  1. Thanks to you both - will send LBA TODAY!! Should I send it to the return address of letter they sent me?
  2. Hi, I was in the same situation at end of July, I was about to send LBA and then received the letter as outlined above. I have maybe foolishly not continued with the next stage as I believed we would have to wait for the outcome from the OFT. I received the letter from the bank on 30th July. Can you advise as to what step to take next please. Thank you.
  3. I received my reply and copy statements from the copy statement unit, Swallow Street, Birmingham - there are quite a few different addresses listed on site for Lloyds and unsure where to send this next stage letter, do I send back to CSU? Thanks.
  4. Hi, I only received statements for one of the accounts requested within the SAR, they sent details of current account and not credit card as requested. So I am going ahead and sending template 2 from the library, Could someone clarify before I send please, this is a LBA - shall I not bother with the prelim letter? and should I send the amount I am claiming back for current account along with this. Thanks to anyone who can advise, K.
  5. Hi Barty, thanks. I have just realised that the figures received yesterday are for current account only - when I sent the SAR I requested statements for a credit card account also. Do I need to start over again sending a new SAR for credit card, or include details of this in the LBA? Thanks, K.

Thank you both for replies, I have decided to write them a letter stating I am not prepared to pay these penalties and the reasons why - as discussed not authorised within the lease agreement, and, the estate agent is considered a ' large' business' - there is no way the admin work being charged can be anywhere near £30 + vat. Thanks again, K.
  7. Thank you, on to next stage !! Could I just ask one more thing - :-| do I need to send prelim and LBA or just one or other.   8. Thanks Barty, day 40 today and they arrived in post. I am a little unsure which charges I can claim back - they are listed as O/D excess fee, obviously the normal O/D interest is not included but do you know about the charges marked ' O/D excess? Am just adding it all up now, by the way, they have accepted the £10 DPA request fee!! Thanks, K.
  9. Hi, thanks for reply, I have re read the lease and there is nothing that mentions agents rights or authority to charge for late payments.
  10. Hi, how is your claim going? Mine, It is day 39 and I have received no statements - nothing. I have tried to track my letter through royal mail and it is not showing up as received - although I think there may be a problem with the service today. If I dont receive tomorrow ( day 40) Will I need to go ahead and send LBA? trouble is I'm unsure how much I am claiming back??!! Any advise appreciated, K
  11. Hi, can anyone advise on this please. I rent a business premises through a letting estate agent, we are slightly in arrears with our rent - one letter was sent out by agent with a charge of £30 + vat, ( saying our rent was in arrears, they sent the letter out the same day I paid the rent.) Now we have a second letter, £30 + VAT, this time relating to a figure of rent increase that had been overlooked by us both. I guess the real question is, are they allowed to charge these extortionate amounts for sending out a letter - ( their office is 200yds up the road from my shop). If the banks are acting illegally are too the agents that collect on behalf of landlords? Can anyone advise please. K
  12. Hi, thanks for reply - easy to say dont worry about the default letter - hard not to worry though, we have had countless letters and a default notice - endless phone calls too! We just phone them and update with situation - they will have to wait, better still, as posted below - they owe you alot more than you them!!! Keep chin up and stay strong, will keep you updated when I get my response from SAR. K
