not guilty. I just asked if there is any template in order to explain my situation and that I wont be doing it again and i had ben offered a fixed penalty notice i would have accepted. thanks again anyway

  4. Hiya again I followed Castlebest's advice and I was just waiting for the test case to be heard. As I ve read some other threads I think that many people now take their case through the court. Whats the best thing for me to do? Any advice is much appreciated Thanks
  5. what i need to know though is do I have a chance? next is can you please tell me if pages 3 & 4 from HSBC is the actual default notice? And also one more question. I think all the defaults that are placed are rightly done at the time of issue (I have not got a default from ABBEY cause i ve never been with the ABBEY) so I think most of the peoples case here is that they try and find something wrong in the banks papers etc in order to get their default remove. You cant just miss 4 months payments and get a default from them nor you can destroy your life cause you missed some payments 3 or 4 or even 6 years ago. I know it is very difficult to get a default removed but i want to try and get it removed not partially but wholly. But I cant do that without your help. So thanks for replying but I still have questions. Alex

Sorry Paintball With HSBC i am to the stage to which I ve sent them an LBA letter and I received the letter from them saying that due to a test case they have the right to stop any communications about these so I have to wait for the test case. That was back in October. So do u suggest me going back and file a claim???
  7. UPDATE!!! I received this letter from HSBC after sending my second letter asking for the default notice. As you will notice there is no signature and I think this is a reproduced one. I ve never received that notice. Anyway the reason I am not clearing the balance is that around 50% of that is made up from charges. So even if the default notice is correct because I have not cleared the balance I believe that I have got a strong case arising from the charges. The thing is that I do NOT know how can i approach my case. I can explain you though what it would be my ideal case. my balance is £1200 approx and the charges are £620 approx. If they tell me or offer me to pay lets say £600 and remove the default I can pay off the whole amount the same day.   9. hiya again I think I ve lost quite a few things, reason was I was in Greece for a few months. The last Letter I ve received from HSBC was that there will be a test case and therefore they have the right not to respond anything.Last letter was the LBA.can anyone help. What should i do?????
  10. hello again, As I was away for quite some time back in Greece I now sorted out the one of my two defaults. I have got 2 defaults in my Credit record one from Amex which is now showing as settled and one more from HSBC which shows £1100. The thing with HSBC is that half of that amount is made up from charges. But as we all know there is test case going on in the courts. So, I have a good reason I believe not to pay HSBC just yet until the test case is closed. Now back to my problem. I have never received a default notice from AMEX or HSBC so I ve sent the first letter asking for it to both of them on the 13th of November 2007 and haven t received any correspondance from them. What should I do now? Please help

  12. just to update my thread I ve sent them the full and final settlement offer for £1400 while i remind them that they didn t comply with my requests. they only accepted £1820 which is very very good if you think that got 50% discount.the amount of money paid today. I will just wait for a week to check that my default will be settled in full. I also got a letter from them that says that neither them or any other associate company will be chase me further. I WON THE BATTLE THANKS TO ANYONE HERE
  13. hi there I was living in a flat from the period 16.06.2003 to 16.09.2005 I was paying £45 per month and after 2 years i.e in 2005 they send me a bill saying that I was owing them £1875. Furthermore, I do not really know if they had the meter readings correctly or and if i have been charged in the correct band. Note that i was still paying my £45 per month for the entire stay in my flat. They then passed my account to Wescot and now they are chasing me. Does anyone have any suggestions to give me of what should I do?? Should I send them a SAR or it doesn t apply to them? please help.......

I finally received the statements Unfortunately it is just £600 :) Anyway, the address that I am going to send the preliminary letter is HSBC Bank Plc Service Quality Team Arlington Business Centre Millshaw Park Lane Leeds LS11 0PP Is That Correct????????????????? and I won t include the 8% interest. I will purely include the charges only. I hope I am correct ould someone confirm?????????????
