    OVERARCHING PRINCIPLES OF FAIR BUSINESS PRACTICE

    2.1 In the OFT's view, there are a number of overarching principles of

    consumer protection and fair business practice which apply to all

    debt recovery activities.

    2.2 In general terms, businesses17

    • treat debtors fairly – debtors should not be subjected to

    aggressive practices, inappropriate coercion, or conduct which

    is deceitful, oppressive, unfair or improper, whether unlawful or

    not

    should:

     

    • be transparent in their dealings with debtors and others –

    information provided should be clear and should not be

    confusing or misleading

    • exercise forbearance and consideration, in particular towards

    debtors experiencing difficulty – we would expect businesses to

    work with debtors with a view to providing them with

    reasonable time and opportunity to repay debts and, where

    appropriate, to signpost them to sources of free independent

    debt advice

    • act proportionately when seeking to recov

    Dear Sir

     

    Thank you for your email

     

    As you have failed to accept my payment arrangement I will now await the County Court Summons after which I will enter a defence so that a full hearing can then be held at County Court, I will submit all email correspondence regards this matter to prove I have done my utmost to prevent wasting the courts time and will ask the Judge to take into account my serious Financial Difficulties which you have failed to do. I will look forward to the Court making a judgement on how much I will need to pay each month to reduce the balance. I understand that when it goes to court , the court terminate any further interest charges,

     

    My offer remains on the table both now and at any court hearing

     

    Can you also send me your final response so I may take my complaint regards your organisation to the Financial Ombudsman whereby you will have to pay a non refundable fee of £550 for the case to be heard.

     

    At no time in my communications with you have you advised me of my right to go to the FOS for this matter to be settled and I will also advise the court of this

  4. okay good luck and remember the OFT will not ignore the form, they cant help you personally regards the debt but they can take action against the lender including fining them or even revoking their licence to trade, The OFT also dont deal with the underlings at the company but the top people who own it

     

    Alot of people on here have won battles against Payday lenders it just a case of sticking to your guns

  5. once i get to ten posts i it will allow me to post the OFT Irresponsible lending complaint form which you need to fill in and email to the OFT regards each payday lender you are having trouble with. Whilst the OFT cant assist you personally they will register all complaints and get in touch with you if need be regards further information to take action against the lender, the more people who complete these forms the more evidence the OFT have to revoke a licence

  6. Tell them you are making a formal complaint over the fact they are refusing your offer and remind them under th 1974 Consumer Credit Act they can not refuse any payment you try to make to pay the debt off

     

    Advise them if they fail to accept your payment you will take them to the FOS and the lender will have to pay a non refundable fee of £550, it will cost you nothing

     

    When you applied for the payday loan, did the lender ask for evidence to check any of the following

    your income e.g. payslips, P60

    your monthly expenditure (how much you spend on bills e.g. bank statements)

    your employment status

    specifically whether you had any other credit commitments (e.g. other payday loans

    This complaint form is designed to help you tell us about your recent experience with a payday lending business.

    What is a payday loan?

    We consider a 'payday loan' to be a short-term, high interest, unsecured loan, expected to be repaid by the time borrowers receive their next regular income payment. This will normally be on or around 30 days of having been granted the loan.

    References in this form to ‘rollovers’ relate to cases in which payday lenders may allow loans to be rolled over beyond the original repayment date provided the borrower pays another month's fees and charges. References to ‘refinancing’ relate to loans where additional credit is advanced or the terms and conditions are changed

With regards to any Payday Lender advise them you are making a formal complaint and they have to look into this within 8 weeks, if they send you a final response then you can take it to the FOS whereby the Payday lender will have to pay £550. Make the Payday Lender you know it will cost them this amount. Also completethe complaints link which you can find on the OFT website

     

    Advise the Payday Lender of this link and that you are going to make email a complaint using this form to the OFT.You can make this complaint regards irresponsible lending by the payday lender at any time you wish

     

    Remember Payday Lenders work on fear and ignorance of the borrower and try to lie and bully you

     

    Minicredit tried that with me, i stood firm and stated i would only pay back the loan of £600 plus £150 interest and £50 charges, they kept refusing the account went to OPOS and I made it cleat that was all I would pay and it was agreed . A year after taking the loan out with Minicredit I paid them back £800 which i said i would and not the £1800 they were asking for.

     

    Payday Lenders are about to get a very rude awakening which is long overdue
