  7. Hi Lickthewallfatboy The dispute is very similar to the one First Trust have lodged in my case: 'The claim is denied. The Respondent disputes the claim. The money claimed is not due and owing to the applicant and all fees and charges levied were done on foot of the terms and conditions which governed the aggreement between the applicant and the respondent' I think they are just standard disputes. Let them argue in court that the charges are not contrary to the Unfair Terms in Consumer Contracts regs - I don't think they will have a leg to stand on. I'm just sorry my court case is so far away - but then they say patience is a virtue. Flo
  8. Hi James I have a court date of 26/09/06 with First Trust. - I am quietly confident. In their Terms&Conds they actually state penalty charge which is contrary to the Unfair Terms in Consumer Contracts. What does your solicitor think? Good Luck Flo
  9. No nothing from First Trust or their solicitors. The last correspondence I recieved was from the Court. They probably think they have plenty of time as the court date isn't until the end of September. Ah well sure isn't the interest accumulating on a daily basis. When the court write to you they will tell you that you have to submit all relevant papers 10 days before the hearing. Anything I can help with just shout!!! I'll keep you posted on anything I hear. The big four here think they can do what they like and they are currently being investigated by the Competion Committee because of their high charges. The Consumer Council for NI in conjunction with Which? reported them to the Office of Fair Trading who in turn commissioned the Competition Committee to start the investigation. They know they have that going on - so they won't like us fighting them through the Courts. Keep the fight up - we will win in the end!!!!!
  10. Hi Lickthewallfatboy I have gone through the dispute part with First Trust. They filed a dispute on the morning of their deadline with the court. You will get a letter from the court in the next few days assigning a court date for the hearing. It will be well into September/October because of the summer recess in Northern Ireland. First Trust had to respond to the court by 6/7/06. I got a letter a couple of days later informing met that my court date is 26/9/06. It is also in Craigavon. Mine is not for DPA disclosure but for the fees. Tranfer to civil means you will get your date in Craigavon. If I can help in any other way give me a shout Flo
  11. Hi Paul Welcome on board. I see we are going from strength to strengh against First Trust. Don't worry - I am quite prepared to go to court. I have paid the £62 and have nothing to lose and everything to gain. At first I was a little phased that it had got this far - but now I am quite looking forward to it. Pity its so far away because of the courts summer recess in N Ireland but I'll just have to excercise a little patience. I'll keep you posted (and if I can help in any way just yell). Flo

  13. Hi Big Aid You will hardly have enough room on the Small Claims court form. Just give a brief discription of your claim ie how much, interest, and on what grounds you are claiming. If it goes to small claims and they dispute you will be asked to submit all nesessary documentation 10 days before the hearing. If I can help in any other way just yell. Flo

  17. Hi Jonni I have been charged £30 per annum for an overdraft facility. If I use this once in any quarter I am charged for each transaction made on my account ie DD, Standing orders, taking money out from their own ATM. It ammounts to about £40 every quarter. I have been charged the penalty charges on numerous occasions. I have claimed about £1000 for the charges and about £1000 for the referral fees. This is were I have made my mistake. Any help would be appreciated. Thanks
  18. Hi Jonni Sorry for confusing you. We pay £30 to set up and O/D facility then each time you use it the bank charges you for every transaction even when you are in credit. This always ammounts to quarterly charges on top of the penalty fees. I thought we were being penalised for using a service already paid for!!!   19. I have made such a BIG mistake. I thought the quarterly charges were penalties and claimed them when I lodged court papers. I thought that we were being penalised for using a service already paid for. In the First Trust you pay £30 to get an overdaft and even if you only go into in once in the quarter every transaction is charged for during that quart even if you are in credit. How stupid have I been. I checked the NI Court Service online today - First Trust have lodged a dispute!!! I haven't got the papers yet but any advice would be very much appreciated. I don't know what to do now.

  21. Hi wjs501 Welcome to the site. Great to see another one from Northern Ireland joining the fight. Don't expect them to be forthcoming with your money at this stage. You will probably have to take it right to the court stage. I am waiting on First Trust responding to court papers at the minute. They have tried to stall me every step of the way.   22. Hi Richard To do this just right click over the top of the letter. It will then give you the option to 'select all' - Click on it and it will all highlight in blue. Right click again and then select 'copy'. Then open a new document in Word. Right click in it and select paste. After you have done this you can edit the document to suit yourself. Delete all the xxxxx etc and put in all your details Again if you need anything else just shout!!! CHEERS
