Hi from other threads ive read, i belive the bext stage would be to send a s10 sharing cease request. you conscented to sharing information while you had a contract but now no contract exisits so sharing information must stop. the deafult isnt in the public interest, and the information belongs to you, so i understand you can insist on its removal... I think !
  2. Hi, I have a default ( equifax and experian show two differant amounts and dates) with shop direct from kays catalogue from 4 years ago. Ive written to them now 3 times, and the letter I recived today confirmed they have no cca for me they keep bluffing me. They then tried to tell me today the the cca fee for staments of ac and copy of default notice was £10 and not £1 I am now going to send, this Thank you for your letter dated 12 April 2007. I have enclosed a copy of sections s77 and s78 of the cca 1974 (freely available on the internet). You will note the information requested has to be legally provided with a fee of £1 (already paid) and not £10 as per your letter. A copy of the original default notice which I don’t remember receiving and statement of account is requested again (3rd request). I note that you have stated that your ‘client’ has no credit agreement for this account; investigations are now taking place to see if the debt was legal and if any laws were broken trying to enforce a debt without signed agreement. Any interest and charges applied to the balance that were paid may be illegal, and if found to be, I take court action to recover this plus the cost of any such action. This will be my last request to you for the information before it is passed to the regulating bodies as a complaint to the financial services authority, office of fair trading and trading standards where you may be fined £2500 for failing to supply the information. If you cannot substantiate and supply all the data requested about this default I must insist it be removed. Yours sincerely So they confirm no agreement on file, as this default has led me to pay higher interest rates with other creditors, where do i stand ?
