  1. I got my last six years bank statements through the post yesterday. Been through with the highlighter and picked out all the charges. A little dissappointed actually I was hoping for some more  !!

However, from around 2000 - 2003 my paid referal fees were charged at £25. The problem is that since then they have only been charged at £10.

Has anybody claimed back charges at this level on here or do you think that the OFT's decision regarding credit card fees might give the bank a good chance of fighting back on this one?

  2. Hi Guapa

Nice to here that you're sticking it to Barclays too..

Barclaycard are a trading name of a department of Barclays Bank plc. As such you should have confidence that the Information Comissioner's (Information Commissioner)decision in relation to the Microfiche storage system used by Barclaycard bears direct relevence to that used by Barclays the Bank.

I have recieved a similar reply from Pete Townsend myself and am intending to reply to the effect that I am aware of the Information Commissioner decision and would be prepared to take the matter before a magistrate to obtain resolution.

I am pretty certain that Barclays would rather send out the documents than go through the hassle of a court case. Although if they did, a judge would almost certainly rule in favour of the Information Commissioner decision and against the Bank which would set a precedent that Barclays would not welcome.

Good luck with you claim - don't let the swines grind you down.

  3. Barclays will never learn..

Recieved a reply on the 2nd to an S.A.R. sent to Barclays about a week ago. Now although Barclays have kindly agreed to send me copy of statements relating to my current account with them, they have declined to send me any information relating to the period 1998 to 2000 due to this being stored on microfiche.

Now I am sure this is subsequent to the Information Commissioners findings in relation to this matter as reported on the above sticky. Is this therefore a flagrant disregard by Barclays for the findings of the Commission or perhaps simply a sign of ineptitude in the internal communications of their organisation.

I realise that this period is further back than the 6 year period many people are claiming for but I understand that there are some claiming further.

Should I get back on at Barclays and try to claim for the entire life of the account?

  4. I've had a direct debit returned unpaid this morning for which I have recieved a charge from Barclays, which they are calling "commission".

Thing is the charge is a relatively small £10 when compared with some of the other charges people are recieving. Not sure if it is a feature of my graduate account or what really.

Thing is, does this prevent me form trying to claim back my charges or will it make it any more likely that Barclays might try to defend the claim and perhaps give them a chance of winning.

    Your thoughts are greatly appreciated...

  6. Anybody out there who's had a successful claim against Natwest?

Was just wondering because I was hoping to find out whether or not Natwest were closing peoples accounts aftering offering them a settlement. I'm rather hoping not because I think I might struggle to open another account if that does happen.

  7. Hi all

I'm thinking about putting through a claim on behalf of a relative. I've been looking through his online banking today and this guy is clueless when it comes to manageing his account.

In this respect he has paid over £400 in the past 5 months alone in bank charges. However, several times over the period he has been over his agreed overdraft limit by over £500. Would this bear any relevance if it came to disputing the 'reasonableness' of the charges?

Has anybody put in a claim in similar circumstances and come through with a win?

Many thanks in advance for any light you may shed on the matter

  8. Do you think the time will come when everbody catches on to the fact that there are people out there getting thousands of pounds back from the banks..

The banks are deluged by amazing consumer pressure and eventually cave in to the demands of campaigners such as the B.A.G. and are forced to give back millions of pounds to everybody who has held a bank account in the past six years..

Entire banking organisations collapse under the weight of their very own largesse and past greed giving way to a new world order based on fairness and justice..

    Will this day come?

  9. Good luck Thomper you wanna get some of that 10k cleared!

You know I really hate MBNA, I took up a 0% balance transfer with them a few years back which of course ended up spiralling up to credit limit - which they conveniently increased without my asking. And now I'm riddled with a debt that charges a ridiculous amount of monthly interest that is going to take me forever to pay off.

That is unless I can get them to pay some of it back for me.

My only worry is that when I get back my statements I won't really find enough charges to make it worth my while.. we'll see.

S.A.R letter printed off today, will be going in the post when I get home from work. I've used the template available in the library but added a final paragraph along the lines of:

'Please accept this letter as full Subject Access Request and as such I require the information mentioned in the first paragraph of this letter in full and within the timescale specified.'

As it appears that MBNA a waisting some time by fobbing people off with inadequate responses first time around.

We shall see if this makes any difference. Anyway, here we go, lets get the buggers!

  10. Rinch

Why wait go back to the prelim stage. Your deadline has past and so you can now progress to the next stage. If anything you have been extra generous by giving them further time to comply.

    That's my opinion anyway?!?

  11. I can't believe how easy this has been for everyone with MBNA. Really can't wait to send my stuff off this weekend.

Makes you wonder if this Miney guy just spends all his time answering the phone to people wanting charges back. What a job!

  12. Yes Thomper this is a credit card.

I am only asking because I would be pretty certain that the total recoverable charges would be less than the outstanding account balance and I would rather not be left having to fork out to pay it all off right now!

Also, as I am being charged an extortionate rate of interest on my balance, am I therefore able to claim this higher rate of interest as part of my charges claim?

    Many thanks

  13. Hi all

Intending to set the ball rolling as of this weekend.

As a matter of importance before I set about attacking MBNA, if I am successful with my claim, be it through the courts or otherwise, is MBNA insisting on the repayment of outstanding balances and closing accounts. If so this would leave me in a rather tricky situation as my balance is a little too large for me to be able to repay outright.

    Any advice greatly appreciated.

  14. Hi all, its nice to meet everybody. Its honestly a truly liberating feeling to be reading about all these individuals who have taken these multinational corporate regimes to court and won. Well done you all!

I have been feeling very inclined to try to win back some of my own bank charges. However I can't help wondering whether as you guys have been doing it for some time now, maybe the banks have got their act together and are contesting more of the cases now?

If not and it is still worthwhile fighting fot the charges, does it do any damage to a persons credibility amongst the banks/ credit agencies?

Thanks in advance for your advice and once again well done you all!
