  1. I had an interesting letter from moorcroft recently, with it ending "I believe therefore that the most sensible course of action would be for the company to return the account to our client and to cease any further activity with regard to it"

     

    So im assuming moorcroft have returned the debt to barclays partner finance, because i recieved a arrears notice the other day from BPF! Confused!!:|

I recieved a letter from moorcorft debt recovery people this time stating, in the mcguffick v the royal bank of scotland plc (2009) EWHC 2386 Mr justice flaux ruled "although the consumer credit act may render the agreement unenforceable, the agreement remains a valid and subsisting contract and rights and obligations under it continue to exist"

     

    Anybody else recieved anything like this?

  4. I have seaked some advice from the CAB recently and they are telling me unless BPF can produce the contractual agreement then the contract is void, no proof to back up their argument.

     

    I am also another where my loan was taken out with a guarantor... i have requested the contract of agreement today and also many times before but not once have they posted me this agreement, also with my guarantor's consent. So will wait on what happens.

Interesting reading coming from some of you, i was an advent student then given alternative training with computeach... then to my horror sent an e-mail today explaining that my course has expired with computeach and if i wanted to carry on my studies i would have to pay £140 a month for 12 months... surely my contract with BPF should have catered for my entire course duration, no matter how long it takes... as it stated in contractural agreement with BPF that they would HAVE to find an alternative training provider for me to COMPLETE my course, not suddenly expire with computeach and for them to start demanding money for me carry on.

     

    I feel i should stop making payments immediatly.
