  2. YES! It think it makes sense now. Basically, for example... if my O/D limit was £2,000 and i was say my balance was £1,800 overdrawn, but had a DD go out for £220 which put me £2,020 O/D and the bank charged me £28, i can attempt to claim that back??? Thanks for this!!!
  3. Thanks for the speedy response.... There is one thing i dont understand, can i only try to claim back those charges for Unpaid direct debits that Natwest has returned, or also those direct debits which the banks paid but which took me over my agreed O/D limit, thus them charging me anyway????

Cheers, i may need those template letters if i get no response from my next letter... this is what i put (I borrowed a big part of it from another letter i seen on here) :o) "Dear Mr Higley, Thank you for the bank statements sent 17th May dating back to October 2002 (3yrs 7months), I received them today 2nd class on the 19th May 2006. It was worrying to see the envelope torn and in such a bad state showing my personal statements on clear display to anyone who came into contact with my mail. The envelope was in such a terrible condition in fact that when I later showed my friends and family the photographs of the envelope they commented how shocked they were on how much little care must of been taken when packaging them ready to send, especially being Natwest customers themselves. In my letter dated 19th April 2006 my request was for a DPA Subject Access Request, INCLUDING a schedule of charges and transactions on my account dating back to 01/06/00 or ALTERNATIVELY account statements for that period. I feel that I need to draw your attention to the second paragraph of that letter in which I made it clear that I would require disclosure where there has been any event in my account history over this period which has required manual intervention by any member of your staff or any other person, and disclosure of any indication or notes which have either caused or resulted in that manual intervention or other evidence of that manual intervention in relation to my banking business with you. Obviously the statements alone would not provide this information, but while statements themselves are not covered under the Data Protection Act, the list of charges and transactions on the account ARE included. Therefore, in order to expedite matters, I again apply for a full Subject Access Request including a schedule of transactions on my account dating back to 01/06/00, or alternatively account statements for the requested period in addition to any information you hold regarding the record of charges and transactions on my account for the requested period, as per paragraph 2 of my letter of 19th April 2006. As mentioned before, if I discover that you have levied disproportionate penalties against me then I shall be reclaiming them and also reclaiming the £10 DPA disclosure fee. I would remind you that the statutory 40 day period that you have to comply with my request for this information began on 24/04/2006 and expires on 3rd June 2006 and that I require compliance in accordance with the Law. Regards" I await to see if Stuart can comply with this simple request!!!!
  5. Well, Rock on to all you guys and gals taking this action to claim whats rightfully yours! This system we live in all revolves around credits and debits, debt just being another form of control to take our minds off asking the real questions that matter! And aslong as were all worrying about how we're going to pay our Mortgage, or this months bank loan... the International bankers are busy holding our goverments to ransome and orchastrating the next war to get rich off! Sent my DPA letter on 21st April, recieved recorded delivery on the 24th April. Had'nt heard anything until this morning when i had bank statements arrive in a battered envelope dating back to Oct 2002, only 3yrs 7months. Oh and a letter off Stuart Higley saying: "Dear Mr Crane Your recent request for duplicate statements has been forward to this office. Please find these enclosed." Huh? No mention of a request for duplicate statements in my letter Mr Higley, more like proof of manual intervention and list of charges for the past 6 years. Sending following letter today pointing this out to him... Will keep y'all posted!
  6. Thank you dinghy, i know the question was irrelevant to the thread, but its alot to take in all the legal info on this site and where to find the best place to ask questions... cheers for the answer tho!
  7. Can i just ask a question... can i only try to claim back my charges that have been issued because ive gone over my overdraft but less than £28 ie a few quid, or can i try claim back all charges....even when ive gone £100 over my agreed o/d limit?
