    below is a exerpt from their offer letter:

     

    "Your query regarding the default notice on your account has been reffered to our legal department."

     

    One final question:

     

    I never recieved all of my statements so the amount that they are refunding is based on them reading the total of charges off of their computer system. I mentioned on the phone that i would be continuing my action to recieve all of my missing information soi that i can continue my action to remove the default.

     

    If i finally get all of my statements and the total of charges is greater than the value they told me can i then take them to court for fraud as they lied to me about the total of charges and that is what i based my acceptance on?

  2. I had a Bank of Scotland account that had some serious charges on it and had also defaulted for £4!!!

     

    I have been proceeding my claim but only recieved half the statements so didn't have info to ask for the removal of the default which was caused due to charges and interest upon them.

     

    Basically BOS are making a full and final offer for the whole amount but the department that are dealing with it can not arrange to remove the default as itis not their job apparantly.

     

    My problem is that i dont want this 'full and inal' offer to then negate my ability to take the bank to court for the removal of the default. Can anyone please advise?

     

    They say that it will not affect my right to claim to have the default removed because their offer only regards the refund of the charges but are 'unable' to make a statement to that extent in my offer letter. What they are doing is saying that it is being reffered to the legal department.

     

    Will i be ok to accept the offer and then sort out the default later because i could really do with the money just now.

     

    Will it maybe work in my favour because if they are recognising that the charges should not have been charged then because i defaulted as a result then the default should be removed? Or will their offer be inadmissable so to speak should i have to go to court regarding the matter.

  3. Got the court papers back at the weekend:

     

    Return date 22nd February

    Hearing Date 2 March

     

     

     

    Thats awfull far off is it not?

     

    I know the hearing date is normally a good couple of months but i thought the return date was normally a couple of weeks after issue of teh summons or am i getting myself confused?

  4. I'm ready to fill in my claim forms as per the scottish procedure post on this site but i've hit a small glitch.

     

    I'm claiming against Woolwich who used to have a branch in Aberdeen but they have now changed it to a Barclays. Therefore there isn't a Woolwich branch/branch manager in my town to use as the defender.

     

    I have however recieved correspondance about my claims from Barclays as it appears they have taken it over from Woolwich. Would i be in my rights to say that as Barclays are dealing with it for the Woolwich that i can use the local Barclays branch/branch manager as my defender.

     

    Also i never sent any correspondance through the branch therefore the manager knows nothing of my claim, am i still ok to use him as the defender?

    Got myself into a very bad state with this card so not looking forward to seeing the info once i get their reply.

     

    SAR sent 4th Sept, acknowledged 20th September charged my card and also kept the PO i sent so need to find out what they did with that.

     

    Watch this space.

    SAR sent 4th of last, no acknowledgement, haven't checked if they've cashed the Postal Order i sent (Why didn't i send a cheque????) waiting game now i suppose.

     

    Reckon there must be easily a grand in charges, it was my main account when i was a student, randomly found an old statement for nevember 2002 and it had about £150 all by itself.

    SAR was sent 4th sept, no acknowledgement yet. Paid the £10 by PO instead of cheque (why i don't know) so not sure if they've cashed it yet, need to check with post office.

     

    Probably looking at a couple of hundred squids hopefully

  8. Right things seem to be moving along well. I sent my SAR on the 4th September, recieved info of charges back for both my current accounts just waiting for mortgage accounts. Going to send my first prelim request for £735, In scotland so very lucky one account is less than £750 to make things easier.

     

    Just wanted to confirm before i send this, all of the £735 is made up of £3/day daily charges for being over my agreed averdraft limit, can i reclaim these?
