  1. Just a quick update. The deadline for the CCA request has now passed(21/02) and my friend has still not received the CCA. However he has noticed that they have taken the £1 payment from his account for the request... is there anything that can be done now that the deadline has passed? Cheers

  3. Hi Guys, Just to update you, my friend sent the CCA request on the 4th Feb which was received by Thames on the 5th. He then got a reply which is exactly the same as the one in the first post. A second letter was sent on the 11/02 and was recieved on the 12/02 by Thames and the letter restated the CCA request with another £1 for payment. Today he received this letter: What should he do next? Thanks in advance!
  4. Hi guys, A friend of mine received exactly the same reply from Thames and also received his £1 cheque back. I just want to ask what shall he send them in reply to the letter? As someone has mentioned above he needs to remind them of the deadline of 12 working days...is this from receipt of the original letter he sent? This was signed by them on the 5th Feb. P.S He told me the debt was from 11 years ago!
  5. Hi, I just got the following letter back from the abbey; What should my response to this be? The offer is £41 less than what I am owed so I am unsure if I should accept or not!
  6. Abbey have sent a letter this morning saying they will pay me £377.76, which is the full amount via cheque! Thanks for everybodys support on this site!!!

  8. Hi, I thought its best to create a seperate thread for my other account as otherwise it will become confusing. Just so people know I am claiming £126 in total and have sent off the AQ, however I just got a reply from the courts and have no idea what I am meant to do next! Here is the letter typed in full; Before DISTRICT JUDGE STONER sitting at Manchester County Court,Courts of Justice,Crown Square,Manchester,M60 9DJ. Upon the courts own motion. The court has made this order of its own initiative without a hearing.If you object to the order,you must make an application to have it set aside,varied or stayed within 7 days of receiving it. IT IS ORDERED THAT 1. The action be stayed until 23rd March 2007 for settlement by mediation/negotiotion or for narrowing the issues. 2. Within 7 days of the end of the period of stay the parties shall jointly notify the court in writing of the outcome of negotiotions and what,if any,directions are required.Failure to comply with this direction or properly engage in negotiotions may result in the application of sanctions.On receipt of such notification the court file shall be referred to the District Judge for further directions. Dated 15 February 2007 What the heck does this mean, what is my next step....I have no idea Thanks in advance!

  12. I have one more question. The deadline for the AQ is 20th Feb. If DG agree to pay me the remaining monies owed should I still send the AQ in because I am guessing it will take a few days to put the money into my account?
  13. Well basically when I filed the claim online, I sent a schedule to both the court and to DG solicitors. However a letter came from HSBC saying that they will pay £223 and asked if I would accept this as full and final settlement. I responded back to HSBC saying I would accept only as part settlement. I still need to claim £412.15, but i will give dg a ring tomorrow as I have a feeling they do not know about the part payment which has been made(I have checked and it was paid 2 weeks ago). If they offer me soemthing close I will probably settle. Thanks for your help.
  14. Hi, prior to defending the claim hsbc have put in £223 into my account. I have already send them a letter stating that i will only accept this as part payment and would be claiming the rest. Now that I have recieved the AQ, where abouts on the form do I mention this, to make the courts aware that some of my money has been repayed? Thanks

I just have a few questions about the court bundle. 1) Looking at post #50 above am I correct in saying that I will have to provide a witness statement along with bookworms bundle? 2) When I send in copies of my statements, in the bundle, should I just include just the page where the charge occurs or send copies of the entire statement? 3) How should I send the bundle. Just put the bundle in a A4 ringbinder, then post it or.......? Thanks

I finally obtained a reply from the judge, remember I sent in both allocation questionnaire and draft order; DISTRICT JUDGE JONES has considered the statements of case and allocation questionnaires filed and allocated to the small claims track. 1. This claim be allocated to the small claims track 2. Parties shall file and serve the following not later than 4pm on 2/3/07 (a)The written statements of evidence of any witness whose evidence is relied on in support of defence of the claim (b) Copies of any documents which a party proposes to rely on 3. The hearing will take place...... 4. It is important to comply with these directions.Failure to do so may result in the hearing being adjourned or the claim or defence being struck out. Does this mean the draft order has been accepted? If it has/has not been accepted what documents do I need to send to the courts? Thanks
  17. Hi, just wanted advice. HSBC have given me a credit of £223 as GOGW. I am still owed another £300 and have already agreed that the £223 be part payment. My question is , as this is still in the mcol stages, who should i contact to say i have been payed some of the money back?
  18. Just an update. I posted the allocation questionnare and draft order to my local court about three weeks ago. I rang the courts today to get an update and they said the judge would get back to me within 7 working days! Suprised Abbey havn't caved in yet cos the claim is only for around £350!
  19. They have till the 1st Feb to defend so not long now! Incidently I have another HSBC account which i was claiming around £750 and today HSBC have written saying they will give me £680. They are lucky as today is the deadline for filing a claim! I will accept that offer as £70 is not worth going to courts for!
  20. Hi, thanks for your reply. I have already sent a copy of the schedule of charges to both DG and the courts. So this basically means, at this point, i just need to send a reply to HSBC accepting the payment as part settlement and will be going for full amaount?
