  1. Did not pay NI conts in 14/15 and 15/16 as I was below lower earnings limit.

     

    I am now unable to work due to a health condition.

     

    If I opt to pay the contributions for both these tax years is it likely I will then satisfy both of the contribution conditions for an award

    (I know I am not entitled to income based as my partner works).

    The second condition is really confusing me!!!

     

    The guidance online says:-

     

    You qualify for contributory Employment and Support Allowance (ESA) if you have paid sufficient National Insurance contributions.

     

    There are two contribution conditions you must meet:

     

    First contribution condition

    - in one of the last two complete tax years,

    you must have paid Class 1 or 2 contributions on relevant earnings at the lower earnings limit for at least*26 weeks.

    This means you must have worked for at least 26 weeks of the last two complete tax years; and

     

    Second contribution condition

    - in both of the last two complete tax years,

    you must have paid or been credited with,

    Class 1 or 2 contributions to the value of 50 times the lower earnings limit.

  2. Please can someone help me witht he wording I need on a court form.

     

    I am claiming for part known amount and part unknown amount .

     

    I have sent Abbey the relevant letters I have only got some of my statements and they have used the microfiche argument to deprive me of the rest.

     

    I have already complained to the ICO and have sent Abbey the LBA and now their time is well past up and I want to file my claim without further delay in the hope I get some much needed money back before Xmas.

     

    I will be filing in person as I am exempt from the charges being a disabled single mum on benefits any help please with wording would be much appreciated as I dont want mess up at the last most important stage.

    I took action against Nationwide and got a couple of eltters warning me they woould close my account but yesterday got a letter saying they have refunded my charges and no mention of closing my account - I have checked my balance and they ghace so far paid my court costs and interest but niot the actual charges so will hopefully get them on Tuesday - just wondering if the letter to close my account is on its way - not really bothered as I have another account elsewhere that I can use

  4. I got exactly the same letters from co-op bank so I filed claim online after 14 days co-op acknowledged and said they were going to defend but then paid in full about 5 days later inc costs and interest (£1026) so stick with it you will get your money soon

  6. I have had the same from Nationwide but so far have not even had a response of any kind from 14day letter to NatWest - dont care either as long as they give me the money back I will take my business elsewhere - fine by me

  7. congrats I am taking on NatWest for my o/h £768 I sent 14 day letter on 14th August and have rec'd absolutely no response whatsoever (sent it special delivery so I know they have rec'd it).

     

    My o/h thought I was deluded when I started this but after winnig back over £1000 from co-op and £250 from Abbey he has changed his tune a bit and is now eagerly awaiting his money back

  8. I took out a mortgage with Cheltenham and Gloucester in 2002 it was a 5 year term and the first 3 years were discounted. I paid it off after 3 and a bit years and had to pay an early redemption fee/penalty.

     

    I understand that the C and G will have lost out on interest that I would otherwise have paid if I kept the mortgage but I am sure they will have either invested the lump sum I paid back or lent it to someone else so I do not see how they could have suffered any actual loss or costs.

     

    Is it possible that this type of charge is a penalty and covered by the same rules as bank charges in which case could I claim it back and has anyone else claimed back this type of charge and won.

  9. hi yes I know they make me really angry and upset

     

    I got another letter from them today tellin me the same thing that they have investigated and their charges are fair transparent etc and if I cannot agree to their terms and conditions now is a good time to look for alternative banking facilities - the cheeky so and so's

     

    They have also sent me the banking ombudsmans leaflet

     

    Thing is I have already filed online claim (14th August) and they have acknowledged it so we will wait and see what happens next

  10. Hi I am new to this particular but have been claiming penalty charges back with help from another similar site.

     

    I have recently sent a letter to Nationwide asking for my penalty charges to be refunded and they have said no their charges are in their terms and conditions and if I am not willing to accept their terms and conditions I should look for alternative banking facilities. I have filed a court claim (17th August) which they have acknowledged and I am just waiting now to see what happens. Having read through a few other threads it seems that they will close my account - but do they give any notice of this and give you time to sort alternative banking out

  11. Well done I wrote to co-op bank on 8th June asking for a refund of almost £1000 in charges since last September. I have rec'd a letter today telling me they are investigating and will respond in 6 weeks - I feel like this is a delaying tactic and dont know whether to write back and tell them I am not willing to wait that long what does anyone think

  12. Just one thing worries me though - I think 14 days is a bit tight, and the County Court may also feel that way. The reasoin we suggest two letters is that by giving them a total of 28 days, they cannot claim in court that they were not given enough time to respond.

     

    My bank have written to me in response to my initial claim for refund of charges and have said they need to investigate fully my claim and will respond within 6 weeks - they have already had 2 weeks - should I wait another 6 weeks or should I write back and say they can have another 14 days then I am going to court
