  2. Hello This is my first visit to the Barclays forum, I was previously loitering around the HSBC section but have no need to anymore - hurrah! Anyway, I am going to be claiming back for my husbands loan account with Barclays, the account has been closed for nearly 2 years and we no longer have the account details available. When the DPA letter was sent, we included previous addresses etc to help them trace the account, however, we have received a letter back basically saying "With no account number, we can't help you." I get the impression that they have not even looked! Somewhere in my head, I thought that there is some sort of rule (maybe FSA?) that means records have to be kept for seven years? Can anyone help me out and let me know if a) this is a rule? and b) who made this rule? Any help would be much appreciated! Thanks Grace
  3. Figures have been checked and are all correct. I am convinced now that they were only looking at one account. Draft of letter to send back to solicitors below - comments welcomed! Thank you for your letter dated 1 June 2006, offering me £1674.04 in full and final settlement of this claim. I am declining this offer as it is only 68% of the claim amount. You stated in your letter that you were unable to reconcile the amount claimed with the charges applied to my account. I am attaching details of the charges that I am claiming back, please note that they apply to TWO accounts. I would like to re-iterate the amount I am claiming: £1962.81 for the actual charges taken from accounts numbered XXXXXXXX and XXXXXXXX, including the cost of statements required to make this claim. Breakdown attached. £366.67 8% interest of the charges taken £120 Cost of filing claim £2449.48 Total Claim Amount Yours sincerely Me
  4. I've heard nothing for ages and then today received 2 letters. One from the court "Notice that Ackknowledgement of Service has been filed". One from DG Solicitors, offering me £1674.04. This is somewhat short of my claim of £1962.81 for charges, £366.67 for interest and £120.00 for costs = total £2449.48. In the letter it also says "We are unable to reconcile the sum you have claimed on your Claim Form with the charges applied to your account". Therefore, my next steps are going to be: a) Double checking the charges and figures b) Sending a copy of these to the solicitors to 'prove' the figure. The claim covers two accounts and I wonder if this is where they are going wrong - not to worry, I'll point out their mistake! Is this the best plan of action? Has anyone been in a similar situation? Any advice appreciated. Thanks Grace
  5. Moneyclaim details PM'd as requested. In the post today, I got: 1) Confirmation of the claim submitted on money claim 2) Letter from HSBC, totally standard (all the same wording as first partial refund offer) about from this time they are now offering approx 75% (last time they offered 50%). I guess they'll know the answer to that offer when they receive the claim details! Hee hee!
  6. Replied to offer saying that I wanted the full amount by 22nd May but have had no response so moneyclaim online - completed last night (22nd May). Feel abit nervous now but also interested to see what happens next!
  7. Oops - I am using the wrong terminology for the letters I think! The letter from HSBC offering full and final settlement for half the amount was in response to my letter to them which said "you have 14 days to give me my money back damnit!" (it was along those lines anyway!) So I'm going to write a very polite "thanks but no thanks" letter, rejecting the offer and advising them that I will be pursuing this in court. Thank you for your help - I will be sure to make a donation as soon as I am able! Cheers Grace

Since I last posted: 24 April - preliminary letter sent and not received by HSBC (so they say) 6 May - preliminary letter sent by registered post 10 May - acknowledgement received 16 May - received offer of £975 in full and final settlement (claim amount £1962.81) with expected blurb about how they think they would win in court etc I say - No Deal! ;-) I have read the FAQs but I would just like to clarify, is my next step to cease communications with HSBC and start the Moneyclaim thing or do I have to officially reject the offer in writing before I can do this? Also, I am right in thinking that it is at the Moneyclaim stage that I add the 8% interest? Any advice would be much appreciated. Thanks Grace
  9. Hello I have been lurking on here for a few days and think this is a great site. Last weekend I scared myself by working out that I have paid near enough £2K in charges over the last 4 or 5 years :o . After reading the FAQs and using the letter templates, I posted off the preliminary request for a refund to HSBC on Monday. No news as yet but I have never been so eager to get home from work each day to see what I've got in the post! Any advice for what is coming next would be appreciated. Thanks Grace
