  1. Ok, ok i know it's been a while ;)

     

    Abbey suggested that i should contact the FOS if i wasn't happy with there service so i did.

     

    Got a reply from the FOS this morning and Shabby have decided to settle my complaint in full rather than invite a formal investigation :)

     

    There's me thinking the FOS was a "toothless tiger"

     

     

    Capital one are next the robbing barstewards :)

  2. Because he feels we have not been able to reach a suitable resolution or it may be that i asked for a complete list of refunds that appeared on my last statement apparently given as a GOGW. Who knows?

  4. Anybody else recieved a letter from Philip Blaver refusing to respond to any further correspondense?

     

    What a pig ignorant barsteward this guys is. As requested by him, i have just sent off a copy of all letters sent/recieved to the FOS. I know the FOS is a toothless tiger but i want to cover every angle when i submit my n1.

  5. Ok! Advice given is that I MUST write giving them a further 14 days to supply me with the dates that relate to my refunds. I did phone Shabbey and they couldn't supply me with any dates as they gave it to me as a gogw and not any kind of refund for charges (even tho i have 22 miscellaneous fee refunds on my statement?).

     

    If they do not supply me with the dates or again insist that it really is a gogw, then i will have no alternative but to chase them for the full ammount claimed in court as i cannot adjust my figures to reflect any changes. It would then be up to the court to decide if i have a valid reason for persuing the full amount.

     

    There is a chance that it could be thrown out if you have not tried all reasonable attempts to determine if the gogw was just that or refunds for any charges the bank has levied. So be very careful! I believe this is a tactic on Shabbeys behalf to get the matter thrown out of court.

     

    On a plus note, my Solicitor did say that he has consulted his partners and are approaching an insurer to secure cases concerning the banks on a no win no fee basis :)

     

    Happy days ahead for the banking industry methinks ;)

  6. right i received a letter back from abbey yesterday saying: "Having carried out full investigation, I can assure you the charges do not contravene those regulations and therefore I cannot agree to refund all of them. However, as a gesture of goodwill, I have refunded £290.00, for the period between 30 May 2006 and 14 September 2006."

    I got a part refund as well but unlike you, i was given no specifics as to what the refunds where for or for what dates. I accepted it as payment for hardship caused to my family and myself and promptly used it to pay off my o/d and settled my other outstanding debts. I think that because SHAbbey have given you specific repayment details you will have to take it into consideration when filling in N1 as part payment.

     

    on the N1 form where it say court fee, do i need to write the amount in here even if i claim legal help?

    Just ask the court for help before submitting. I'm sure they are on our side and will help :)

  7. I have an appointment with a solicitor this Thursday due to an unrelated matter. I'm gonna push my luck with him and ask just exactly what a GOGW means and if it should be taken as part payment or a gesture for any hardship caused.

  8. Seven days before i submit N1 and i'm a little troubled by my last letter!

     

    Even tho Shabbey made a gogw direct to my account and i accepted it as payment for hardship caused, should i go the whole hog and claim the original amount? I'm thinking my initial high of getting something back may have made me a bit cockey :(

    Thank you for your letter dated 04/09/06 in which you made a gesture of goodwill to the sum of £570 placed into my account.

     

    I shall accept this as payment for the worry, stress and debt that your illegal charges have placed upon my self and my family.

     

    As a gesture of goodwill on my behalf, I shall give you a further 14 days to agree with my request for £1,225 before I commence court proceedings.

     

    You should already have in your receipt two copies of the schedule of charges that I am claiming for I see little point in enclosing another copy.

     

    Once again, I thank you for your gesture of goodwill.

  10. Ok y'all :)

     

    Looking at my statement i have 22 "Miscellaneous fee refund" all entered on the 4th of this month. It gives no indictation as to what dates these refunds apply to so i'll phone complaints (0845 600 6014) and ask for a breakdown.

     

    Got a letter this morning hand signed by Martin Dillingham ..

     

    Thank your for your letter dated ** August 06, about your bank charges. I am sorry you feel these charges are unlawful at Common Law, Statute and recent Consumer Regulations.

     

    Having carried out a full investigation, I can assure you the charges are fully valid and in line with our terms of the account and therefore I cannot agree to refund all of them. However, as a gesture of goodwill, I am happy to credit an amount of £570 to your account.

     

    (BIG SNIP EXPLAINING HOW TO COMPLAIN TO THE OMBUDSMAN)

    I have so far only threatened court action but for them to give me £570's as a GOGW (thanks Lula) will not in any way affect my claim for unfair charges. I'm still going for the full £1,225.

  11. It is "new" common practise for shabbey, IMHO they are playing at a new tactic, i would ask them for a breakdown of the GOGW and take it off the most recent of your charges before you claim,

     

    The charges they have refunded date from January this year. Needless to say when i do submit my claim i shall deduct those charges plus interest. What's a GOGW?

  12. hi ayzi, good news for you! Just wondering how far down the reclaiming stage are you with the Abbey? Be nice if they did that for the rest of us, it seems they work so unpredictively........

    They buggered me around with my Data Protection Act request but i discovered that if you ask for statements via the only banking service you get them within a month for free (watch them close that loop-hole now)

     

    Sent off my first letter claiming all charges and they replied with a standard 4 week to investigate blah-blah, replied with the second letter of action (final) stateing that as it was not a complaint i would not give them four weeks to investigate but gave them a further 14 days before i instigated court proceedings. They buckled after 10 days and paid £570 into my account :)

     

    I shall send them a letter tomorrow thanking them for the part payment and will give them another 14 days before i claim the outstanding balance in court.

    Taking Shabbey for £1,225 and today they put £570 into my account as a gesture of goodwill. It's in my account with no explanation via letter or email, i had to phone them to see what it was for. If i touch any of this money does it mean that i can no longer proceed to claim the remaining ammount back in court?

     

    I'm confused?

  14. Ok! After having Abbey mess me about with the dpa request i finally got my required statements FOR FREE just by ordering them using the online banking system ;)

     

    Sent off my first letter claiming back over a thousand pounds and gave them 14 days to reply. Got the letter back this morning stateing that they need another 4 weeks to investigate? Should i go ahead with my second letter for a full refund or should i allow the 4 weeks? Should this come to court i don't want Abbey to turn around and say i gave them unreasonable time limits.

  15. Got a letter today 2 days after i cancelled my cheque claiming that they would send the dpa request using my 10 pounds!

     

    Looks like i'm going to have to start this process all over again after the 30th of July (when the dpa request would have run out) because of bad advice from the bank.

     

    I will lay odds now on abbey charging me for a bounced cheque that i cancelled :(

     

    I'm thinking of giving up as this is all becoming too much of a hassle.

    Just requested a claim form from RM as there is no proof that it was delivered. I'll write another Data Protection Act request addressed to my towns bank and if that's ignored i'll estimate what they owe me.

     

    On another note - if i have fallen behind with DD's because of cancellation due to high charges incurred, would i have any chance in re-couping these charges such as TV licence, water and catalogue?
