  1. Hello. I had a business go into liquidation nearly 2 years ago. I had a personal guarantee on some equipment. The leasing company took out a court order for the outstanding £5230. I got an agreement to pay £20 per month. I am now mid divorce with 3 young children, and opened a new bank acoount at end of last year. All my direct debits went haywire, ultimate disater is I missed 2 payments of the standing order, and the company have now sent a bailiff with a writ of Execution, for a total of £6719....orginal amount, shows no deductions of payments I made, plus fees, VAT. This was on 28/2/11. Unfortunately my 7 year old son opened the door as I was upstairs, I went down and very polite guy said 'I need to come in and discuss a matter with you'. He was v polite and I let him in, huge mistake I now realise. End result is I was so shocked, all this over £40, that I signed papers (walking posession) which I have since researched and realised I didnty have to let him in or sign anything. I have spoken to original creditor, he is unwilling to budge and says I need to negotiate with bailiff. Bailiff is only prepared to give me 12 months, which equates to about £550 per month. I work 2 days a week, get tax credits as have kids age 4,7,11, and simply do not have that much. He has written list of my stuff, which isnt much, 8 yr old renault, 10 year old sofa, 8 yr old 32" tv, couple of coffee tables, thats it. I am absolutely panicking now, spoke to Payplan today, they said get a N245 from court. However, looking online I think as it is high court I need N244 for stay of execution??? Could this help me? I'm happy to pay instalments but just not such high ones. Would an N244 give me option of smaller payments? I have income and expenditure as I have other debts from business failure and no spare cash each month at all. Any advice as to what may happen? Family and ex can't help, my only other option would be a loan if I can get one, which I'm not convinced I can. Worried sick.
  2. Hi, Posted last week as had'nt received letter from Barclays. It arived today, offering £1200 against a claim of £1975 (£1700 plus interest). Is it worth negotiating - do I compromise and ask for £1700 - just interested in other people's experience of this. On another note, its joint account, all the letters have been sent by me, signed by me, and they insist on adressing everything to my husband!!!! Thanks, Caroline
  3. hello, Lots of other Barclays people here - quick bit of advice needed. Wrote my letter claiming charges back, after receiving statements, in March. Got 'holding letter back at end of 6 week period, then another letter saying they are still looking into our case, but would get back to me by 10th July at the latest. Well, phoned on 10th July as no letter, and was told they are very busy etc, etc, and should get a letter by today - still nothing - any advice??? Am claiming about £1800?
