  1. It wasnt much longer than the 40 days to be honest, I got a letter a week before the deadline ran out, and they arrived about a week after the deadline. You have certainly given them long enough now, I would stick the non-compliance in as soon as posisble. Hope this was helpful.
  2. Hi everyone, My claim comes to a little under £1500, but when I add the 8% it'll take me over the £1500 allowed for a summary cause, does this mean I have to raise an ordinary cause? Many thanks FT
  3. Has anyone started a summary cause against their bank in Scotland? Not sure of the way forward. Any help appreciated as the bank have had their 14 days to reply to my LBA. Many thanks FT
  4. It's court time. On Tuesday the 15th May I shall start formal proceedings against the Clydesdale Bank in Scotland. Looking for a little advice though. The amount I'm claiming is just under 1500, however as I will now add the 8% interest since its going to court, this will take it to just over 1500. Does this mean I cannot now use the summary cause under Scots Law? Couldn’t see the answer in faq. Any comments or suggestions appreciated. FT

  6. Sent them my prelim request, got the standard reply about terms and conditions and how I signed up to them etc. Posted my LBA yesterday, 14 days start now! Wish me luck! FT
  7. Well, I've added everything up and tomorrow I send my letter asking for just under 1500. Here we go!
  8. My statements have arrived! Hurrah! I'll count the charges up over the weekend with a view to writing back on Monday. Wish me luck!
  9. Has anyone had a letter from the people in Leeds saying that will not be able to supply your statements on time? I got a letter saying just that a couple of weeks ago. It is now well over the 40 days and so I phoned them this morning to find out more. Of coarse, this being the Clydesdale I'm not allowed to speak to anyone in Leeds direct. Rather they said they enquire on my behalf. They call back soon afterwards and explain they are simply so busy and that they cannot tell me when I can realistically expect my statements. I feel like Ive fallen at the first hurdle! Anyone else having this problem? Is there anything I can do? Wont this mean I'll lose out if I can only claim the last 5 years (as I'm in Scotand) if there were any charges on my account 5 years and a month ago? Or can I claim 5 years from when I sent my letter? Your time and assistance, as always, is much appreciated. FT

I have just sent the following letter to my home branch of Clydesdale bank. I read that the Clydesdale are notoriously bad for getting back to people and may need your continued support. For that, I thank you in advance. Without seeing the transactions, I reckon there may be a few thousand quid at stake here. Anyway, here is my first letter, penny for your thoughts: Mr XXXXXX XXXX XXXXXXXXX XXXXXXXXX XXXXX 02 Feb 07 Clydesdale Bank XXXXXXXXX XXXXX XXXXXXX Data Protection Act disclosure request Dear Sir/Madam Regarding: XXXXXXXX/XXXXX Under the Data Protection Act 1984 and 1998, and including the right of subject access under these acts, I would be grateful if you would supply me with a complete list of transactions and charges relating to my bank account since February 2001. Alternatively a complete set of bank statements for that period will be acceptable. Please deduct the statutory maximum fee of £10 from the above account. I understand that you have 40 days in which to comply. My intention is to reclaim any money lost on disproportionate penalties levied against me. You may be aware that due to massive media attention you may receive more letters like this one. You may also be aware that every time you receive one of these letters it will be followed by a request for a full refund of any disproportionate penalty charges, allowing you 14 days to do so before further action. I would therefore be grateful if you would refund all these charges dating back 6 years immediately and you will not incur the court fees or your solicitor’s fees. I am grateful for your time.
