  1. I got a call from barclaycard the day before the court case. They claimed that they hadn't received my settlement form. am not sure if thats true or not but you can't trust the post and i didn't send it registered post. anyway i sent another copy of the settlement form which arrived Friday. I am now waiting for the check to arrive.

  2. got my papers in on time. got a call from barclaycard on the document deadline offering to settle if i would cancel my claim. i got the settlement doncument from them which i signed and sent back nearly two weeks ago. i wrote to the court cancelling the claim. am still waiting for my check though. If it doesn't arrive by Monday i'll send them a letter reminding them.

  3. recieved a letter from capital one this morning. They are willing to settle in full to avoid court. They will credit my account with the £668 i am claiming and send me a check for the amount above the balance owed. Is such a relief that its over as this was my main claim. Just one more to go now.

  4. Got a letter from Barclaycard saying they unwilling to pay up the remaining amount so have just submitted a claim for the remaining £180. Hope one of my claims is settled soon as i've spent £140 submitting claims and i need my money back.

  5. don't know how my natwest thread ended up in the capital one forum. have a capital one thread also. maybe i came into this forum intending to start my cap1 thread but got distracted and started the natwest one by mistake.

  6. Got a partial refund from Barclaycard so had just enough money to file my claim against Capital one online. I was claiming £480 but with additional charges, interest and the court fee they will have to pay me £660. I would have thought they'd want to save themselves the money and the hassle.

  7. I sent my prelim letter to barclaycard on the 15th Sep asking for £300 back. I recieved a letter from them 5 days later saying that they were looking into the issue and hoped to have the matter sorted by the middle of October. Being something of a cynic i thought this was just a delaying tactic and was just waiting till i could send my LBA. The optimist in me had me checking my account online, really don't know why. I was suprised to find they had credited my account with £120 only 3 days after i got their letter. Its a bit strange that they didn't let me know. They haven't sent me a letter yet or made me an offer in writing. It was a nice surprise as i need the money to file my claim against Capital One. I am still going to send the LBA when the 14 day deadline is up but am encouraged by the fact that they refunded part of what i am asking for within a week of my prelim letter.

  8. received my claim number at the beginning of the week and then today received a letter from the court saying Natwest have acknowledged the claim and intend to file a defence. Why do they have to drag it out? I'm not a very patient person. I've been climbing the walls waitng to get my mail. It doesn't help that the post doesn't arrive until 2.30 in the afternoon. Anyway i just wish they would pay me my money and get it over with.

  9. recieved an offer of £220 today, its £260 less than i'm after. I really need the money but don't want to let my desperation lead me to losing out on what i'm owed. If i can stand the stress of the wait and get the full amount then i can nearly clear my balance and start fresh. I wrote back accepting the money as a partial payment and telling them i'd put in a claim if they didn't pay me the rest.

  10. have recieved my letter from s higley. They're not going to pay me back my charges just yet. Am going to have to put a claim in. Unfortunately i have no money until i recieve my student loan in six weeks. If i can borrow some money from my family will put the claim in at the local court.

  11. i have started trying to claim my charges back from Natwest and now am ready to claim charges back from capital one. I still have nearly all my statements so don't need to get copies. Have totalled up my charges and it amounts to £480. I'm eager to claim it all back especially as am still bitter about how some of the charges came about. Capital one was my first credit card and i got it before i was due to go abroad for four months. I wasn't supposed to pay a yearly fee but they charged me a fee of £18. I was away so didn't know about the charge and they charged me a late fee of £20 for every month i was away. They then wrote saying they shouldn't have charged me the yearly fee and refunding me £18 but still leaving me £60 of charges to pay off. I payed the additional charges even though i'd never even used my card because i didn't have the nerve to challenge the charges.

    anyway four years on i'm claiming it back. I wondered if the prelim letter was the same for banks and credit cards? do i just make slight adjustments? Also should i mention the mistakes they made in charging me when it was their mistake in the first place. It only accounts for a small amount of my charges but it might make them more inclined to refund my charges early.

  12. I don't really have a problem with Natwest but am annoyed because whenever i go over my overdraft limit and a direct debit fails to go out they charge me £38. They have charged me about £260 since i opened my account so i finally decided to claim the charges back. I had all my statements so i just sent out my prelim letter on Monday 7th August. I recieved a reply today. They are offering me £114 but am planning to reject it. I'm about £70 past my overdraft so need the full amount. The second letter goes out tommorow. I am hoping they'll settle at that stage since i'm only claiming £260 but expect i'll have to go to the next stage.

    I'd be interested to know if anyone had them settle after the second letter.
