I have had 2 credit cards which are closed now but had charges on them, could anyone advise me on: 1- Can I ask for DPA and give my £10 and ask for both accounts at same time? 2 - Do I send my letter for credit cards to: DSAR Team 10 Carlton Street Halifax HX1 2AL or Halifax Card Services Customer Services Pitreavie Business Park Dunfirmline KY99 4BS Thanks Ena

  4. I sent an acceptance letter to SC&M for the full amount of £1828.26 and crossed out the clauses. I didn't hear anything for some time, I contacted SC&M they said they lost the letter so I resent it recorded again and they said Lloyds would credit my account in a couple of days. I just checked my account and they only credited £1500 into the account, I want to claim the full amount, can anyone suggest whom i contact regarding this, is it SC&M or Lloyds themselves, what should I write? Please if anyone could help i'd be ever so grateful! Thanks Ena

Hi Flower, Sorry I clicked new thread by mistake, I have made a thread, I had received a preliminary hearing from the courts on 21st August So i've got quite far, I've got another account i'm going to start reclaiming for once i've received the money in my account from this first claim. Hi I received a letter from SCM offering me the full £1854, but to the clauses I wouldn't go over overdaft again, would meet with branch manager etc. I crossed this off and sent a letter to SCM saying I accept the offer but not to any of your conditions and crossed off the condition they labelled. I have not heard anything back now and that is 9 days after I sent the letter. Can anyone advise me when i'm likely to get the money and if at all now? Thanks for any help, Ena

    I have just received a letter from SC&M saying Lloyds will pay up providing I agree to the following conditions; 1. The above amounts of (£1828.86 in total) will be credited to your account 2. The payment will be in full and final settlement 3. the terms of this agreement are confidential to the parties and their legal representitives 4. you agree to maintain your account with the bank within your agreed limits and in accordance with the erms that govern the account 5. You can avoid these fees in future if you agree an increase in your overdraft etc. 6. You make contact with the local Lloyds TSb branch manager to arrange a review of your account 7. you must notify the court immediately once payment has been made and provide a copy of your letter to the courts for our records. I have another account with Lloyds i will be sending my request for money to shortly, but am going to wait until the cash is in this account before I do so. Can anyone please advise what I need to do next? Do i cross out some of the clauses from this and send on to SC&M? I'd really appreciate the help i'm nearly there and don't want to fall at the last hurdle! Thanks Ena

    Thanks Barty, That makes sense now i did recieve the following... Without hearing it is ordered that :- 1. the filing of an allocation questionnaire be dispensed with in this case unless the district judge at the court of transfer orders otherwise etc. following the link you sent,it suggested filling in an AQ anyhow. However, I know i'd get the money back but I'm very short on cash at the moment, would it be safe not to send an AQ? Can you suggest what's the next stage, do I sit and wait for the court to get back to me or should I be doing anything else now? I hope i'm getting close now Thank you so much for your help, E

    Hello, I've just received notification from the court that Lloyds intend to defend the claim, what is the next step now? do I have to send a AQ off to the courts? where do i get the form? I appreciate any help, and getting a little worried as it's become so public now, i'm worried i'll miss the boat with the claim. Thanks again for the help E

  11. Hello, could you please help me, I sent away asking for a complete list of bank statements 50 days ago. since then I have been sent a copy of my charges up until 9th September 2001. On the letter they sent with the statements it said i would have to send another letter to them asking for statements prior to 9th sept 2001, and that they are entitled to 40 days from the date of the letter to send it. I wrote to them saying how they needed to send statements prior to 2001 and they have a further 8 days to do so before they break the data protection act. Nothing came in the post, so i sent a letter after 8 days saying how they had now broken the data protection act and if i do not receive the complete list of charges including prior to 9th september i will take them to court, they then sent me 2 of the same statements i received two weeks earlier minus the statements prior to 9th September. Are they entitled to an additional 40 days as they've sent part of the information? If not what should i do? Thanks for any help Ena

    Thank you Jessica, I decided not to include the first two months as i don't want to make this any more difficult, or give Lloyds any reason to get back, and besides, Its not too much money to worry about in terms of the amount they owe me!   13. Hello, please help, am i correct in thinking that when i file my MCOL I can only claim for exactly 6 years i.e, i can only claim from 20/04/2001, without it getting messy? When I sent my request for payment letters, i asked for money dating back to 24/01/2001 (6yrs&2 months, £1360). Does this mean i need to re-work my sums and when i fill out MCOL miss out the pre- 6 years claim, and does this matter if i've already sent my LBA & asked the bank to refund me the amount of £1360 and then I file a claim with MCOL for a different amount i.e - £1305 + £284.40 interest? Wow I hope this makes sense and someone can help me out, I've read it back to myself and struggle. Thanks again, Ena

  15. Hello all, I think I have started a new thread in the correct place? I have got two bank accounts with lloyds, I have just received my Data Protection Act statements and have totalled up £1370 in charges. I also have another account which I have looked on the internet and this too has £1600 charges and counting as i can only go to July 2002 on the web and have to contact lloyds again for any previous statements. Should I proceed with the Preliminary approach for repayment letter for the first account and proceed with the second account at a later date or should I wait for the banks to send the Data Protection Act statements and take action against lloyds for the two accounts at the same time?     Hi Rooster, Thanks for the help, I had sent the D.P.A from the templates, together with the £10, should I send the non-complience letter to the same address or maybe to Penny Berryman Senior Manager Data Protection Dept. Lloyds TSB Bank PLC The Pentagon 48, Chiswell Street London EC1Y 4XX Bank Fodder put this as a useful contact - Thanks to him too! Should I use this address instead as I hadn't heard anything, or should I keep some uniformity and send it to the Birmingham recovery address

    Hello, this is my first thread. Firstly can I say what an excellent site this is and on the result of my boyfriends result of reclaiming from Lloyds I have decided to reclaim mine. I have sent a letter to Lloyds reclaim centre in Birmingham asking for them to send my Data Request with a list of all my charges over the last 6 years. After 32 days I sent another letter reminding them I had not received anything from them and reminded them they had a further 8 days before they had broken the Data Protection Act. They are passed 44 days after this letter was sent out i still haven't received anything. Am i sending this to the right address? Customer Service Recovery Centre, Lloyds TSB Bank plc, 125 Colmore Row Birmingham B3 3SF If this is the correct address, I'll send the letter in the templates informing them that they have broken the data protection act and i will have to take them to court if they do not reply within 7 days. Is this the correct procedure, Thankyou for any help, Ena
