  1. As you were at the IUC I am assuming that the claims were in your name. I then get a bit confused as to when your husband worked and when payments changed from your bank account to his.

     

    Are you saying that the benefit was paid into your account until he started work in 2002, who changed the payments over to his account. You will have had to sign a form giving a change of bank account details.

     

    The fact that you have signed paperwork without reading anything isn't a defence. Its your claim, its your responsibility to make sure its correct.

     

    Depending on what you said during your interview it may be that a decision is made to interview your husband as well. If he has completed the claim forms and payment went into his bank account he can be charged with aiding and abetting, or knowingly allowing someone to make a false benefit claim.

     

    Either way, the documents that they hold relating to his work will be sent to a decision maker, they will decide whether or not an overpayment has occurred and a calcualtion will be made.

     

    If the overpayment is in excess of £2,000 (which I am guessing that it will be) then the case will be referred for prosecution. You should also be aware that if the overpayment is over £10,000 that a referral will be made to the financial investigators who will consider whether or not to press for compensation under the Proceeds of Crime Act.

     

    If the court decide that you have sufficient resources then an order could be made by that court that you realise the funds from your property to repay the overpayment within a given time period.

     

    I know that this wont put your mind at rest, but whatever happened is done. It needs to be sorted out.

    the original claim in 2002 went into my bank account until 2005 then he started to work and the benefit stopped into my bank, but he had phoned them up giving his bank details, and i thought we was ligitimate. He has already had 4 interviews over the past 12 months but he says no comment and they haven't issued him with a alergation.

    I have had a IUC and they have put an alleged allagation to me. My husband and i was claiming HB CT IS IC CT and WT not all constantly. My husband handles all claims and i just sign mainly without reading them. They have all payment going into my bank account and also have proof that he worked, which i didnt understand as he told me he informed them. But it was all there in black and white for about 3 years, now he has the benefit paid into his bank which i thought we wasnt claiming anything and it turns out he never stopped our claim (or told them of work since 2002).

    What will happen if im found guilty as it was only me at the iuc, and i am really worried about this, will the give me a custodial sentance or can my husband take the blame?

    Can they make us sell the house?

    I have a question though.

     

    Can capital one demand that i pay up what i owe and close my account if the mood takes them?:confused:

    i got my charges back from capital one and they did close my account and i have been over my limit for over 12 months, but when they did refund me they paid it off my card so i was in credit, then i spent it!!

    yes i got back £4200 from hsbc, they kept writing and saying these charges were applied to my account and they stand by there descision but they paid out when i filed a claim at mcol. If you have online banking with them, this will save you time as all your statements are available online

  5. Hi, I'm all a bit new tothis and have been reading lots of advice etc, I would also like to start reclaiming bank charges from HSBC, however you may think I am being really dum, but do I send the Data Protection letter to head office or the branch where my account is held?

    just wanted to say if you have online banking all 6 years worth of statements are available online so there is no need to wait for them in the post. log in and on the left click statements this goes back 6 years!!

    I have visited PayPalSucks.com is where you will learn about the PayPal Class Action Lawsuit, Abuse, Fraud & evil behind the PayPal system! and read the horror stories but i am having one of my own. Has anyone had dealings with paypal and got there money back?

    They have limited my funds for 180 days because its linked to another account (my husbands lol) i have phoned numerous times and emailed every day since april. They will not release the funds until all issues have been resolved, which they have, documents faxed ect id faxed bills faxed, now they saying we will part ways as i am potentially high risk and am related to another account. which i keep telling them is my husbands but they will not divulge this info because of the DPA.

    Anybody any ideas?

    Also did you know that if you bought a item and paid via paypal, which was sent 1st class royal mail......or something that is tracked that you could start a claim through paypal saying that you haven't received it and you will win. As i found out on numerous occasions somebody did it to me and emailed saying the item did not fit them, i replied saying sorry all measurements were listed. They started a dispute with paypal saying they hadn't received the item. And as it was sent 1st class royal mail (which is untrackable) They won and got there money back because i could no prove they had received it despite them emailing me. Despite my argument with them that there is a flaw in there system and not all people send recorded ors special delivery

  7. hi guys

    I just wondered if anybody has a managed loan with HSBC? I have been paying them £110 a month for the last 18 months and my balance has only come down by £181 i was mortified and got a statement from them.

    Only to see that when i pay them the £110 interest is added back on between £80 0 £90 a month so at this rate i will be 77 before its paid off and will have paid them back in the tune of £64,000 for £7,000

    I would be most grateful if anyone could help me

    if you have already sent your £10 cheque it don't matter but you can get your 6 years of statements online with the hsbc

     

    when you log in there is a option statements on the left click it and it will go back 6 years!!

    I phoned abbey and spoke to this wonderful guy who said they are overwhelmed with people wanting there bank statements, but he would mark it urgent for me and would you believe i had them the following week.

    Just to let all you know who bank with HSBC and want your 6 years worth of statements.. they are all online (for those who have internet banking)

     

    When you log into your account there is a option on the left 'statements' which if you click next set ect takes you right back 6 years. Saves waiting for duplicate statements to come through!!

    I have wrote the letter to the Abbey asking for my statements of which they have sent me 12 month's and the rest they said are on microfiche. It has now been 43 days since my request, has anbody any ideas on what I can do...

  12. no particular charges in mind i think i was having a blonde moment, thanks for your prompt reply, i have done this with my bank as well and claimed 4k i could not believe it was that much over 6 years
