Hi I have photographic evidence and hospital reports regarding the burns my wife suffered to her abdomen. with regards to the faulty shower im sure i can get the ex manager to testify that it blew up in his face and had flames coming out of it. With regards to the gas leak i have kept the transco report they issued when they came about the gas leak thats states nail through pipe. I have a copy of the reciept regarding the carpets. They had already relaid new and disposed of them before i had chance to return to the property with a carpet fitter!! No one but the manager was present upon my return and i wasnt given time to return with any witnesses regarding the so called stain on the carpets! Col
  2. SO what your saying is that the only rights I have are my statutory rights which give the trader the right to repair before replace. Even though i thought my warranty is the reciept that says exchange or replace?
  3. Hi I understand where your al coming from but im just fed up at being taken for a ride but other poeple. I wasnt consulted on price, nor given estimates. I was just told it hd cost £252 I didnt have enough time to get another person into the view the carpets they tore them up on the Monday. They had the keys. No, it was taken as is with the dog and shelves but the previous manager. However both the landlord and manager saw the dog in the premises and never said anything the dog being there nor anything about the shelves. I have a witness being the ex other manager that the shower exploded as he was there and saw it for his own eyes when he came to repair it.. Also the hospital reports gives us a good case for personal damage. If i was to compile the case i would include all the above. It just seems to be every private landlord we have takes our deposit for no reason. The last one we had kept our deposit because the new tenant gave backword and he needed the deposit for HIS mortgage repayments!
  4. No specific warranty was issued with the phone except the 12 month simple warranty. No warranty information relating to Currys, No paperwork relating to Currys except the receipt. The only thing that i suppose you could class as the warranty was the receipt which states: "PLEASE KEEP THIS RECEIPT. IT MAY BE REQUIRED FOR REFUNDS OR EXCHANGE" No mention of the wording REPAIR.   5. well it comes down to this. If you were walking in the street and someone came and stole £250 from you, would you A: Chase after them B. Think Oh well nevermind Id go for option A because thats how i feel, but if I dont stand a chance i would rather someone tell me before i commit ritual Hari Kari. Col
  6. Hi we moved out of our property last year. The manager came by to inspect the property before we left and said it was OK and that we could collect our deposit from the office on the Monday. However the next day, Friday,i got a call from the manager asking me to go back to the property. I arrived and he had lifted the carpets, There was a damp patch in the middle of the floor. I remember spilling some water there one week before. He said thats it was dog pee!! HE COULD SMELL IT!! Yes we had a dog who was house trained, who was known by the manager and all the neighbours. He was toilet trained, he hasnt nor has nor would urinate in the house. I disputed this. He said that we would have to buy new carpets with our £250 deposit. I said this was unacceptable as it was his word against ours. Anyway they went a bought new carpets with our deposit that cost £252, amazingly £2 more than our deposit, then had the cheek to say we not only owed then £60 in outstanding rent by the extra £2!! I told them not a chance. They have harassed me ever since for the £62. I did ask the manager if he could return my sky dish, quad LNB and wiring upon having the property signed off, he agreed. I do not to date have these (Approx cost £100). My wife and I were nearly killed by a gas leak in the house, Gas board paper work available. My wife was scalded by the shower, hospital notes available. The shower blew up nearly electrocuting my wife, witness available, damp in the house etc etc. They said we did not have permission to have a dog nor put shelves up. They said they had to redecorate? When we moved into the property there was a different manager who gave permission for both of these. He was very happy by the fact we have laid new lino in the bathroom and new carpet in the bedroom at cost to ourselves. WE LEFT THESE upon vacating the property Do i take them to court, threaten them with legal action or just walk away. The landlord come from a well known family who are notorious for intimidation but I don't see why we should pay for a carpet on here say. Col
  7. Hi Bought a mobile phone from Curry's in Dec 06. this has now gone faulty with its battery, stalk and memory card. I tried to return it back to the branch by phoning them first in the begging of march 07. They said the phone would have to be sent away for repair. I didn't accept this as my wife requires the phone at all times due to illness and that when i purchase the phone i also purchased a 12 MONTH WARRANTY. I was told it is there policy to send all phones older than 28days away for repair. I asked why i was not told this upon purchase, nor had any paper work supplied that states this. In fact I asked why this was not worded on the bottom of there receipt? They would not budge. REPAIR ONLY. In the end i wrote a curt and to the point letter to Curry's stating. 1. Why wasn't i told about this clause regarding repair. 2. why does it not state this on the bottom of their receipts. 3. They require the customer for business not the other way around 4. I look forward to a replacement phone 5. I bought the phone with a 12 month warranty, exchange or refund not a repair warranty as stated on their receipts. Today i got a phone call back from Curry's head office basically telling me to jump. They were not prepared to replace the phone, they would only repair. I asked them if this was their policy why i wasn't told about this and why does it not get stated at the bottom of the receipts? Infact there receipt read as follows " PLEASE KEEP THIS RECEIPT. IT MAY BE REQUIRED FOR REFUNDS OR EXCHANGE" They had the nerve to tell me that I SHOULD HAVE ASKED!!!! I am really peeved and angry now. Any advice would be welcome as I'm pig sick of being trodden on by so called BIG BOYS. from a big 6ft 5 fella!! COL
  8. Brilliant Thanks for all your help. However, i cant remember when my last payment was! How would i find this out without opening the floodgates again>? Would a credit agency hold these details? I was always a bit nervous in applying for my credit report as i felt it would cause me more trouble because they would ask for all my details>?
  9. The last time i went into the branch AFTER i had been defaulted was Approx FEB2003, and tried to work out payment back to them. I was then contacted by another collections department in Nov 2003. Is it taken from the time i was first defaulted which was in 2002 which would mean that its been 6 yrs now. Or From FEB 2003 whochmeans i have 1 more year left Or Nov 2003 which means i have 18 months left? I never once contacted them by writing to them about the debt. The act didnt specify the above nor could i get through to there helpine
  10. Hi I took a loan out for my parents, whose business was struggling back in 2000. They defaulted on the payments. I had in the mean time lost my job through a failed job transfer and applied for loan cover which i had taken out. They said i was not eligible for it because i was still alive or something. I couldnt afford the payments in 2001 myself and my parents refused to pay. The loan was defaulted and sent to collection in 2002. I have not heard anything from them since? How long will they look for payment for and how long will this still on my file? If its 6yrs wont it have been wiped fom my file now? They also defaulted on their AOL payments under my name back in 1999. Will they still be looking for payment as well, same as the Credit history. Im trying to sort my life ot andtese re hovering around me. I think ve managed to sort the rest out but could really do with some advice in regards to these. DT
