Hi fendy yeah i dont intend to stop the court untill they have cleared the cheque! i asked about the £500 and they want another scedual of charges and a letter which is not a problem. i wouldnt recomend emailing cobbets straight off i would call them so you have a name they all seem to have direct lines and email addresses nothing to hide u know! if u reaaly want it pm me emme x
  3. ok today i was offered everything back £1198.50!! the best way to do this is if you dont recive a defence is to speak to the cobbets directly. People at NatWest are only going on what the cobbets have said and i wasted alot of money and time speaking to NatWest. I spoke to a rep from the cobbets and gave her till 4 pm today to get a figure i was happy with, i was prepared to negotiate with the intrest. I was asked to send another scedual of charges and my particulars of claim, i said they were stalling me but she said an email with these was ok, she called me this morning to say i should be expecting a cheque for the full amount so now im waiting for my cheque and i start this all over again with NatWest, because from january they have charged me another £500.00 worth i can claim back, thanks everyone for all your help!! emme
  4. today has been a joke, ive spoken to 3 different natwest people on different numbers, one who swore blind a defence was entered, all lies! confirmed with the court again no defence was entered, i could ask for automatic judgment, called the cobbetts seeing if they wanted to come to an arrangment now awaiting their call back, will keep everyone posted !!!
  5. yeah its strange though they sent the defence paperwork to me, but not to the court. Ive been though small claims before and you get a form back with a copy of the defence from the court with the allocation questionaire. the status of my claim has not been defended or transfered to my local court and the time for them to get the defence in was up last week. and i never got an alloctaion questionaire! its all very confusing i am still yet to ring them, its something i will do today. they have had another week to sort this out so may ask for automatic judgment. ill keep u updated! lets hope they dont take it as far as a warrent of execution!

  7. hi again still have not recived AQ from court, checked with them and MCOL, Natwest has not sent the defence to the court only to me. so i could ask for an automatic judgment, though im going to give them a ring in a minute to try and sort this out now. if not sent them a letter. the 28 days was up last week thursday. ( including bank holidays!) i also got a letter saying that they are closing my current account and demanding i pay back all my overdraft in one go or they will take me to court. in one of my letters i asked them to freese assets on my account because every month i was getting about £100 worth of charges on my account which they havent done, and they are still charging me! are natwest allowed to threaten me with this kind of legal action when they are aware of the activity on the account at the moment? are they even allowed to close my account? also with the letters i recived from the cobbetts with all the deadlines on it from them i only have to respond from letters from the court right? thanks guys emme:D

Hi fendy, the claim is for £1198.00 in total with 8% and £120 court fees, the charges alone are £980 I have not recived anything from the court just the cobbetts this morning, Ive been following your case ( huge thread!) i love your enthusiasum for this its a real help and your a star! you should be a solicitor!!! so i only need reply to anything from the court, is it worth contacting natwest again? i called them the other day and no one would talk with me about it, emme

I actually got the defence this morning from the Cobbets, seems to be alone the same lines as what everyone else gets , I got a CPR part 18 request, i see that this letter as a responce to it http://www.consumeractiongroup.co.uk/forum/natwest-bank/55874-letter-court-re-cpr18.html do i send this to the court and the cobbets then? i know i have to respond before a certin date, does this letter count as the responce? i have not had an allocation Questionair so it goes back to northampton right? I just want to make sure ive got the right details and things thanks again for your help! emme

Hi guys, the actual 28 days are up on monday so if its plus one then its tuesday, but on the paper work it does not say 28 days except bank holidays or anything so i have included them. do i have to include the bank holidays then? ill have to call the court to check, so in that case it would be thursday ! either way i have no defence from natwest, should i just call the court on that day then? because MCOL does not have an option for no defence under aknowlogment! i know i could get a defence in the mean time, but i want to be quick with it if they dont submit one. thanks guys!

Hi everyone, I got an acknowledgment of service signed by the cobbets today, the court said i have 28 days to hear of a defence from them, what exactly can NATWEST defend against? the court have recived my statment of charges and all the relevent paperwork from me, all set within the time scales by the book. Is there anything i should be doing or just waiting?! this was all done via MCOL, total amounting £1198.00 any help would be appreciated!! emme
  16. thank you! I think i am going to decline the letter, I want them to stop charging me , the charges are now have taken me over my over draft and every day no it goes up and up! can i get them to freeze me account? regards
  17. im really not switched on i just opened my mail and i had a letter from natwest today offering me £854.85 my claim is for £1078 plus £120 court fees which was submitted yesterday. How i see it is i am £120 out of pocket from having to submit this claim in the first place after being told to bring it on when i called to negotiate before i submitted the claim. also they want to pay it into my account, in affect i have frozen , i have stoped all money going in and out of my accout as i live in my overdraft because so much was coming out in charges i could not pay my rent.. anyway, What is the likelyness of negotiation at this point? its all very backwards and confusing, and i also want a cheque , theres nothing wrong with that is it? any information would be great with regards to letters i should be writing, or is it more straight to the point if i call this guy stuart higley??!!!! PLEASE HELP!!!!
  18. to be honest im not sure of time scales for the judgment i think it is 14 days but im sure the bank will draw this out as long as possible. seems to be they case with me ive been given the brush off with this hole ordeal , its only since i found this forum i had an confidence in going ahead with this! good luck and let me know how you get on em

  20. hi, the letters were sent to my branch and i did recive a letter saying to be patient and i submitted a claim on money claim, with all the particulars and also posted a copy of the scedule of charges to the court on the same day. if natwest submit a defence do i get a written comformation from court to say so, because im not sure if i get this whole automatic judgment for non responce. so if im understanding this, they get 14 days to respond, claim was ok'ed yesterday , if they defend it then they have 28 days to come up with a responce then and from what i gather from other posts they seem to be paying up here? im not seeing much evidence of these cases actually reaching court is this the case? thank you!!!

I just submitted my claim for natwest after being ignored and pretty much told to get lost when i attempted to negotiate before i submitted my claim! is it 14 days from the date of issue i have to wait before requesting an automatic judgment? also is it common for the bank to actuall sumbit a defence? I know people have been getting settlement with out much argument. thanks guys!

Hi everyone I have already begun preliminary proceedings against Natwest bank,I have sent the letter before action, and tomorrow was the last day they have before I submit my claim to the small claims court. I have only had a standard letter in response to my first letter saying to be patient whilst they investigate. My question is about the claim submission, i intent to apply through the money claim website, is there any format or template i should keep to when i actually explain the nature of the claim? Is there any particular words i should be using as i have no idea how to word it! any help would be much appreciated! emme
