  1. Hi guys, At the moment I am at the stage where I have got my statements, sent my prelim, and had an offer. I am claiming £705 and had an offer today of £335. Obiously I have declined it and I sent my LBA today saying £335 would be accepted as a part payment and I will take court action if they don't pay up within 14 days. There is just one thing I need clarification on: "If you are dissatisfied with my proposal for resolving your complaint you may ultimately eligible to refer to the Financial Ombudsman Service." Hellllooooooooo!!!!???? Not quite sure what they mean. Hope some one can give me some advice on this and my next steps. Cheers Stuart

  3. Hey Guy's, The situation is Barclays received my Prelim letter on the 17/01/07. I am still waiting a reply. Since then, I have received a letter today regarding a charge I incurred on the 16/01/07. I thought this might be detrimental to my sums already sent in and a pain in the ass at a later date, so I made the call. On the usual number I got a snotty call centre operator, he said basically it was my fault and there was nothing he could do. I was so cheesed off, but thought I would just add this new charge when I issue the LBA. Today I received a letter explaining this charge, so I decided to call customer relations on 0800 282 390. The gentleman explained that the charge was Barclay's policy. I then explained that how I had gone overdrawn was due to my avaliable balance on a cash machine was incorrect. Basically my avaliable balance was £59 pounds, so I withdrew £50, so my balance was £9. Two days later 2 card transactions appeared, which I had done 4 days before, making me go in the red!!! I explained avaliable balance should be avaliable balance and the last transaction i had done was a cash withdrawal!! I asked him to justify the £30, and he couldn't!! He then told me he could immediatly refund the £30!! A bit different from the indian call centre operator and his supervisor I spoke to. Its a drop in the ocean from the £705 I am claiming but at least this can cover my court application or a few more recorded letters lol!!! I reccomend everyone not to use the 08457555555 number and go for customer relations!!!! Ill keep you all posted in my big claim. Stu

  5. Hi everyone, Read lots of threads, cant really find anyone that is in the same boat as me. I have had a Barclaycard for 4 years, iv been over my credit limit for the past year, making small payments but my minimum payment is high. I want claim the charges back and I estimate these will be in the region of £500. Can I claim even though I am over my limit and still incurring charges every month? Thanks stu
  6. Hi guys, Been looking at this site for a couple of months, have been a lazy really, but finally decided to give things a serious go. Barclays have so far been helpfull in providing statements. I didnt use the DPA request, i used a different approach: Phoned telephone banking, got through to India and Requested statements. Waited seven days, then phoned again. This time I asked to speak to someone in the UK. It turned out that India did not order the statements, so I filed a complaint regarding their incompetance. Within 5 days I recieved the statements and a letter apologising for the problem with the India call centre. So I have posted my prelim letter today, be recorded post - of course! £705! Have already pre prepared LBA and a letter rejecting their offer - I think it pays to be prepared! So now I am waiting - 14 days and counting FAT CATS!! Regarding Capital 1 - This account was closed because it defaulted, I paid the lump sum of the account and they closed the account. I think I will have to go down the DPA request with these guys. Has anyone had any experiences or advice they want to share?? Now Barclaycard - I do need a little bit of advice with this. I still have an account which I havent paid for 10 months. Basically I was a day late with a bill, then refused to pay the charge. This has gone on and on, they were not willing to remove the charge so I have never used the card again or paid another penny. The situation now is the account is £500 over limit. Can I file a claim, even though I havent paid the account for so long. I am guessing the amopunt of charges over the last 3 years is enough to pay the account off anyway - HELP PLEASE!!!! Cheers guys Stu
