  1. Hi We are due to go to court very soon and was wondering if we have a good defence or not? We have been paying NR through a DMP with CCCS for the last 4 years and they were the only of our creditors who didn't stop charging intrest etc. A few months ago they asked for arrears of £250 to be paid before they issued a defult notice, but after speaking to NR it became clear that if I paid the £250 then they would just keep demanding large payments every so often which was not affordable or fair to my other creditors. So they went to court without me knowing and the judge ordered that we pay the full amount of £5941.38 immediatly. I sent a template letter asking for a redetermination at our local court. We are now going to court for a charging order!!! Have some steps been missed here? We are in neg equity by around 20-30k. We have 5 other creditors. Total debts amount to £27k. Is it worth arguing that in Sept Iam hoping to do more hours at work therefore take home more pay. Hubby is being promoted in June and agian pay should increase, and also our fixed rate mortgage will end in Dec again freeing up more cash as our payments should almost halve saving around £300. Anyone????
  2. Hi, does anyone know what I would be entitled to if anything. I work in an Afterschool club 3pm - 6pm 32 weeks a year (term time) The rest of the time during the holidays my work is unpredictable, One holiday I could work the whole holidays 5 days a week 10hour days. But these hols (easter half term) there is know work for me so therefore no pay either. I have asked my employer on many occasions what my entitlement is but still after almost 2 years I do not have an answer. I was paid for 1 weeks holiday last year, and I was given a £200 xmas bonus (which when i asked about holiday pay was told that was covered in the bonus, so was it a bonus or holiday pay?) I liek my job as it suits my circumstances at the moment but can't help but feel a bit let down. vicky

Ok so I now know that I can reclaim the current account charges. it's the credit cards items I am unsure of i have been looking through the threads all weekend and that is why I have asked today. I think I am going to tackle these one by one starting with abbey as I am sure they have charged me the most and I have been with them the longest (account now closed). I have then got Abbey credit card and co-operative credit card which have both charged me loads giving the reasons i posted about late payment cash withdrawl use of cheque Over limit fee. So if anyone can help me with which ones i can or can't reclaim or point me in the right direction to finding out then i will be very grateful. Thanks in advance. Vicky
  4. Hi, I am hoping to reclaim charges and I am interested in fighting these banks to get my cash back and help prevent it happening to others. But what are the risks in joining your force? And I don't know if you can help me out here but what charges can you reclaim exactly? Current accounts: Over overdraft limit fee? Unpaid items fee? Anything else on current accounts? Credit cards: Over limit fee? Late payment fee? Cash withdrawl fee? Use of credit card cheque fee? Anything else? Also does this rule stand against catalogues and the like? I have been charged Hundreds probably thousands of £s in charges in the last 6 years. I am in the process of sending the DPA letters to get all of my statements for the last 6 years then I will know exactly how much banks have had off me over the years, but I need to know exactly what I can reclaim first.
