  1. Received this morning - "the application to set the judgement aside is granted" Now I just have to move the case to a court near me. How does one do that?
  2. I've received a letter today from Northampton court "the above case has been referred to the District Judge for directions on how to proceed". Not sure if this is a good or bad thing! Will send off first re-payment regardless...
  3. Thanks for everything so far. I am sure I can find the details of payments to the debt people - I actually sent them a list; which they acknowledged. I was actually away in Europe for most of the time in the run up to the court case... I'm assumiing I should send payment in accordance with the court decision...
  4. Letter to court was sent before judgement. But still the judgement was by default. No letters were sent recorded/registered. I have a letter dated 17th October 2009 from Bryan Carter 'acknowleding communication' - which was another 'send me the bank details' letter; this I replied to with the details of repayment. I do still have the original bank payment details and can recommence payment into that account.

  10. The point is that I keep offering to recommence paying (and have doen for about a year) but they just wont send me the account details for me to do so. And why should I have another £300 load of charges added to the outstanding?
  11. The debt was a personal unsecured loan. I didnt think I had messed up at all - I have asked constantly for the bank details to begin repayments.
  12. After loosing my job I defaulted on a loan.. I began repayments as soon as I was able but after a few weeks a debt collection agency sent me letters sayiing they were not receiving the money (I was paying it into the original lenders account so assume there was a delay in themoney being forwarded). I asked the agency for bank details so I could pay a regular weekly ammount and extra payments when I could afford it. The letters, there were several, over the course of the year were ignored or never replied to yet the standard demand letters continued. It got to a stage where I wondered if this was real and therefore asked for a copy of the original agreement. This took 4/5 months to come through. This is all fine - I accept I have to pay back the seven grand - but the debt company and now their solicitors have never supplied the bank details to which I can pay the money. The solicitors went to the bulk claim court in Northampton and issued a notice to me. I wrote to both court with copies of some of the letters I have sent in the past but this letter has been ignored and I received yesterday a judgement for the full ammount. What can I do? Can I issue my own claim against the solictors for the charges of £320? The amount they are asking for, £50 a month, is far less than I originally offered to pay and am willing to pay now. I really dont understand why they dont send me the account details to pay the money into. I dont want to pay by direct debit as this is not flexible enough; a weekly standing order and extra payments as and when I have the cash is far more than they are now asking for. A letter dated the 12th may says I have failed to respond with reasons for the dispute or proposals for payment, which is wrong because I have. Yet a letter dated the 14th says they need a form of admission completed. A court letter dated 21st May demands the £50 a month. Yet I wrote both to the court and the solicitors. I am confused and frankly astounded that they just keep ignoring my letters over the course of a year.
  13. How does the charges issue relate to general consumer credit? I am in the process of buying a product through Clydesdale Financial Services. Due to a closure of a bank account I was unable to begin payments when required - letters to them requesting a new direct debit form went unanswered. Initial payments were delayed while I tried to find out how to pay; which I did eventually. But not one letter was answered from the company - only letters charging me £25 a month for late payment. They have also charged me £25 for not telling them I moved; which is incorrect and just the other day another £25 for being in arreas of £84 - which can only be because of their charges (the 'normal' story). They still fail to reply to any letters. Are these charges legal or excessive and worth a claim?
  14. Following the instructions found on this forum I have just received a full payment of £813.59 from Intelligent Finance. They failed to respond/defend the court and transferred the money a few days later. (Unlike Barclays...)
