  1. Hi all

    I tried to get RBOS to stop charging me for unauthorised overdrafts, which they created by charging me for an unauthorised overdraft taking me over my limit.

    I was told they would not help because I had already received money back through the court for unauthorised over drafts and other illegal charges.

    Aren't they sweet.

    Come on OFT, FSA, untie our hands and lets us get at them.

    Does anyone have any idea when the OFT v Fecking Banks court case, might be completed, I have had a stay put on my claim, very annoying.

    Is there anyone getting their claim heard in court at the moment or is the whole court system on hold until the outcome of the OFT case.

    I am starting the court action this week.

    It looks like OFT court case could go on for some time before a resolution is found, months rather than weeks by then there will be a lot of cases backed.

    I received a reply from RBS about my claim, they say until the out come of the OFT test case the they have asked the Financial Services Authority (FSA) to suspend the normal timetable for dealing with bank charge complains and therefore are no dealing with any complaints.

     

    They say the the FSA has indicated that as a general proposition it will indeed not proceed with cases which will rely on legal issues being considered in the test case.

     

    They also say the master of the rolls (in england and wales) and the the lord chief justice in northern ireland has issued a notification suggesting that the county courts stay proceeding until the test case is resolved.

     

    Is the true, I think it could be a smoke screen, should I continue with the next stage informing them that I am about to initiate court proceedings?

     

    Can anyone help.

    I have sent off the first letter, but just received another charge for £28 quid putting over my overdraft limit again.

    Is there anything I can do to stop this madness now without going to court or do I just add it on to the rest of my claim.

    I have just totaled the maintenance charges on my RBS account and I am about to start claiming the money back from the bank.

     

    I have in the past claimed the £38 paid refferal charges over the same period, but missed the £28 maintenace charges.

     

    Has anyone claimed the £28 maintenance charges back.

     

    Also when the maintenance charges were taken, there was also an interest charge can I claim any of this back.

    Were the charges after 6 years or before?.. The reason i ask is that charges are normally claimed upto the 6 years within the time limit. However, quite a few people have claimed beyond the 6 years, by using the Limitation Act, and have been succesful in doing this. There is more intoformation here on that:

    Then look at other threads in your bank’s forum, so as you know what you can expect to happen.

    The royal bank of scotland charge £38 for an unauthoristed overdraft and £28 over and above that for a maintenance charge if the overdraft limit is exceeded, can I claim the £28 back.

    Thats what I,ll do.

    When I spoke to them I suggested that if they were waiting for the OFT court case outcome before they accept claims for illeagle charges, then they should stop taking the charges also, funny but they said they wouldn't.

  11. I contacted the RBOS last week asking about a charge made on my account.

     

    I ask for the £38 pound taken from my account to be repaid, I informed them that I had already retreived money from them for illegal charges.

     

    I was told that they would not look at any further claims until the OFT test case was completed.

     

    Is this correct?

    Court date was this friday, got a letter from Barclays monday paid in full.

    It was so easy they said it was relatively small (£1485) and not cost effective for either party to take the matter to trial.

    Ha it may be a small amount to them but not to me.

    go on everyone it feels great to beat the B******ds.

    Now how do I donate to this site.

    I have made the claim for refund.

    I have recieved an offer of £715.

    I have sent the LBA and they would not offer anymore.

    I am about to apply to the small claims court.

    Has anyone any experience dealing with Barclays through Scottish courts. I am raising two claims. 1, £740+176.85 interest, 2, £340+134.82.

    The 1st claim is under the max claim allowed, but when the interest is added it is higher than the max, am i doing the right thing.

    Any help would be great.
