  1. My working hours are not fixed but as a example I may start work at 7am and work until 2pm

    Then go home and 3hours later I will go out again and finish approx 1-2am. I will then get the Friday off as I worked my Friday hours the previous evening/night.

     

    What's happening is they are giving me more work to do during the day so I am not finishing until later giving hardly any time between shifts. On more than one occasion I didn't finish until 5 so ended up working from 7am until 2am, a 19hr shift. And basically I have had enough of it.

     

    I don't know about contract wise as I'm not even sure I have a signed contract. (terrible memory) Can I ask to see my personally file and do they have to let me see it straight away or do I need to give them notice of wanting to see it?

  2. Hi all,

    Twice a month on a Thursday I have to work a shift during the day then at 5pm I have to go out again and do a late/night shift (finish approx 2am. The day shift starts approx 7am until anything upto 5pm)

    All I want to know is how long am I entitled to between the two shifts. I have been summoned to the office for a discussion after telling the manager it was "taking the ****" after they gave me extra work to do during the day.

  3. Hi,

     

    I received a cut on my shin about 3-4 weeks ago when I open the door of my work van and something fell out and hit me.

    It was recorded in the accident book.

     

    On Monday (bank holiday) it was hot, red and pain full so

    first thing on Tuesday I went to my GP where I was told I had cellulitis.

    I was put on antibiotics an told to take the rest of the week off of work.

     

    I have to go back to the GP tomorrow as they want to check that its healing ok and not going ulcerous.

     

    I am not getting paid for this time off which seeing as it was caused by an accident at work seems a bit unfair to me,

    I have only been with the company since Oct last year.

     

    I would like some advice on if there is anything I can do to claim some money as I cant really afford to not get paid.

    (Its only a small company with approx. 12 people working there.)

  4. Hi,

     

    Last week I bought a 2nd hand car from a car dealer. They had just fitted a new fuel pump because the one in the car was faulty.

    A couple of days later, when I filled the car up, there was a smell of petrol inside the car. I lifted the rear seat up to have a look and the "well" that the fuel pump is located in was full of petrol. I phoned the trader who said to bring it back and they would sort it out, which I did.

    They didnt resolve the problem though as petrol was still leaking into the car. Back on the phone again to tell the trader it was still faulty, he said it was probably the O ring that needed replacing and he would order one, that was yesterday.

    Today took the car back to have the new O ring fitted, which they did, by the time I got home petrol had leaked out again and if anything its even worse than it was before.

    I have just returned from a local garage where I went to ask for advice on the problem, and the man I spoke to used to work for the main dealer for 9 years and he said he was 99% certain that it will be the fuel tank that is deformed as they are only plastic and its a common fault with them.

     

    Anyway to get to the point what are my rights to a refund as I no longer want the car, as I understand it the car was sold "not fit for purpose" as it was faulty from day one. If I can I would rather avoid the writing of letters etc until I have spoken to him, I would like to know where I stand beforehand in case he doesnt play ball and cough up. Then go via the more "official" route.

  5. Update from me on this,

    I have now recieved 3 letters, "charge certificate", "final reminder", "notice of collection proceedings"

     

    This morning I have recieved a letter from "Legal Recoveries & Collections Ltd" which says the following:-

     

    Dear Sir/Madam

    Athena ANPR Ltd - Outstanding Account

     

    We act for Athena ANPR Ltd.

     

    We are instructed to apply to you for the total balance due to our client of £115, being the amount owing by you to them under the following:-

     

    (gives details)

     

    Unless payment is received by 11.00 am on Wednesday 24th November 2010 Court proceedings may be issued without further reference to you. Should this course of action be taken, you may be required to pay Court costs, interest and fixed solicitors costs which may substantially increase the amount you will be liable to pay.

     

    Ive not seen any reference to LRC ltd anywhere and I presume that the appropriate advice is to carry on ignoring these letters.?

  6. In my personal opinion a crack in the disk would not be an inherent fault and is usually due to accidental damage, there are many thousands of disks produced every day.

     

    That said when it comes to the legality of things, it is up to ASDA to prove that the product did not come like that under the SOGA. (S48A). A company does not have to provide a warranty or tell you they are not providing one, however they are still liable under your statutory rights. My statement above still stands though, I would recommend printing of Part 5a of the SOGA and taking it in (It is the part where it says it is assumed goods do not conform to contract within 6 months of delivery_)

  7. 8 Weeks ago I bought Resident Evil 5 for the PS3 from ASDA, Yesterday it wouldnt load and I noticed a crack in the disk from the center hole.

     

    Being as Im not a spotty 12yr old and I look after the things I buy (no offence to spotty 12yr olds :D ) the rest of the disk is immaculate.

     

    I took the disk back today (I still have reciept) to see if there is anything I can do about it, but they said that they cant/wont because they give you 28 days to return faulty goods. I didnt really argue too much as I was unsure of where I stand legally as it was fine until yesterday.

     

    What, if anything, can I expect to get back from this, ideally I would just like the game replaced.
