Thanks for the advise, I am not expecting a cheque, would just like any unfair charges removed so the debt is more manageable.Not sure what right they would have to add these extra charges, may look through the Libary to see if there are any letters to send to DCA regards charges if not I will send a SAR to Wescot making sure they are aware it applies to them.

  2. Do you think a SAR request should be sent to Wescot as well then as it appears they have added the charges as HBOS have informed in witing the account was defaulted and the interest stopped. The balance has risen £1100.00 since this happened.I am hoping these will be deemed illegal charges which I can get wiped.

Hi everyone, and thanks for the advice.I have received the CCA from Halifax signed by me but not by anyone at Halifax, not sure if this affects anything.However in the letter from Halifax they state that my account was defaulted on the 08/07/2011 with a balance of £5079.66 when all interest stopped.

     

    The account was then passed to Wescot to collect. At this time I had stuck my head in the sand and was not really dealing with anything.However by the 17/11/2009 Wescot were telling me the debt had risen to £6256.66!.

     

    I am unsure where this extra £1177.00 comes from, ie Halifax or WescotI have sent a SAR request to Halifax today, however should I do the same to Wescot and if it is Wescot who have addeed these charges, are they legal, can they do this etc etc To find out where these extra charges came from would I need to send another SAR to Wescot? or would a letter do?

Hi looking for a bit of advice.I am about to send some SAR requests out to a number of different organisations where I have accounts with in order to look for an PPI or illegal charges.I am aware that there is a cost for £10.00 for the request. I am going to enclose a postal order to each financial organisation, however my question is , is it OK to leave each postal order blank .The reason for my question is I have had problems in the past for example I have requested a CCA and forgot to put a Ltd on the end of the company name and had the request returned.

I have a couple of defaulted current accounts with main street banks.Both accounts defaulted back in 2009 and have balances of around £500 owed.I have attenmpted to make F&F offers to these banks but one never responded and one refused.I am about to send a SAR request to bth in order to see if there was illegal charges on the accounts.My question is though, should I also send CCA requests or is this negated by the SAR requst.Many Thanks in advance.

    Got a letter from Crapquest today.

     

    It stated that they had received statements from Citicard but unfortunatley they had still not received the CCA but had requested it. ( Its over a month since the account was put in dispute because of their failure to produce the CCA)

     

    The letter also had a paragraph stating they purchased the account from Citibank in 2009 and were not made aware of any dispute or issue with the account and were acting on good faith based on the information provided by citicard.

     

    Does any one think this paragraph has any signifigence?

     

    There is no PPI on the account and charged add up to about £300 of the debt, all £12 late payment fees

  7. I started Paying Capquest again because I owed Citibank £3500 which was sold to CQ when I defaulted and my CRA confirmed this.

     

    I understand what your saying in that no DCA will offer a discount from a position of strengh, that is why I started with a CCA request which they have not complied with, hence me coming on here for further advice.

     

    Are you suggesting that I should not have been paying them anything even though they are on my credit file and the account is defaulted. The bottom line is these were my debts and I want to try and clear them one day and no longer be in debt, the reason im on here is looking for some advice that will improve my hand

    Look I have come on this site hoping to find some help and advice on trying to clear my debts.

     

    I have started with one Capquest and sent a CCA to them as off tomorrow they would not have replied with in the 12+2 days allowed. I jst wanted to ask someone if I should be sending a follow up letter puting the acount in dispute. In any case I was under the impession that even if the DCA can find the cca the debt can and will still be collected/

  9. I sent a CCA request to a DCA on the 11/07/12 by recorded delivery.

     

    A response was sent back to me on the 12/07/12 stating that a copy agreement had been requested from their client and will be sent to me when received .

     

    The deby was originally a Citibank card started sometime in 2006 /2007. Though the debt is recorded on my CRA with the DCA.

     

    From Tuesday that will be 12 + 2 since they received my request. if I have not heard anything from then is the account in dispute and should a follow up letter be sent.

     

    Im also a bit confused, as im aware that the debt still stands and is collectable, however if they cant provide the CCA does this mean they can not put a CCJ on my CRA (however the account is already defaulted!

  10. Hi, looking for some advice. I sent the CCA request to Capquest by recorded delivery on the 7/7/12. I had a letter aknowledging my request on the 12/07/2012. The letter stating that my request had been sent on to their client and will sent to me when received.

     

    The debt is theirs as they purchased it from Citibank! They are also shown on CRA

     

    Not sure where to go from here, is the account now in dispute if so is it best to continueing making the token payments I am at the moment?

  11. Ok dismissed by Halifax,

     

    However about six months ago I rang Wescot to make an F&F offer and they told me over the phone and they said more or less what they just told me in a letter. during this telephone call they didnt contact Halifax they appeared to make the decision independant of Halifax. They also styated in this call that the default would stay on my CRA file for six years from the date the account is settled, hence me not trusting them 100%

  12. Hi Thanks for the reply,

     

    If I am honest, I could not really say Wescot are treating me unfairly, they have been civil enough and agreed to drop my monthly repayments when my circumstances changed, I just would prefer to deal direct with Halifax. Again it is really my fault as I stuck my head in the sand when I defaulted and as a result Halifax passed the case to Wescot.

     

    I want to clear the debt and think I made a fair offer which was a staring point and it has been dismissed out of hand by Wescot.
