  1. Hi all, While I was on holiday, enormous bulging cracks appeared in one of my back rooms. I've spoken to the insurers, and they'll be coming round in the next couple of days. I've also spoken to my neighbour, who's told me that my house had a subsidence problem in the 80s! There's also a concrete floor in the room with the cracks, and now I come to think of it this might be explained by previous subsidence. This didn't come up on any of the surveys when I bought the place, neither was it declared by the seller. As far as I'm concerned, I bought a house without a history of movement, and got appropriate insurance. My big fear is that the insurance company will void my insurance due to the house's history, even though I bought the cover in good faith! Has anyone got any experience/advice on this? Thanks, L

  3. Hi all, I've got Aktiv chasing me for a statute barred debt. I've sent them the standard statute-barred letter. I was hoping for the 'you have a moral obligation' letter in response, but instead I got two letters, one asking me to call to discuss the issues raised in my letter (I won't) and a second informing me that I was the debtor, and that they'd tried to contact me on several occasions. Are they trying to imply that the debt is therefore not statute-barred? They don't have a leg to stand on, surely? They can't have been trying very hard to contact me as I've been on the electoral register for the last 10 years! So, should I just ignore the letters, or send them a 'stop harrassing me' letter? I don't want things to get nasty! Cheers, L
  4. Thanks 42Man! I'm a little concerned about some of the wording in letter M. I have moved since this default, and I guess Thames Credit have tried to contact me in the past. How do I know that they haven't tried to contact me? If they've sent a letter (or possibly managed to fabricate one) will the debt not be statute barred? I'm sure I haven't acknowledged the debt myself. Thanks again, Liam
  5. Hi all, I've just received a letter from Thames Credit, asking me to call them to confirm my address (or else have something put on my file or some nonsense). Having checked my credit files, I came across something on Callcredit - an old overdraft that I'd pretty much forgotten about. There's a default on there, from July 2002. I'm quite confident that this debt is statute barred, and there's no mention of any CCJs. My only worry is that the credit file says I have a default listed in the last 36 months for that previous address, but when I go into it the default is from July 2002. Aktiv Kapital have however 'updated' my file. I'm not sure what this means. Will people searching my credit file think that I've defaulted in the last three years? I don't know what my next move should be... should I call Thames Credit and sort this out, or just ignore their letter? I don't see why I should bother calling them when they're chasing a debt they know is unenforcible. Can they harrass me at my address, even though they don't know for sure that it's me? I'm worried that if I call them they'll get hold of my number and make my life hell. On the other hand, I'd rather not bury my head in the sand. I'm a bit nervous about the sort of tactics they could employ. Any advice? Thanks, Liam
  6. Thanks for the tips! Can I reclaim the charges if the debt has gone to Aktiv? And I'm a little concerned that too much quibble will turn them nasty, which is what they want, I'm sure.

Hi all, I've just received a letter from Aktiv Kapital on behalf of Lloyds TSB, demanding I repay them £600 for an old overdraft that I ran away from when I was younger and less responsible (five years ago). I'm not disputing the debt, but I do have a question. Does anyone know how this is likely to appear on my credit report? Will it be a default, and if so, will it be dated from 2002, or from today? I've really been trying to clean up my act these last few years, if I get a fresh default I'll be really depressed! Does anyone have any tips about settling accounts with these people? I'd rather avoid giving them my phone number. Thanks for any advice!
