  1. No....the work ground to a halt because the builder never turned up to complete the work, or would only turn up at the last minute (sometimes on a Sunday afternoon). He would then promise to come round the following week to continue his work and they would not see him until the phoned to ask where he was.

  3. Hello, My parents decided to have some structual work done to the house, which was started in June last year, the company gave a verbal timescale of 5-7 weeks work. We are now in Feb 08 and the work is still not completed, my mum has withheld a sum sum circa £1300.00 and told him she is no longer prepared to allow him to finish the work and she wll use the monies owed to get the work completed by someone else. The rear of the premises has been left in a condition that its not safe to use I.E large holes, jaggered concrete and also interier work not completed or completed to a poor standard. The builder in question has wrote a letter stating he must be given adequate time to resolve the issues and must settle the outstanding balance within 7 days. Questions: Is my mum within her rights to withhold payment? The builder has been given since november last year to resolve the issues and has failed, can this be used as 'adequate time' to resolve them? In the letter he is quoting from the consumer direct website that payment must be made and to give him reasonable time to complete the work. I can not find this information is it true? Is he within his rights to demand payment within 7 days? Thanks Lee
  4. I have already done the statement request once on another closed account and all I got was a 1 page document stating no details found, if this acc is over 6 years old can I still contest the debt? Thanks for the details Lee
  5. Lloyds TSB If the DCA don't supply the info, can they still chase the debt?

  7. Hello All, For the last 3 years I have been getting threatening letters of court action from around 7 different DCA's for a debt I don't believe I owe in full which has been sold to Lowell. Every time I received a letter, i phoned that DCA and asked them to provide me with proof (Via statements) of where they have got their figures from and for 3 years they have never been sent to me. I had another letter today so i decided to contact Lowells direct, to try and sort it out. I was told I had 2 options 1, Negotiate a settlement for the debt or 2, they will get the statements I require on the understanding once they have gone down this route there would be no negotiation I would have to settle the debt in full. Obviously I stood my ground and asked for the statements of which they said they will send to me and they will be in touch. Couple of questions: 1, This debt is from a bank account from over 6 years ago, it is already on a CCJ which I was paying 4 years ago. Can they still chase this debt? 2, The debt will mostly be made up of bank charges so this is the reason I want the statements and don't agree I owe the full amount, if Lowell provide the statements were do I stand as the debt is no longer with the bank? 3, What do I do if they don't provide the statements they have promised? This debt is on my credit file so I want to resolve it. Thanks in advance Lee

(I cancelled within 2 days of signing my agreement and had not received keys or agreed specific date to move in) I am in now way qualified to give lawful advice, but what does jump out at me is, under any contractual signing, both parties have a cooling off period in which to back out of the agreement (I beleive normally 7 days). Colin has stated in his post, he cancelled after 2 days, surely this is his right under his cooling off period?? Lee
