  1. Hi there! Can anyone give advice on the whether or not the information I have typed out is what the court is wanting????? thanks xxxxxxxxxxx
  2. Is this correct?? PARTICULARS OF CLAIM 1. The Claimant had an account HSBC account number xxxx sort code xxxx with the Defendant which was opened on or around 24th May 2002 and closed on or around 25 April 2005 2. During the period in which the Account was operating the Defendant debited numerous charges to the Account in respect of purported breaches of contract on the part of the Claimant and also charged interest on the charges once applied. The Claimant understands that the Defendant contends that the charges were debited in accordance with the terms of the contract between itself and the Claimant. 3. A list of the charges applied is attached to these particulars of claim. 4. The Claimant contends that: a) The charges debited to the Account are punitive in nature; are not a genuine pre-estimate of cost incurred by the Defendant; exceed any alleged actual loss to the Defendant in respect of any breaches of contract on the part of the Claimant; and are not intended to represent or related to any alleged actual loss, but instead unduly enrich the Defendant which exercises the contractual term in respect of such charges with a view to profit. b) The contractual provision that permits the Defendant to levy such charges is unenforceable by virtue of the Unfair Terms in Consumer Contracts Regulations (1999) and the common law. 5. I omitted 4 charges from the original letter/claim to HSBC do I need to inform the Court or HSBC of this? Plus shall I use a similar letter to NAWANDA PERMALINK 40??? thanks x

  4. Hello all, We have received a letter from the court which I will type out in a momernt, we are very worried as we have no idea on how to tackle this. Any advice on this would be greatly appreciated and many thanks in advance if anybody has any ideas. IT IS ORDERED THAT : 1. The claim be stayed as it makes no serious attempt to comply with CPR 16.4 ( 1 ) by setting out a concise statement of the facts. ( Stylised particulars do not constitute compliance. ) The Claimant must amend or substitute the particulars of claim by setting out the case and by including details of the charges complained of, how they are calculated and in what circumstances they were incurred. The Claimant should note that sending copy correspondence and/or copies of bank statements will not suffice. The Claimant has until 4pm on 21st June 2007 to comlpy with this order. In default the claim be struck out without further notice. Dated 25th May 2007
  5. We have sent a court order to Natwest, they have acknowledged so have 28 days to submit a defense. In the meantime they have sent us a letter offering us £364.00 , which does not include the 8% interest or our court fees, which come to £443.12 in total. If we accept this they say that is a full settlement, are we right to ignore this letter and wait for 28 days to pass to default to get the full amount, or do we need to tell the court about the letter that we have received and to say that we are declining, your comments would be most welcome as we are a little bit of a loss as to what to do next and whether we have to take any further action at all, whather it be letters or contacting the court.
  6. We are in the procees of claiming back our charges from HSBC, we have received the statements, however there are a load of charges on the statements citing HSBC Acquiring, this is on a business account. Can anybody shed any light on this and what these charges are for ??
  7. I am going through my accounts now ticking off all the charges and keep coming accross HSBC Acquiring - charges....does anyone know what this is??? Its a business account??? Can I claim back for this...One instance I had PLUS £2200 in my account and they took out £400 approx for this?????
  8. I have filled in the relevant forms and sent them off and have now started to receive the statements, can't wait to tot it all up. When I have done this what do I do next send them the sheets back and highlight the amounts, or do I put all the amounts into an excel spreadsheet and send that to them with the amount at the end. I just want to make sure I get this right and get all the illegal they took off us over the last few years, god do I really dislike NatWest and hsbc. If anybody has any ideas they can pass on that would be great.
