Thanks - I will do that today.
I did speak to HFC (now fully HSBC) and they said that the account was closed when i paid the £96 but the additional amount was sold onto a DCA. They confirmed they have never defaulted the account and that is why it previously was showing as settled on the CRA report.
Can i also write to DCA nad request they remove this default?
-
The default date is listed as March 2014 (5 years and 3 months after the account was closed). Yep, i think the balance was £150 and i paid off £96. The account was then closed.
Is there anyway i can remove this default or does it stay on for another 6 years (2020!!).
-
It has never been defaulted. It was closed in 2009 and has shown as settled ever since.
The DCA have just updated the account 5 years later and put a default on there. Can they do this? I thought it would have to be done within 6 months of last payment.

Hi,
I wonder if anyone can help.
In 2009 i closed an account with HFC for a reduced amount of £96. It has been showing on my credit report ever since as 'settled'.
However, the same account has now been updated with a default - 5 years later! I called HFC and they said the balance of the account was sold on to a DCA and it has nothing to do with them now.
What can i do?
Thanks

Got a third letter now. That is 3 in 6 days.
They are offering me a deal to settle the alleged account for 250. Very reasonable when they allege the debt is 1400.
Only problem is that it has crossed with letter bearing bad news for them. Statute barred I'm afraid.

Yes they will drop the debt like a hot brick!
Send this by recorded/signed for post:
The Compliance Manager
Ruthbridge Ltd
Ref: Use theirs,,
Sir/ Madam,
I am in receipt of your letter dated xx xx xxxx regarding an alleged debt for £xxx .xx please not I do not acknowledge any debt to Ruthbridge Ltd or any company it may claim to represent.
Having reviewed my credit history I have concluded that any such alleged debt is STATUTE BARRED and I will therefore not be making any payment.
I am fully aware of the OFT Guidance 2003/2012 and the sections regarding the pursuit of statute barred debts and the section regarding the sale of such debt without informing the debt purchaser of the status of the debt.
Ruthbridge Ltd is reminded that should it dispute the status of the alleged debt the onus of providing unequivocal proof that the debt is not statute barred falls entirely upon Ruthbridge Ltd.
I now require Ruthbridge Ltd to cease processing all data relating to me and to remove it from its records immediately.
Ruthbridge rarely reply to this letter and I guess the noise of toys being thrown from prams in Twickenham will be very loud.
Thanks Brig. I will make a donation once this is sorted.
One other thing. Shall I copy in Cabot?
-
Thanks. Will they go away then or persist?

It would have been paid off in 2001. That is the last time I had anything to do with it.
Not on my credit file. I check these regularly. I actually have a top credit rating as I've learnt the errors of my youth.

Hi,
Had 2 letters from these guys in the space of 2 days. Say I owe Caboot 1400 for a credit card from MBNA.
Now, I had one of these in 2001 when I was young and stupid but far as I know my parents paid it off at the time. If not there could have been no more than 300 as that was my limit.
Any ideas? I'm not paying these clowns.

Not much of a story yet.
Just covering myself in case something comes back to bite (sent that response to someone in 2008) but have not heard since.

Will the following statement class as an acknowledgment?
Dear Sirs,
I refer to your letter dated x.
I do not know of any reason why i would owe the sum of xx to xx.
Please can you provide more information.

Noddle is often not upto date, and Experian has been slow lately I closed an account fully paid off in July Experian still show an os balance Wquifax shows settled.
Write to the data controller ant both CRAs to get it sorted.
Sorry Brig, think I didn't make my post that clear.
I checked my credit reports and they show the account settled in 2009. The only thing that bothers me is the final payment was for 96 and I didn't pay that.
I called the lender and they were happy the account was settled in 2009 and said it hadn't been sold on so I can assume they wrote this small amount off.
The payments leading up to the settlement date are all green and marked as paid as normal it's just this last figure that bothers me.

Just looking on my credit report (experian/Noddle) and it shows an account i had for a small loan as settled.
This was 3 years ago - no defaults as payments were kept up but the final balance paid was £96 (which i don't remember paying). Does that mean this sum is still outstanding.
I telephoned the lender and they said they can't give me payment detials but they informed me the matter is closed and i don't owe anything. They said they have never defaulted the account and have not sold it on.
Where does this leave me?

Thanks for the advice.
I am just worried as i have heard the dirty tricks these DCA's use to get people to pay. I am just assuming that at sometime in the future they will catch up with me and i will be ready when they do.
Have you ever heard of someone never hearing anything about a debt this old?

Hi,
I had an Egg loan in 2001 which was defaulted late in 2002 for various reasons. The balance was around 3.5k.
I have since then rebuilt my credit history and on checking my reports i am in good health and have been able to obtain credit.
It is now 10 years on and i have not heard anything about this loan - what could have happened to it? Is there anyone i can contact to find out as i would like peace of mind.

in HFC (Household)

Just verbally. I will SAR and see what happens. I just wanted to know that even if the debt was legit and sold onto a DCA, can i get the default removed/amended for being put on 5 years too late?
