  1. Thanks that's brilliant. The only thing I'm slightly nervous about is liability for costs. Is there a limit and what costs am I actually liable for?!
  2. I have had further charges of £118 added to my account! Can I still reclaim these - plus the £10 data request fee I sent originally!!!! Also is there anywhere I can find out what the difference between fast and multi track are (and other tracks). As I am filing three claims for amounts ranging from £2k to £11k and all this legal stuff on tracks is frying the old grey matter!!

Hi, have read lots of bits on here, but am still unclear whether I should attempt to claim any of the following: I switched to GMAC about 14 months ago, but between 2002 and 2005 Abbey National charged me a High Value Loan Fee (£2078.96) on taking out the mortgage, then over the course of 3 years monthly arrears fees of(£172.50). Then on switching mortgages they charged a deeds handling fee (£225.00), early redemption charge (£4938.00), variable discount charge (£5021.16). What (if any) can I claim back? I have written to Abbey asking for a breakdown and explanation of charges...

  5. I bought a Renault Laguna from Renault UK, finance by Lombard Vehicle Management, in November 2002. The term was four years, with a return date of December 8th 2006. However, two days prior to this date (and despite regular servicing in accordance with Renault guidelines) the engine seized. I had done 90,000 miles, 30,000 in excess of the agreement, but was willing to pay the additional £800. Renault could not explain why this had happened and could only advise me that the engine needed replacing. With it impossible to do this inside two days, I had to agree with Lombard to agree to pay the residual payment on the car (£5046). I also had to pay for a reconditioned engine and costs of installation (Renault's quoted price was out of my price range - and worth more than the car). I haven't paid Lombard a penny yet (largely because they've not invoiced or called me asking for payment). Can anyone advise me of what options I have?

  8. I have filed my claim for just under £10k at the County Court. What should I do next, and am I liable for any more fees and costs if things go pear-shaped??? I have seen £750 mentioned, but can't find this on the court website anywhere?

  10. Saint Luco - No haven't mentioned contractual interest at all... should I be fussed about it?
  11. Many thanks fendywether - that's reassuring . I have other things (credit cards, other banks etc) to do. Should I ask for charges plus contractual interest... then only add 8% when I go to court? And should I add 8% instead of contractual interest (or as well as) .
  12. I am filling in the advanced interest calc spreadsheet - but am a little confused. I have completed it, but is there anyone who would mind flashing their eyes across it before I send it in.
  13. Have I messed up? I sent my LBA with the simple excel spreadsheet requesting charges plus simple interest at 8% APR (but no contractual interest)... I have just re-read guidelines and they say you should NOT do this - but ask for contractual interest. However, since the 14 days are up... I have filed my N1 including charges, interest at 8% APR, daily interest until settlement and court costs - but should I have included contractual interest and therefore have I messed things up before getting to court!?
  14. A few queries: Can I still claim back charges from Capital One, even though they are now only charging me £12 per month if I go over my limit? Also, should I include these £12 charges in my claim? Do I use the same standard letters that are used for the banks? I have my statements, so don't need to request charges information. However do I need to write concerning manual intervention? Or should I include this in the Preliminary Approach for Repayment? EG: Additionally, where there has been any event in my account history over this period which has required manual intervention by any member of your staff, or any other person, I require disclosure of any indication or notes which have either caused or resulted in that manual intervention, or other evidence of that manual intervention in relation to my banking business with you. If you are unable to supply this data because there has been no such manual intervention, then please be so kind as to confirm this in your response. Any help appreciated!
  15. I had a loan with Clydesdale Financial Services - and they charged me £247.50 in 'Letter Charges' over the period of the loan agreement. Can I reclaim this? If so do I use the standard templates?
  16. Am filing at court on Wednesday. Have filled in N1 and copied three times. Do I give this (plus schedule x 3) all to the court? And do I need to send copies to the bank?
  17. Stuart Highley has written asking me to give Natwest more time to respond. My 14 days since sending the LBA are up on Monday. Any advice would be appreciated...

  19. Thanks Nattie. I have done exactly that, but I have updated my charges. What should I do next, start preparing to launch court action? And can I still go via county court even though my claim is over £5k?
