  5. Well Barclay's acknowledged the claim on the last day then didn't submit a defense in the following 14 days so I applied for a judgment. That was almost 2 weeks ago and still no money. What's my next step on this one? All my others have settled much faster Barclay's are dragging their feet.
  6. So that date issued already takes into account the extra dates as the 21st wasn't the date I filed which was a few days prior. I have done a search on the forums and it seems that there is a few people who have not been able to do this using moneyclaim online. I will give the court a ring on Monday something doesn't seem right. My claim was for £3800 so can not see Barclay's not acknowledging the claim.
  7. Is it 14 working days or 14 days? It was issued on Thurs 21st Sept would Friday 6th be the date I could do this?
  8. They haven't acknowledged I thought they had 14 days in which to do that if they did then they got an extra 28 days? Because they didn't acknowledge in the 14 days I thought I could file a a default?
  9. I have subbmitted the claim and it was issued on the 21st Sept. No defence has been submitted by Barclays and the 14 days are up so I tried to submit for a default judgement but a screen comes up saying it hasn't been 14 days. Any idea whats going on? It is 14 days and not 14 bussiness days isn't it? "You cannot request a Judgment by Default at this time. The Defendant is allowed 14 days from the date they were served with the claim to defend or admit your claim before you can request a Judgment by Default. If the Defendant files an Acknowledgement of Service within 14 days of receiving the claim form, they will be entitled to 28 days from the date they were served with the claim form to file a defence or admission of your claim. If the Defendent does not file a defence or admission within the 28 days you can request a Judgment by Default. If you have not requested judgment, the defendant may still file a defence to your claim after the 14 days or 28 days have elapsed. The claim will then be transferred to your local court for a hearing to be arranged."
  10. Got my money back on 27th and a letter in the post today expaining it would cost too much to defend and they would not get costs if they won. £430 including intrest and court fees!
  11. The court have sent me a letter saying they intend to defend. Bit worried now.
  12. I used this for MBNA and it worked so I am using the same for Halifax. I have a contract with the defendant bank dated July 96 which is conducted on their standard terms and conditions.I am claiming the return of money taken by the defendant in charges over the last 6 years plus the interest they have levied on those charges. The bank's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further, as a disproportionate penalty they are invalid under the Unfair (Contracts) Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999. Para.8 and sch.2 (1)(e). In the event that the charges are not a penalty then they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. I have asked the bank to justify their charges which they haven't. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 31 Aug 00 to 4 July 06 of £94.90 and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £0.07.
  13. Filed online today for £315 plus intrest of almost £100. Hopefully should get a fast settlement but who knows.
  14. Survey and Donations done I am on the ball today. The refund has paid my holiday to Florida in Nov so the drinks will have to wait until I have won the Halifax not long now and they will be paying for a good night out!
  15. The intrest and court fees are in my account today so just need to contact the court on monday. Next the Halifax bring it on!!!
