  3. Now reparing to send the LBA which i will do before close of play today...

you have a long road ahead but keep replying to the letters as they come one by one and eventually you will get there. I sued LLoyds TSB on behalf of my son and although they huffed and puffed they paid up in the end. Took us about two and half months all in all but got there eventually 3 days before the court case was scheduled.

  4. A few of us are near going to Court against LLoyds but can someone encourage us by saying they have acyually received a cheque or money refunded into their account. Loyds seem to be on the ball as banks go and seem a harder nut to crack than others.

Sorry if I'm being negative but I need to know before I return my questionnaire and incur extra charges.

In answer to my question- yes We have case settled on 28th June and payment into my son's account on that day. A bit of a saga but worth it especially to those of you that have a lot of money at stake. Just keep answering all the letters on time and you will get there in the end.

  5. the sum of £325 was paid into my son's account on Wednesday 28th June. I only remembered on Friday morning (30th June)that the court case is on Monday 3rd July. Phoned the Court in Milton Keynes and told them we didn't want to proceed because LLoyds had settled. The lady said that they would have to have it in writing and din't think the case could be stopped for Monday. Got my son to fax a letter through to the court with a statement showing the money paid in. I will have to ring them tomorrow and hope that they can pulll the case before the judge sees it.

How do I make a domnation to the site?

  6. My son went into Lloyds at Oxford for his review. I suggested that he tells them he is a poor student and that he is trying to keep his head above water but things are difficult on a student loan. Also suggested he say something on the lines of he is at a good university (Oxford) and that one day when he is making a lot of money he could very well invest with Lloyds TSB. The person conducting the review was very sympathetic and offered to increase his overdraft. She also commended him for trying to reduce his overdraft by transferring it to a LLoyds TSB credit card with 0% interest for 9 months. They parted on the best of terms and she said she would let Martinuae Johnson know that he had attended the review so that they could pay the money in ASAP. Is this the end of the story we wonder?

  8. Posted a Letter today to solicitors asking for the interest and also informing them that I would charge the 8% each day untill the money went into the account.

I have made an appointment for an account review but have told which is in two weeks time.I have also informed them that I will cancel this if I do not receive the funds before this date. But have also informed them that I do not agree to the other conditions.

    We wait and see!

I think they want you to have the account review before they put the money into your account. My son rang his branch yesterday to say that he is away at uni so can't come in to the branch till 10th July which is 1 week after the court hearing and they said just pop into your local branch where you are at uni. He's going to do that tomorrow. I bet they won't know what to do with him when he turns up though. The local banks don't seem to know what is going on. Has anybody else found that to be the case?

  9. have a look at Hill V Lloyds TSB. I have been going through the process on behalf of my son Matt. I was encouraged to cross out the confidentiality clause by members of this site and ask for another £30 because they had charged him again since we started the claim

They wrote back straight away and said yes alright. We haven't got the money yet though- they hang it out for as long as they can hoping you will miss a deadline or just give up. I'd be interested to know what happens with you.

  10. The saga continues

Had a letter from LLoyds saying

Thank you for signing and returning your letter on 7th June 2006. We are pleased that you are willing to settle your claim in the terms set out in that letter. Please note that ther refund of the amount of your claim can not be paid until the .....branch confirm that you have attended an account interview. Please contact ........... on 01525 853234 to arrange the necessary review.

In the meantime please can you write to the Court, as the claimant in this matter, to confirm that the case has been settled. The Court needs to be made awae that there is no longer any need for the proceeding to continue so that the hearing date can be vacated. Please can you also send us a copy of the letter to the Court for our file.

Thank you for your assistance in this matter

    Yours Faithfully

    I wrote back

    Dear Sir

Thank you for your letter which I received today about my claim against Lloyds TSB bank

I have telephoned Lloyds TSB in ...... and requested to speak to ................. on two occasions. The first time I was informed that she had left the branch and I explained to the person answering the phone why I had phoned. They informed me that they knew nothing about the issue.

Today I phoned again at your request and asked to speak to ........... and was again told that she had left the branch. I have been asked to phone back again on Monday to speak to another person.

As you will appreciate I am a student and find it costly to make phone calls from a payphone or from my mobile especially when no one at Lloyds seems to know why I am phoning. Can I suggest that you ask them to phone me - they have my mobile phone number.

Meanwhile I would remind you that the Court hearing is on 3rd July and I have no intention of writing to the court to confirm that the case has been settled until the payment of £325 is in my account.

I look forward to hearing from Lloyds at their convenience.

    Yours Sincerely

What a cheek. They are actually expecting me to let the Court know that everything is fine and my son hasn't even had a penny yet.

  11. After reading your last post I became very brave and crossed out the confidentiality clause and asked for another £30 from them for another bank charge that they added after we claimed. Had a letter back from solicitors Martinasu and Johnson saying OK we'll give you the extra £30 and another agreement with no confidentiality clause to sign- so here goes we are signing this time and hope to get the money soon and then it's definately 5% in it for this site. Sorry it's not a bigger claim for my son and the site's sake.

  12. Other people in similar situations have crossed out the bits they don't agree with, initialled the changes and then signed and sent back, and still ended up with their money.

My son has received the exact same letter with the 5 conditions. It is so tempting to just sign them. We are in a real quandry. Are you sure people have had their money even if they didn't sign them

He rang the bank on Friday to have a review of his case but the perosn they said he had to ask for had left and noone knew anything about it. So at least he's rung for his review.

  13. well done yes i had the same letter but as stated elsewhere on this site, terms you agree to are the same as that which you agreed to when you opened the account. so in the future if you inccur more charges your in the same situation but i dont think anyone has tried to get them back again?

    Ross

I have been advised by the moderator of this site not to sign the confidentiality clause but to cross it out. Did you sign it and have you actually got the money into your account yet.

My son rang up to discuss his account yesterday and LLoyds didn't know anything about it. They asked him to fax a copy of the letter that he had received from the solicitor to them. Did you have the same experience?

  14. Firstly, congratulations :D

You should not sign the confidentiality part of this, just cross it out and then return it.

Do not seek to include further charges on this now, wait until they have refunded you and you have your money, then phone them and demand the others be refunded, otherwise you'll go back to court ;)

The review will be to 'tell you off' for no running your account properly!! I would cross that out too, but you might put up with it in order to perhaps keep the account open - your decision

My son phoned them yesterday to discuss the account. He asked for the person they told him to discuss the case with and she had left and the person he spoke to did not know anything about it. She asked if he would fax the letter that he had received from the solicitor.

He did phone them to discuss it so do you think he should now sign the letter as he has done whct they asked him to- the fact that they didn't know anything about it is beside the point.

If he doesn't sign the confidentiality clause do you theink that they will still send him the money. Have others on this site refused to sign in and still recieved the money?

  15. came back from holiday to a letter to say that they are going to refund the whole amount into my son's account- £295 . There are conditions though- confidentiality clause and a review of his account. They have charged him another £30 since we made the claim. Can we ask for this £30 to be paid as well and another £20 which we forgot to ask for originally because I mis calculated? Are we being greedy. Do you think we should quit while we are ahead or go for it?

    What does the review entail?

I will make a donation to this site as soon as we get the money. Thanks for all your help and those of you who are still in the process keep going. They will pay up in the end. I didn't believe they would but they did, so keep going.

  16. Came back from holiday to a letter to say that they are going to refund the whole £295 into my son's account. Over the moon- he can't quite believe it. There are conditions though. He has to have a review of his account and there is a confidentiality clause. Did they send this letter to you?

    What was the result.

Just goes to show if you keep on they give in in the end.

  17. You only need to put anything in here if you want it assigned to a different track or handle it differently than a standard case AFAIAA

oh dear I hope I haven't done it wrong. I put all the arguments why bank charges shouldn't have been charged. Do you think it will matter?

I'm just about to send a copy to LLoyds solicitors too.

  18. yes ive had £2520 credited back to my account.

Its just a case of having the bottle to follow it through just remember if it goes to court and you lose you only lose the court fees you paid up front to money claim. any claim under £5000 is processed via what is called small trak,

This means the claiment is not liable for any legal cost incurred by the defendent. so its worth claiming back as much as you can upto this limit. i included every charge incurred from the bank for the last six years. lloyds kept me waiting till the last minute before refunding the charges, but i was preparred to go to court if i had to as my case was good with the help of this site. i beleive you only have to convience the judge your 51% likely to be right for him to find in your favour and thats odds the banks are not willing to take so it makes financial sense for them to settle if your willing to go to court. they rely on scaring most people off by this stage. Cheers Ross

    Ross

How many weeks was it between sending in the questionnaire and getting the money into your account. Did they contact you by phone or just put the money straight into your account? Did they try to do a deal. I'm afraid that if they ring my son and offer him £100 he'll just accept as he is so broke and he doesn't really believe we are going to get anything. I want to be able to warn him to turn down all offers.

  19. Hi - welcome aboard by the way!

Good luck, and I'm sure that your soon will soon be full up, having eaten his hunble pie :D

Was it a defence you received, or a counterclaim? And what was their point G that you struggled initially with?

    John

I think it was a defence. Can't remember now. G on the questionnaire I mean It asks you to list your arguments so that the judge can decide on your case.

  20. Any news of a court date yet or a settlement? Completed my questionnaire last night and sending it today. It has to be there by 27th May. Do you think I should send Lloyds a copy. It's a bit like showing your hand and letting them know what your arguments are before hand. That could go 2 ways- may show them that we know what we are on about or give them the arguements to work on before court. What do people think?

  21. just a note to hilla all the info you need is on this site but when i filled out the courts questionerre i included a letter stating my claim ie unfair regs etc mentioning here basicly everthing i would be producing in court including cd and transcipt of the Peter Mcnamara radio 4 interview. copys were also sent to lloyds solicitors.hope this helps Ross

Thanks for that completed the questioonaire last night. Only claiming £295 on behalf of my son but LLoyds are being really determined about it. Hope we get a swift response like you. Have you actaully got the money reimbusred yet?
