  1. Hi Scooby, Any pointers you can give would be much appreciated. I want to make sure that I'm clear on where I'm going as I don't want to mess this up. What should I do first? i.e should I now write back to HFC with my intentions on the PPI? Cheers, DJ
  2. Right Guys, need some more help. I'm struggling with the in-putting on the spreadsheet! where it says interest charged do I put it in as it says on my statement for the monthly cash withdrawel amount i.e 0.087%.:idea: Also it says Account Balance at Interest Date. Do I put in the balance before the interest was added or after? Cheers, DJ
  3. Hi AL, Yes i've spent hours reading through various posts etc. It truly is mind boggling:o I'm trying to piece together everything to make sure I get it right. Basically I feel I now have two bullets to fire. 1. Mis-sold PPI 2. Default Notices for different amounts.   4. Good Afternoon All, Today in the post I received a response from HFC from the second letter (see above) I sent dated 23/01/07. I am suprised at this as BigAl had already informed me its unlikely I will get a response due to HFC already satisfying the original request. Here is a copy of what HFC have sent: Dear Mr xxxxxx Re: Account xxxxxxxxxxx Further to your lettter dated 23 January 2007, regarding your request for a true copy of the original default notice. As a member of the Executive Complaints Department, your letter has been forwarded to me to investigate and duly respond. Please accept my sincere apologies for the delay in responding to you. My I take this time to advise that as the Notice to Default letter is an automated process, I am unable to provide a certified copy, as you have requested. However, please find a copy of an 'example' copy of the Notice to Default letter and our example contains a true copy of the original wording. It is important that your issues are fully addressed. Therefore, if you have any further queries relating to this matter, or remain dissatisfied, please do not hesitate to contact me and I will arrange for your complaint to be escalated. Alternatively, you may follow the steps detailed on our internal complaint procedure. As you are aware, HFC Bank is a member of the Financial Ombudsman Service and ultimately, you have the right to refer your complaint to them as an independent adjudicator in disputes between Banks and their customers. I would also like to advise you that unless I hear from you within the next 8 weeks, I will assume the matter is resolved to your satisfaction and my files will be closed. Yours Sincerely xxxxxxxxx What I find very unusual here is that they have now provided me with two copies of the alleged Default Notice:confused: , both these copies have different payment amounts and different payment dates.   5. Thanks guys, So just to confirm - I claim the charge and the MONTHLY rate of interest they charge on cash withdrawels, add it all up and send of the first letter? I'm gonna have a crack at the spreadsheet on the weekend so will keep you updated on my progress! Phew, my six year old could have work this out before I did!   7. Hi Ian, Thanks for the reply. Claiming on PPI is a new door for me, I guess what I'm really after is some sort of guidance on what to put in my letter i.e some help to draft one up. My main aim here is not claiming back the PPI (although that would be nice;) ) but to get the default removed. I need to get that point built into the draft letter and use being mis-sold the PPI as my bullets! Speak soon, DJ

  11. Hi, I am about to try and reclaim PPI and a default removal from HFC. Has anyone on here had any success with regards to claiming back a PPI from this excuse of a bank? Always keep smiling! DJ

  15. Evening All, I received my statements from my RBS credit card on Saturday and have found there to be £194 worth of charges. I am about to send off the template letter for reclaiming the charges, however I am getting confused. Do I add the intrest now or only if I need to send the LBA? Cheers, DJ

  17. The original loan was for £5,996.00 with an APR 25.6% which added another £6,119.32. Total amount payable £12,115.32 They also sold me PPI which cost £2,004.58 with an APR of 25.6% which added £2,045.90. Total for PPI £4,050.48 Total amount of loan £17,524.92 My payments were £208 per month, which after 4 months I was struggling to pay back, there are a number of penalty fees on my account due to missed payments however these were waivered but that was done after the default was served. I took this loan out in 2003, at the time I was only contracted to work Part Time (20hr contract) but was on a temp f/t contract. I did explain this to them when I produced my payslips. I only took out the loan due to the fact they phoned me and said that they could make my payments cheaper if I amalgamated my HP agreement with PC world and my current loan with them, they never explained to me that £10,000.00 of the loan would be made up of PPI and interest! I am so annoyed that I let this happen and I really should have taken more care and attention as to what I was signing up for. I was 22 at the time and inexperienced but would really like to do something about it if I can. I've grown up a lot since then and now have my own family but this default is causing me hell.   19. Already looked at the link but dont really understsand what I'm looking for. I sent the CCA request and they sent me a re-constructed version of the default notice? Again, anyone could do this?. What will I gain by doing s SAR? i.e will i gain anymore info than i already have? Cheers, Steve

  21. Hi, Thanks for the response, I understand what you are saying but my argument is that HFC never informed me that they were issuing a default. At the time (2005) I was struggling to keep up payments and informed them of this. HFC said they would re-write the loan with 0% APR which would reduce my monthly payment, naturally I accepted and was pleased with what they had done to help. Shortly before xmas I obtained a copy of my credit report and found that they had placed a default on there. Although I was in financial difficulty before, things are now a lot better. However, going back to my original point they never informed me of such action. Surely I must be able to do something? I was under the impression that they had to provide a true copy of the default notice otherwise surely anyone could type one up at will? Thoughts please? Cheers, DJ
  22. Afternoon All, Okay, I need some help on the following: I have a default from HFC on my credit file showing as satisfied. I sent off a CCA to HFC as follows: HFC Bank PO Box 2445 Birmingham B1 3PJ Date: 11/01/07 Dear Sir or Madam Account Number: xxxxx After recently obtaining a copy of my credit file from Experian I was concerned to note that your company has placed a "Default" notice against an account in my name. Further to this I have no recollection of ever receiving such a notice, and I therefore require you to substantiate this data at your earliest convenience. 1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of account. I enclose a £1 cheque in payment of the statutory fee. 2. You must supply me with a signed true and certified copy of the original default notice 3. Any deed of assignment if the debt was sold on I would request that this data is provided to myself within the next 28 days, if you are unable to provide this data then I must insist that it is removed from my files as unsubstantiated. Yours Faithfully HFC replied with the following on the 18/01/07: Dear Mr xxxx Account Number: xxxxxxx Thank you for your recent letter, the contents of which have been noted. Please find enclosed the information requested:- * Copy of your Legal Agreement * Re-Constructed copy of a Default Notice * A statement of your account Should you have any further queries, please contact this office on xxxxxxxxx Yours Sincerely xxxxxxx HFC Bank Limited So my response to the above was as follows: HFC Bank PO Box 2445 Birmingham B1 3PJ Date: 23/01/07 Dear Sir or Madam Your Ref: XXXXXX Account Number: XXXXX Thank you for your letter dated 18/01/07 I must inform you that you have failed to provide me with point 2 of my original letter dated 11/01/07 in which it states ‘You must supply me with a true and certified copy of the original default notice’. I have written to you explaining that I never received a Default Notice as per the requirements of Section 87 of the Consumer Credit Act 1974 (CCA). Please be aware that providing a re-constructed copy of a default notice does not satisfy the requirements of Sections 87 or 88 of the Consumer Credit Act 1974 (CCA). Therefore it is my contention that the entries you have placed on my credit files are unsubstantiated. As you are aware processing and storing defamatory data about a Data Subject is a breach of the Data Protection Act 1998 (Data Protection Act). As I am sure you are aware, breaching the Acts mentioned is a criminal offence and if I have not received confirmation from you that the data on my credit files has been removed within 14 days, I will have no choice but to escalate the matter to the relevant authorities including the Banking Ombudsman, Office of Fair Trading and the Information Commissioners Office Yours Faithfully, The problem I now have is that HFC have failed to respond to my above request, i sent the above letter via Recorded Delivery and it is showing as being delivered on the 24/01/07.
