  1. Hi! I'm confused. I never met anyone from Advent, not even in September 2009 when I was corrisponding by phone and e/mail with them for this course application. All the documentation was done by email therefore all I have now and is considered a copy of the Advent agreement is a black and white paper form they sent, on which I had to put on my details and the start date of the course, which In my turn I sent back and that's it. I've never had in my possesion a form that is also filled or signed by one of Advent's representatives. I was supposed to meet someone from Advent but he never made it to London as he said. I admit kids wouild have done this better, I was anyway fooled and tricked and made to believe everything was so easy and fine Is there a way of using the fact that they never sent me back the form filled by them as well against BPF, could I prove somehow I never received a filled form back?

    just a quick one i understand what you say i fell into the trap thinking we could sue them however as far as BPF are concerned they have provided us with an alternative training provider therefore they are keeping their end of the bargain

    I am going to be contacting BPF and FOS by phone throughout the day pester them like they have been pestering us I WANT ANSWERS and i have a few tricks up my sleeves to play i will let you all now this evening the outcome

    Hi! In the contract I couldn't find Barclays can keep their end of the bargain by any means they can think of. It doesn't say: if the Provider fails to provide then we have the right to find you another Provider but it says if the Provider fails we can sue us and I put my signature only for what the contract says. There will always be another Provider and if there wasn't I thing Barclays would create themselves a Provider ("The best Bank, The only Bank in the world that besides banking provides IT courses, our staff are specifically dual trained). Maybe I exagerate but I hope my point is clear. I signed a paper on which says: Retailer name : Advent Consulting Ltd

    I still struggle to understand this, when I make a contract with an institution, that contract states clearly black on white the type of relation between the parties. I look at my contract with BPF and I can't find anything that would enable Barclays to do what you suggest, it's on the contrary: THE CONTRACT says I can sue Barclays in case Advent went bust, that's it and no more. BPF is nothing but a Finance Partener and should act as a Finance Partener as their own name itself states, they are not a Supplier nor a Provider; they forgot who they are and do and if the Law with all its interpretations and points of view, doesn't make clear at least this, then we can never be sure Law permits as to cross the street on green light.

  4. There are still many unanswered questions as to what happened before Advent went bust, between Barclays and Advent. We have no proof Barclays paid full amount of money to Advent, on our behalf as it is believed and if that would have been the case why going into administration for lack of funds? Then as you say it is quite curious; to be accepted for a £6000 loan we only had to sign. Advent did it all so easy and fast as if they had some sort of unofficial deal with BPF. Then as it appears Advent kept accepting applications even though they probably knew their realtionship with BPF was going worse. I have the feeling that BPF just before taking any decision concerning Advent and us, had foreseen what would happen further and as a result Barclays might be a step ahead of us.

  5. I joined Advent in the middle of December 2009 and I went on holiday over the Christmas and new year, did not get back until 18th January so had no training at all.

     

    Barclays had already made decision to cut funding end of September when the new boss arrived from American express, it was she who looked at the books and said to cut funding to a whole load of companies most of them training companies, they nearly all went bust within weeks of each other.. no coincidence, Barclays is the common denominator between them all.

     

    I was out of work at the time I was signed up for the finance by Advent.. how was it I was given a loan? I was coming to the end of my job seekers payments, the last one was in the December so how could I be given a loan with an income of £250 per month taxable (yes dole office sent detail's to tax office they wanted their share of that money) and due to end the same month I do not get any dole money now, and have not worked in all this time... stinks.

     

    Barclays was happy to give out money when things was going well, they took the profits and gave each other bonus payments because they was doing so well.. now its different story, we are all what they class as toxic debt.. they cant sell us on easily like they could have before, they know they are on a slippy slope and if they take us to court.. they have a good chance of losing because of what happened when we all signed up.

     

    Miselling is what is going to sink the bastards ( Barclays partner finance are jointly and serverly liable with Advent) and when we sink em.. they will have to pay us compensation for stress and harrasment they have caused us all.

    If we could find a way to prove that, it's because Barclays that Advent gone bust, would be great. It would be a decisive positive progress in our case. And the behaviour Advent had on knowing we'll come to this it's weird. It's like they've somehow hidden by going bust.

    This is my first ever post. Only saw this thread last night and have been catching up on the last 10 pages or so. My situation is slightly different. I took a loan out with Barclays Finance but then paid for the course in full (electronic transfer from my HSBC account) around a year later. Since my first complaint, it has taken me over 6 months (202 days) to get to where I am now...

     

    Yesterday, I received my first call from the FOSs adjudicator who will be dealing with my case. This was the first time I spoke to her. Until I read the posts on here, I was filled with a slight hope. Now, on the other hand, anxiety is back with a vengance.

     

    I am going down the miss-selling route and that I wasn't provided with the correct study material. The usual lies apply here: "You can take as long as you need" "The MCSE course is suitable for beginners" not to mention "You only need 8 hours a week of free time to study" Only now have I heard that (apparently) it quite clearly states on the Microsoft website that you should have 12-18 months experience as a systems engineer before attempting the MCSE.

     

    It has taken Barclays until now to even respond to the FOS. I have pages and pages of dates and times I have spoke to all these organizations. Also lots of reviews from other users. I also have a friend who didn't end up signing up for the course, but had his own meeting and heard the same nonsense I was told by the training provider.

     

    The FOS wants me to send paperwork (enrolment form etc) to them but now don't know who to trust? An older post on here suggested keeping hold of any documentation as they need to provide it. Also that FOS were working alongside Barclays?

     

    I would like to help in any way I can. If anyone can give me a link to a template for a letter to an MP I will send one ASAP. Anything else I can do to help I'll do my best. Should I trust the FOS? :help:

  7. Hi, Ive posted the same thing now and im getting rearlly fustrated now. Im one of the unlucky ones who got a guarentor to sign my contract for me, and Im now lost on where to go. Can someone please give me some possible options on what I can do now as I know sec 75 doesnt cover me now. Im not willing to make a claim to be a unsecured creditor with Advent, as im going to get nothing back. Computeach will only con me when I sign up for them as I had 4 weeks left on my course end date, and after i sign they will then ask for monthy payments. So im king of screwed paying back this loan.

     

    Can anyone help at all as im not the only one in this situation with regards to the guarentors, so if somebody on here in the same situation as me, can you reply and advise what is the best course of action.

    Hi! I'm in the same situation as there are more of us. I don't know a best thing to do especially for us whom are uncovered by S75. I signed up to the legal team and hope something good will come out for us as well, eventually.

Hello fuzz.... thankyou for all the hardwork and the update, just curious, can we use the fact that Barclays cut the funding for Advent which was basically why they went bust and that we're not using Computeach for that same reason. Its the recession and there is not a lot of stability at the moment

    Probably we should focus more on why did Advent go bust, in the first place. That is the root of our problem and there might be the answer. If it went bust because of lack of funding then it would have meant that almost any of the 6000 students (or the majority) signed up with BPF. Wasn't there a legal relation between Barclays and Advent that would have committed Barclays to fund the Provider on our behalf?

  9. Could anyone outline some more reasons not to pay Barclays even if we'll win this case?

    what I mean is: We all know the risks of not paying! What about the risks of paying? there could be one just above. Are there any others? If there are, then they would make sens why Barclays is so aggressive in making us pay even if we win in court. maybe if we win Barclays will find a way not to pay us back. Other thing is: wouldn't it be better for Barclays to just sit confortable back and let us not pay and so go into interest period and so get penalties?! IT just would be more money for them. Instead they assault us in every way they can to just make us give them more, and this is maybe because they know that once we pay we won't get it back!

I think what you read was that the lawyers are still going through all our info we sent them and until it was put infront of a QC and he gave the nod that we have good case we do not actually have representation.. there is a sheet you sign at the time when you send in your documents I will need to check but I was under the impression that was the form that signs you up?

    You might be right though! I must admit I'm not sure on this matter. Anyway it's worth enquiring.

  11. How do you mean that only a few are part of the group? have you signed up to Fuzzbutts legal group if so then the number is many hundreds, please explain your thinking?

    On a few pages back I think, I once read some posts, which said that until we sing an official agreement or something formal with the lawyer, we are not properly represented by the lawyer and I also understood that the one/ones who represent/s our group has done this.

  12. Im in the same situation, my payments were supposed to start end of June, in the process of trying to get them to freeze my account but they keep sending me BS letters and tell me I have to continue to pay the monthly installments.

    From this I understand that you choose not to pay and take the risk of paying double plus penalties. I honestly don't know what to do, I have something saved for this but it's far from being enough. I've thought of borrowing from my relatives and so try to get rid of the high interest but I see many of us here who are not paying and this is what I would like to do, but the fact that I have a sponsor and this makes this a bit complicated, really gives me headache. I don't know what to do. I haven't heard much from the legal team lately, about this, about sponsors, and it's a real fact that although I'm a part of the group, practically I'm not part of it, officially there are only a very few who are, from what I understood!

  13. Yes I have thought that, other companies are really quick to drag you to court, BPF have just been waving a stick at us, they know they are on dodgy ground, hoping we will give in and pay money so they can give it to their boss for his bonus.

    I take you heard on the news about their record 44% increase in profit.. Billions!!!!

    Does it make sens? You talk about us giving in and pay the money to Barclays as if it was a Barclays victory, the moment you pay the money. Why would they want to take the money from us, knowing, in court they will have to give it back???

  14. Why Barclays is so aggressive in making as keep up the payments? After all we could consider our case a good case against Barclays with high chances of winning. If Barclays is aggressive because, as some of you mentioned, knows it doesn't stand on solid ground, then will it make any sens asking for money so it could give it back to us again? Or, may It be the case that once Barclays grabs our money then it would be harder to get it back, even on a good court case?

  15. I'm a sponsor case and I'm a bit frightened of what Ingrid could say about it! Just, it wouldn't be fair, after all this time of waiting and hoping for something from the legal team / class action. Months ago, I remember being directed to Fuzzbutt to take part in the class action. I didn't need to pay for a lawyer, I've already paid (or going to pay) enough. In Sept my brother is due to start paying with interest,on my behalf, and he keeps asking me about this all situation. I have no serious job (I haven't been helped yet by Advent to get a job and so start paying) and I haven't got all that money. BPF should check that there's no Database Administrator or Web designer degree with my name on it. I don't have a £5400 or so a year so it can claim £12000 for the training they paid for. It's them who paid, it's them who withdrew the funds, it's them who considers us puppets to decide on our behalf, it's them who ignore the law. I'm angry because the people still don't know/don't care about this/about us!

  16. Hello there!! This has been going on for too much time! This destroys me psychically and yet the same talks, attempts and complaints like when it started! I rely on Fuzzbutt and the legal team, cause they seem the best option and I know it takes time and patience and I'm very grateful to them and still I'm starting to wonder and ask my self for how long this will go?
