  1. Hi everyone,

    About a year ago I wrote to Santander complaining about excessive arrears charges and them sending field agents out without informing me that I could refuse the visits. Santander refused to pay up so I sent a complaint to the FOS. After over 6 months of waiting I finally received their judgement today which boiled down to them not considering the fees to be excessively high.

     

    When I spoke to the guy on the phone and mentioned the FSA judgements he seemed to indicate that since the judgements weren't made against Santander, they don't apply to Santander.

     

    I'd love some advice on what to do next.

  2. After getting my Halifax charges back, she who must be obeyed decided to get hers back from Barclays. After sending letters etc she eventually filed a claim on MCO.

     

    The claim was deemed served on 21st Feb. A short while later we received a letter saying they intended to defend. On this letter it said that if they don't file a defence within 28 days of the date of service, judgement may be entered against them.

     

    It is now over 28 days since the date of service and we have heard no more. Can my wife now ask for judgement?

  3. Thought I should post information about our claim against the Halifax.

     

    This is how things have gone so far:

     

    17th July - letter asking for statements sent.

    9th August - Statements received and request for repayment letter sent (£3643)

    11th August - Sorry, we'll get back to you etc letter received

    25th August - Letter before action sent (claim increased to £3760 inc new charges)

    26th August - Settlement offer received (£465). Rejection letter sent.
