  4. Hi, my husband left Barclays seven years ago and we moved house two years ago and cleaned out all of the rubbish - which included everything to do with Barclays. We left Barclays because of the penalties they were taking from us. Husband has now approached them for the last six years statements and they say that our account number has dropped off of their system and they have no way of tracing it. Has anybody else had this reply from the bank - can it be true? Or is there anything else we can do to trace the number?
  5. Hi Lynne Please try to keep it under 5k. If it goes over they are likely to go to court. I believe the small claims court will only take the cases under 5k. I didn't claim the interest because it took me over. My claim is now finished and NatWest have paid up, including the £150 which were court fees. Good luck
  6. Just to let you know that I received a cheque from Cobbetts this morning and they have paid in full. People it DOES work - keep at it - they won't take you to court because its cheaper to pay you out. Thank you to everybody who helped me and I will make a donation today.:grin:

Before I had a chance to post the letter to their solicitors refusing their offer, I have received a letter with a Notice of Transfer of Proceedings and a notice of their Defence in which the first para reads: This Defence is filed and served without prejudice to the Defendant's case that the Particulars of Claim do not disclose reasonable grounds for bringing a claim against the Claimant to recover the bank charges (and interest thereon) referred to in the Particulars of Claim or any other sum(s). In the event that the Claimant does not properlyu particularise his claim then the Defendant will apply to strike out the claim and/or for summary judgment in respect of same. They are also asking for the account number (which I'm sure they have) and each and every charge which has been applied to the accounts giving details etc etc. All facts and matters relied upon by the claimant in contending that the charges identified in response to 2.21 and 2.2.2 above were unenforceable or that the Defendant was not entitled to make such charges. and it goes on and on.... and its been signed by the defendants solicitors (Cobbett). Also I have a Request for further Information and Clarification - NOTE IMPORTANT.... no 1. states "This request is served pursuant to CPR Part 18. I am asked to provide a response to this request in accordance with CPR Part 18 by 9 June 2006. It goes on to state that if I'm not able to provide adequate responses I should contact the solicitors and tell them when I will be able to provide a response. Can anyone help on this please. Can I ignore the solicitors letter and just wait for the questionnaire from the court, then send a copy of the questionnaire to the bank after I have filled it in. Mountain - what happened to you, did you go to court in the end or did you accept the offer? Or shall I send Jpet's letter --------- ooooooh I'm so confused now. I'm off this weekend and would like to settle this today before I go - can someone please advise again. Thank you, thank you, thank you
  10. Thanks Jpet77 - we have no date for the hearing as yet - but the defence is three and a half pages long asking questions etc. Is there anybody who has actually taken NatWest to court and won? Or maybe it doesn't go that far and they settle beforehand? Should i state to their solicitor - without answering the questions in their defence - that I will drop the case for a full refund plus costs and nothing more. After reading their defence (and not understanding a lot of it) i'm feeling quite bamboozled. They are giving me till the 9th June to reply to their questions. Thanks all for help and back-up
  11. Thanks dgf1973 and barracad for your support. Can anyone help with wording a letter to NatWests Solicitors accepting their offer as an interim payment and still saying that I will continue with my case. many thanks to everybody:)
  12. I've started proceedings against NatWest and have now had an offer through their solicitors for £2,200. My original claim was for just under £5,000. Do I now hold out for the full amount because, as I see it, they have now admitted liability by offering money to me. Would it be a risk going in to court now? Could I possibly lose the money offered to me? Deal or No Deal????

  14. Hi, They have taken £3,145 out of our account plus £1,293 interest. Totalling £4,438.

  16. I have received today a Notice that Acknowledgment of Service has been Filed. Also a copy of the 'Response Pack' . They say they intend to defend all of this claim. The defendant's solicitor is Lynsey Burgoyne - I wonder if she is dealing with anybody else' claim. We are both very new to court proceedings and have now started our case against the NatWest. Apparently they have 28 days to file an acknowledgement. I suppose I just sit and wait for the next letter. We are both pensioners and are at a loss as to know what to do if and when we have to appear at Court. Can anybody help please. Have you 'been there and done it' - what happens and what are we supposed to say.
  17. Have started court proceedings on line - i am now waiting to see what happens - do I do anything or just wait until they contact me to let me know when the hearing will be.

We consider that the cmounts debited to your account have been applied strictly in accordance with all applicable laws and regulations. We are also committed to ensuring the transparency of the information that we give to our customers about the operation of our products. Against that background, we must differ to the views expressed in your letter. Accordingly, the charges that have been applied to your account must stand. I trust I have now resolved your concern. However,if you wish to discuss this further please contact me, or a member of my team, at the Customer Lending Centre, Wimbledon on 0845 300 9639 Monday - Friday 9 am to 5 pm. I enclose a leaflet, which explains more about our complaint procedures and includes details of what to do if you are not happy with the outcome. Yours sincerely, Jay Petersen Customer Care Team."   20. Haven't heard anything after sending my first letter (recorded post) to my bank. I will be sending the second letter to them on Wednesday - after giving them two weeks to reply. Let you know any outcome.

My husband is a taxi driver and his money is paid into the bank regularly - unfortunately usually a day after the direct debits - you can imagine the number of times we have incurred charges - even if there was sufficient money to pay a couple of the dd's they did not pay them and have charged us sometime two or three times because they wouldn't cover the dd's that actually could be paid, they lumped the lot together!! sorry about that, i'm steaming. lol
  22. My bank asked for £5 for my 6 years worth of statements and I told them that under the Data Protection Act these were my property and they had no right charging me - they backed down. I am now collating all the charges and will be writing, using the standard letter kindly provided, to my bank. I will let you know the outcome. Forward into the battle....etc etc etc
