  1. harrassed_senior: letter sent as advised by yourself - thanks
  2. Thanks phil and surfer01 - they shall be informed that they won't be getting this info. Cheers, Craig
  3. I have received a reply from the DCA... "Dear Mr *********, If you are unable to pay the full outstanding balance in a single transaction, then your are required to provide us with an up to date financial statement and proof of your income. We should then hopefully have a better understanding of your financial situation and we may be able to accept monthly repayments. Please be advised however that we are not obliged to accept any offer you make. Your account will be placed on hold for a period of ten days whilst we wait for the above documents. Yours faithfully, Luke Gottschalk Collection Officer Offline Collections Department 1st Credit Ltd Switchboard: 0843 320 0050 Fax: 0843 320 0070 Web: www.1stcreditltd.com"

  7. Email from the water DCA: "Dear Mr *******, As we are sure you can appreciate, due to the length of time this balance has been outstanding we do require payment in full. Please inform us when you will be in the position to raise the funds that will enable you to do this. Yours faithfully, Luke Gottschalk Collection Officer Offline Collections Department 1st Credit Ltd" My reply: "Hi Luke, Payment in full would take me the best part of 12 months to save up for. Please can you confirm in writing that you are unwilling to accept an offer of anything other than the full amount. Then when it goes to court I can present this as evidence that you are refusing an offer of payment. Kind Regards, Craig *******"
  8. @harrassed senior - Thanks for the info - Just had a look but couldn't see a letter relating to them prooving the debt - Am I doing something wrong?
  9. Other than the account number and an amount they havn't really proved anything. I know that I owe them the money, I just want them to stop demanding the full amount because they just wont get it.
  10. Hi Guys, As I was working away most of November/December I appear to have forgotten to reply to say thanks. No longer living at the house, the ex got a new house and I've got my own place now so it worked out ok in the end. Cheers, Craig
  11. Hi Everyone, I have a few debt collectors wanting me to pay for the electricity / gass / water for a house I used to live in before I split up with my partner. I have a few questions really. 1. Can I demand that they send me a copy of the CCA (I dont remember signing one...) ? 2. What can I do when they refuse a payment I can afford on a monthly basis? 3. What can I do when they point blank refuse anything but the full payment in a timeframe in which I would not be able to aggregate the required amount? These bills we're run up just before I lost my job... Any ideas? Thanks, Craig
  12. Forgot to mention: The reason they gave for being unable to insure the house was that the girlfriend isn't working, but the house was being paid for mostly by housing benefit anyway as I am in the process of starting my own business...
  13. Hi, Bit of a messy one, was wondering if anyone can tell me where I stand on this one... I split up with my girlfriend about 2 weeks ago, I asked the landlord to change the house over to the ex. They went away to talk to the estate agent who manage the property. They then informed me that they are unable to insure the property that my girlfriend and kids are living in and will have to give notice to quit. Is there any way to stop them kicking the ex and the kids out? Cheers, Craig
  14. Thanks Scott and yourbank, the letter doesn't say "full and final" on it, I'll scan it in tomorrow for you to have a quick look at...
  15. PS, I wont be accepting the insultingly low amount they've offered
  16. Received 2 letters today from halifax, one per account: Account 1's charges total about £350, they offered me £175 in settlement Account 2's charges total about £1350, they offered me £196 in settlement Now to figure out what I send them next...
  17. I didn't sign anything it was all done over the internet
  18. Information never arrived, and now they think that sending a debt collector round is going to help their cause... I'm going to send the "don't bother sending the debt collector" letter, if I can find it... Any idea's what else I can send them?
  19. Got a reply saying they've asked the client to forward all relevant information to me, so we'll see if that ever arrives
  20. anyhow, so you have sent in your charges reclaim? - Yep can you plead fin hardship? if so you might get them back - Yep this is ofcourse a bank a/c isn't it? - YepFrom what I read if they charge you and you have started a lower paid job (just started contracting and didn't really make much the first 2 months) you qualify as being in financial hardship... I suspect that they'll cough up - after a push
  21. Sent 2nd letter and received a "financial profile questionaire", basically trying to identify if I'm in financial difficulties, filled it in and sent it back... Hopefully they'll stop charging me soon!
  22. Hi, I'm needing to send the following: http://www.consumeractiongroup.co.uk/forum/data-protection-default-issues/149449-put-your-credit-reference.html#post1581179 But I'm struggling to find where I should send this - does anyone know where this should be sent?
  23. Cheers dx, when they send the "financial statement profile" that they now send to weed out the people who aren't in financial difficulty, do I fill that in? or ignore that and send the 2nd template letter?
  24. Hi, I have a second account with Halifax which is about £200 overdrawn because Halifax refuse to stop charging me and have now defaulted me and passed the debt onto a DCA. Even after its gone this far, should I send the bank charges template letter (the one that demands the money back) or, should I just see if they'll actually take this to court? If it does goto court - I presume due to the other high court cases there is now a precedent set?
