  1. Hi slick132, Apologies for hijacking the thread, but I've had the exact same problem and I wrote this same letter to CRS. I had a reply today and they say " A legal precedent can only be drawn from a ruling but the statement you rely upon appears in the Penal notice issued to Ashbourne management services limited, advising them what they must and must not do. This only applies to Ashbourne management services limited because contracts 1-13 examined in this case we're found to be unfair and thus unenforceable. As such the Penal notice issued to them stated any course of action indicating a desire to end the membership ( including canceling direct debits) was sufficient to cancel because those contracts could not be enforced anyway. Exercise 4 Less contracts have not been supplied by Ashbourne management services limited and have never been deemed unfair by a judge. There is, therefore no reason to believe that the terms regarding how a member may terminate their agreement will not be enforceable in other instances." Any advise would be appreciated.   2. PDLVictim, how long did it take for you to sort a payment plan online? And did they keep ringing you with automated messages?
  3. Thanks PDLVictim, there is hope of me getting it sorted then. Ive got their bank details so i sent them a token payment of a £1 for each of my two loans. Ive informed them of this and asked them to confirm the bank details are correct. Ive told them once they do this we can set up a payment plan and i will start paying more. I keep telling them i am very keen to resolve this.
  4. Thanks for that renegadeimp, just as i thought really. How long will they leave it untill they sell it on to a DCA? Thats the only thing im worried about really. id rather set something up with them but they dont reply to emails.
  5. Hi, So im trying to set up a payment plan with lending stream. Ive sent them all the relevent information they asked for via email. They are now saying that i must ring them up to set up a payment plan as they carnt do it online. I assume they are doing this to try and pressure me into ageeing to their terms for the payment plan? I have set up payments plans with ease with other companies online. Im sending them emails everyday stating i am eager to set this up and start paying, but as of yet no replys. Anyone have any experience with this company when it comes to payment plans?
  6. Hi andy I think im right in saying the freeholder has changed. Last year i was paying ground rent to the building company that built the flats. I pay £250 a year for ground rent. I pay both ground rent and service charges to two seperate companys. It sounds like the original company were doing me a favour in letting me pay monthly then. Lets hope the new company can do the same else im stuffed!
  7. In July last year the company we pay our ground rent to changed. I had happily been paying it monthly to the original company with no problems. So as soon as i learnt a new company would be taking it on i emailed them straight away to explain that i can only afford to pay it via monthly payments. I emailed them a few times with no response, and then at the beginning of Dec i received a pack detailing what i owed them for the remainder of last year and for this year. They said that i must pay them what i owe for 2012 by the 1st Jan 2013. Not having the money to pay what i owed in one go i again emailed them and said i would pay what i owed them plus 2013 payment via 12 monthly payments. I received a letter this week stating that i must pay everything that i owe them within 7 working days or face late payment fees of £45. So again i emailed them stressing i can only afford to pay via 12 monthly payments. I also payed this months payment as they had provided their bank details. So the next day i finally get the first email from them saying that this ground rent can only be payed off with one payment. So i wondering where i stand with this now? The previous company had no problems taking monthly payments, and i carnt afford to pay in one go so this is the only way i can do it All advice welcome???
  8. Well just a quick update..... Received a letter from Barclays today. In a nutshell it basically said they were'nt responsible for the problems i am having with my account, but they sympathise with my financial situation etc etc.......... BUT........ as a gesture of good will and because of the way my account was run prior to my problems they will refund me the charges i claimed for and then take away my reserve account. So a good result id say. Ive also got the form for my parachute a/c which i will send off. The co-op have told me i wont have any problems opening a basic account.

Hi Slick Ok ive sent my letter of hardship off today, not holding out much hope with it being barclays, but we'll see.Also made an appointment next week with the co-op to open up a basic bank account. Will i be ok opening up a basic account with a poor credit rating? If all attempts failed and it went to a DCA, where would i stand with them? would they let me set up a payment plan? Ive never had experience with a DCA before.

Many thanks slick I think thats my first course of action then, to open up a parachute account.I was thinking of going with the co-op,does anybody know if they have any connections with barclays in anyway? If they did refuse to help and i could'nt pay anymore would they maybe set up a payment plan? Where would i stand if i told them where to stick their charges, would they set debt collectors onto me?   11. Thanks for that slick If i tried to get my charges refunded who would i send my letter to, my local branch or head office? Would it be an idea to set up a parachute bank account and transfer everything over to that while i tried to sort this out with barclays? That way they would'nt be able to take any more fees with there being no money going into the account. Or would this work out worse with them charging even more fees..... especially if they werent to accept my hardship claim? Many thanks.
  12. Hi im new to this forum so any help will be much appreciated. I am currently stuck in my £500 reserve with Barclays due to other financial difficulties. As you probably know they charge £22 a week for the priviledge! With me being stuck in my reserve i am currently being charged £88 a month in fees, which along with everything else im struggling to pay. I have tried to phone Barclays but i think they have call centres in India or somewhere, and they tend to stick to a pretty rigid script so they have been no use to me. I also went into my local branch to discuss my situation. All they could do was try and set me up with a loan to pay off my reserve and overdraft! Not ideal really as thats just more debt. Is there anyway that they may freeze the charges for maybe 6 months or so to give me a chance of paying this reserve off? Has anyone had any experience with Barclays regarding reserve charges? Any advice welcome.
