Hi all, I'm in the same boat Just rec'd a letter from the courts today saying: ORDER In the High Court of Justice His Honour Judge Grengell sitting at The Court House... considered the papers in the case and ordered that: 1) The claim is transferred to the Mercantile Court, Leeds 2) The claim is reserved for all purposes to his Honour Judge Kaye QC 3) Because this Order has been made by the Court without considering representations from the parties, the parties have the right to apply to have the order set aside, varied or stayed. A party wishing to make an application must send or deliver the application to the (together with any appropriate fee) to arrive within seven days of service of this order. 9. I've not rec'd anything from DG so yesterday i sent my second chaser letter to them. Today i received a letter from my local county court - Harrogate saying... Notice of transfer of proceedings - To all parties As a result of an order made on 23 April 2007, this claim has been transferred to Leeds County Court. Then on the 2nd attached page it says... General Form of Judgement or Order - to the claimant Before District Judge Wood sitting at Harrogat eCounty court.... Upon reading the papers on the court file IT IS ORDERED THAT The file be transferred to Leeds Court Centre, the Courthouse... Dated 23 April 2007 Any clues what i do now apart from wait??? and why was my case transferred to another court?? I have still not received a AQ? but I suppose Leeds court could still send me one???
  10. Claiming my bank charges against HSBC is not easy but this site has helped me understand what on earth i'm supposed to be doing. I haven't won yet. This is my journey so far: 23rd Feb - 14 Day letter to HSBC asking for all my bank charges back or i'll take them to court. This was sent by recorded delivery and they simply ignored my letter and copies of all my statements. 12th Mar - I Filled my online claim against HSBC 15th Mar - HSBC filled a defence.... DG Solicitors 13th Apr - Letter rec'd from County Court 'Notice of Transfer of Proceedings' and the claim has been transferred to the court where the claiment lives (i.e. me). They have no included an Allocation Questionnaire which really made me worry untill i read.... http://www.consumeractiongroup.co.uk/forum/hsbc-bank/78873-new-after-28-days-13.html#post762082Which made everything become a little clearer to what on earth i was suppossed to do as i was starting to feel completely out of my depth. 23rd Apr - I have followed the advice on the above linked and sent a letter to DG Solicitors requesting to settle out of court and enclosing a schedule of my charges... by recorded delivery of course So now i guess i should wait to see if they respond or if the county court sends anything. Is anyone else in the same postition as me? and should i be doing anything else???
  11. V's HSBC! Hi, I received my Notice of Transfer of Proceedings letter yesterday and I completely panicked :o ... feel slightly better now after reading this website but its still quite scary. My letter did not include the allocation questionnaire either so is the best thing for me to do is send a letter to DG to try and settle again and then should i write to the court???.......confused.com:confused:
