  2. Hi, I've got a bit of an update. To cut a long story short, it turns out the payment was rejected. It was approved on the phone, but there was a DD payment I'd obviously not accounted for, which I'd assume took precedence. After which, I had a new phone deal with a different number, the following month was when I moved house. While I left forwarding details with the landlord, I didn't receive any mail. So I'm rather frustrated that I've got my first default, especially for a debt I didn't know about. But the money was owed, so it's been paid.
  3. Thanks again Brig. I just got through to T Mobile Customer Service, they gave me the date of bill, details of phone calls recorded and was surprisingly helpful. After the initial annoyance, I might as well just get proof and solve it. I originally suspected it might have had something to do with the merger that happened in between, but maybe it was a genuine error.

Should I try contacting another T-Mobile department, as they or is it just for reference that they will be the only ones who can remove it. 2.Will do, I've used the Experian Credit check month trial many moons ago, is there another one with a free trial you could recommend? 3. No, the letter from T-Mobile just states that I supposedly owe CapQuest instead of T-Mobile, no mention of defaults. That information was included in the letter from CapQuest. Other than that, zero dealings since the phone call over 2 years ago. 4. Yeah, I figured that would probably be neccessary. Much appreciated.
  5. Hello I've received a letter from both companies mentioned in the title, it's relating to a contract that ended about 2 1/2 years ago. I'm certain I paid the final bill via card over the phone and confirmed it was all finished and closed. I was at the address for a further 6 months and received no further communications from that phone call until this letter. The amount is only £33 and the letter states that a default has been applied to my credit file. I immediately phoned CapQuest to find details, who were unable to help and I then phoned T-Mobile who said they are no longer dealing with it. Having read through some similar situations, I've realise I should now only contact CapQuest via letter if at all. I'm reluctant to spend time getting old bank statements and demonstrating payment, but I want the default removed. Am I able to charge for my time and/or compensation for a default incorrectly applied in resolving this situation? Also I'm about to send a letter to request evidence of money owed, is this advisable? Many Thanks if you can help.
  6. Hi I used to live in a flat with 3 other tenants, all bills were seperated 4 ways. We changed one of the tenants as the girl in question was a bit of a nightmare housemate. We didn't always keep track of all the bills and paid them as and when we received them. Our Council Tax account changed number, without us being informed or notified, just a new number on the page we didn't see at the time. We received an letter from a company acting on behalf of the council, around a year later advising that several hundred pounds was owing. We investigated and at that time realised that the number had changed and it was outstanding. We all discussed and agreed to pay the amount outstanding, each paying a quarter of the bill. We had incurred an additional charge from the company visiting our house, when the bill was delivered. We then received nothing again for another year until we all went to move house. The bill stated that one of the payments hadn't been received and an additional charge had again been added. We have given phone numbers and an address to the council and attempted to get the girl in question to pay in every way possible. They have said that they have conducted an exhaustive search for her, which I find particularly irritating as they have never contacted us other than letters notifying of an additional charge or threats. The council have said they will submit a liability order, but how did they send bailiffs in the first place if they don't have one. If they did get one, surely I should have been notified of it. Is there a way of finding whether they applied for a liability order and if so, why we were not told about this. Any assistance would be greatly appreciated, we are now going to pay the outstanding balance and pursue the girl in question through money claim (small claims online), but I would like to know if anyone has any suggestions or advice. We have agreed to pay the amount outstanding in 2 payments on 1st Oct and 1st Nov, though we hope to get her to pay it before then however unlikely.

I don't think taking a percentage of the money regained through court would be a wise decision, I also think the initial payment idea almost turns the idea of the website around and turns it into another money grabbing organisation. Internet advice is a cheap commodity and therefore I always hope the best advice is the cheapest. This is the case here, and although I intend to contribute after my impending success, a forced charge is not something I like the sound of and I don't imagine many others would too. I would probably suggest maybe having a few adverts down the side as well as contributions from grateful users. Adverts are annoying, but are common place on most websites, I don't think many people would steer clear of the sound advice for fear of a beer advertisement. Maybe see if you can get a bank to sponsor you for a chuckle, only joking. But I'd still be happy to accept a few flashing banners or something than see the website impose a "commission fee". Good work anyway guys
  8. Hello, great site. Have looked and read as much as poss in the last two days, but haven't had a breakdown of what someone has successfully claimed back. I fully intend to retrive all monies paid where manual intervention was not needed. £10 for disclosure of information, court fee's and 8% debit interest on the figures dependant on age of 'card misuse'. But here's my question, has anyone successfully claimed extra money for letters sent to Smile, money for estimated cash spent on phone calls and finally money for my time spent on this matter. I was hoping to push for a bit more, as I have been given the tennis game between bank and several services and shops. So will Smile more than likely take the case to court if I request per say, £20 for phone calls and £100 for letter and my time. Just want to get everything I'm intitled too, any advice handy pointers would be muchly appreciated. I am sending off the initial DPA request letter today, so hoping I will have a response before too long and can then get a little something extra for my troubles. Great site guys, sorry if I missed the answers staring me in the facein forums, have read everything that I could;). Any further help would be greatly apprecaited I hadn't heard the phrase card misuse relating to fines before the bank said it the other day, made me chuckle with annoyance at the term when their the ones misusing your account..... Kind of like Evian being spelt Naive backwards!
