  1. Thanks for that i had printed out that from saintlys link i thought that was correct but wanted to be sure gone too far to mess it up now! I will have a great weekend once i finish work at 4 today you too have a top weekend:p

Ok so the stay hasn't been granted yet well not that the court has told me anyway i have had a letter from barclays saying that all cases are being granted a stay till after the test case but nothing from the court so what form is it exactly that i need to take with me to court in case they do say there will be a stay on the case? If i don't reply tonight i'll not be on till 10 am tommorow works pc and im due to finish at 5 thanks x

The form i have is the n244 application notice on this it doesn't say anything about the particulars of claim all i need to fill in (i think???) is the box at the top left saying i want box c (without a hearing) level of judge which i enter district or deputy judge then in part 6 parties to be served i put defendant. In the top right hand side i fill in the date claim no etc then i just put that i the claimant and my name intend to apply for an order that removes the order of stay imposed on the above referenced claim because the claimant objects to the stay on the grounds set out in part c of this application notice then in part b of the form i tick both boxes then in part c i attatch witness statement and any other supporting evidence so i don't think there is any mention of me having to write the amount i am claiming for although it will show as i said on the soc that the interest is going up daily. Does this sound like i am going in the right direction i really cannot mess up now have spent so much getting this far and really need the cash??:-|
  4. Im sorry you have lost me there am i being stupid? I understand the interest goes up by the day and i wouldn't be altering the amount i originally was claiming as them charges have been applied to the bank account so do not alter so when i do my soc it prints on there the date the type of charge the amount of the charge which will all be the same as the original that i put in but the spreadsheet calculates your up to date interest so the interest will have altered from last time so what do i do here?
  5. I am just using the n244 to ask that the stay be removed not to alter any amounts or anything the only thing that will be differant will be that the interest on the claim will have gone up since i last did a spreadsheet back in june

I have got my statements that include all the charges ready i have 3 seperate ones i will also be updating my spreadsheet the day before i am due to go to court and will take 3 copies of that too. I have located the sticky regarding the application for removal of stay and i have printed off 3 n244 forms which i will fill in following the post 2 as told to in he sticky. I just now need to sort a skeleton arguement that includes case law that i will be relying on anybody got any links or advice where is best to go on here for me to find this information please thank you in advance
  7. Hi all can somebody help me please? I have been claiming back from barclays since February now and am supposed to be in court next friday 21st sept 07 at 2.15pm. The letter states that the claim be listed for a directions hearing and should last 15 mins. What do i need to do now? Do i still have to turn up with all the claims being put on hold due to the oft test case etc? What do i need to take to court with me on that day do i need my bank statements do i need my soc list or court bundles or anything like that? Sorry to be so stupid but i claim to have looked through the posts and am still unsure of what i need to be doing sorry please help x:???:

Thanks for your replies think you might be right on me being too late to accept the offer just been on barclays site and it says any offers already made will be honoured if the customer chooses to accept them so don't think i'd get that now. Never mind like you say persevere and i may get it all back with a bit of luck eh?

Ok been reading newspapers and online bank letters stating that due to this high court thing thats going on at minute with OFT and FSA etc all claims are to be put on hold or frozen my claim started back in Feb 2007 and i have a court day for Sept 2007 just when i thought i was getting close to my case this all happens! Now i'm confused i'm worrying in case i lose everything and end up getting nothing back depending upon the outcome at court and its got me worrying more since the barrister lost his case with natwest the other day. So i have read you can accept the original offer the bank made you well i originally declined this offer as it was only around half of what i was claiming but now i'm wondering do i cut my losses and take it am i liable to end up with nothing if i don't do this??? HELP I'M CONFUSED and i suppose panicking a bit too x x:???:

Phoned the number for Krysta and just get a answer phone so left message detailing my name a/c number court case no etc and asked to give me a call back but not heard anything from them should i call again or just leave it they may think i'm desperate if i keep calling and just make silly offers any ideas what i should do??

Hi Paul thanks for the reply the letter above is what i received regarding the court date so from my reading it doesn't mention to take any paperwork with me when i sent in my AQ i attached a draft order of directions and was wondering do i need to take what it listed in that to court or send it off anywhere??
  13. Thanks for your replies so do you suggest i just leave it all alone now and gather basic court bundle just in case it does got to court? Should i give that Krysta woman a call at the end of next month if nothing heard can't believe the court date isn't until sept thats ages off!!

The letter i have got reads "Upon the courts own motion TAKE NOTICE that the claim be listed for a directions hearing which will take place on 21st Sept 2007 at 2.15pm at Accrington County Court. When you should attend: time estimate fifteen minutes. PLEASE NOTE: this case may be released to another judge possibly at a different court. Cases are listed in accordance with local hearing arrangements determined by th Judiciary and implemented by court staff. Every effort is made to ensure that hearings start at either the time specified or as soon as possible thereafter. However, listing practices or other factors may mean that delay is unavoidable. Furthermore, in some instances a case may be released to another judge, possibly at a different court. Please contact the court for further information on the listing arrangements that may apply to your hearing" So what is my next step and do i have to take anything along to this court visit or just wait to my final hearing i have already began preparing my court bundle statements of evidence etc just not sure if i need any of this for this particular court hearing???
  15. Do you mean the litigation team at Barclays? If so then no where do i get the number and what sort of thing do i need to be saying to them?

Hi i've been claiming now since middle feb and today received a letter from court saying "Take Notice that this claim be listed for a directions hearing to take place on 21st Sept 2007 at 2.15pm in Accrington County Court.   18. Hi all struggling a bit trying to gather my court things together need to prepare my things for the draft order and i need to know where i can find statement of evidence and also copies of decided cases and other legal materials to be relied upon thankyou for any advice in advance

Thank you for your replies i will type up that letter now and send it off when the chat room was open i was advised that i might need to ammend my particulars of claim and had to fill in a form from court called the N244 form but this costs another £65.00 to file do i need to do this or can i just send in the letter?
  23. I originally only had 1 yr of bank statements so added up charges on them and times by 6 and just estimated my claim as advised to by some other STUPID site before i found this one. Took it all the way turned down offer filed court application received defence and AQ have just sent back AQ and now received full 6 yr of statements and when i've gone through them i am actually claiming a lot less than estimated!!! What is my next step do i have to ammend my original court documents do i phone the bank and court i really don't no what i need to be doing PLEASE HELP:idea: :idea: :idea: THANK YOU IN ADVANCE FOR ANY ADVICE:p
