  1. Thank you dx. Understood not to send for another CCA.
    I've had a read through note #2, my first time seeing anything like this. Thank you for bearing with my questions!

    When ticking box D, "I dispute this debt because"..recommended reason as advised from your thread, what reason should I use?
    (The truth is I do owe some money from way back, it was originally 5K, interest saw it go up to 11K (so unfair), and I paid 2K get it down to £9k (as currently owed)) in my eyes, I only owe £3K.  Id rather not pay anything as my ex-wife (who wasn't in her name) spent it!

    When ticking box I, "I have requested by way of a cca request the signed agreement from the debt purchaser [CC is attached to this reply form]" who is this, would this be Arrow?

    When I've filled in the PAP reply form, i'll send it off first thing Monday morning.  What happens then, I just wait, what happens if it goes past 12 days with the CCA, or 30 days with these documents?

  2. OK I sent CCA request on Monday 7/6 recorded delivery with a postal order uncrossed with £1 stating on the back that it didn't go towards any alleged debt.

     

    Wednesday 9/6, received the postal order back from Arrow with a cover letter saying they no longer charge a fee and 'we will respond as soon as we can'

     

    Then on Friday 11/6 morning a letter dated the 10th (they said if we didn't hear back from you by the 11th) I got a letter of claim from Drydens saying 'if you do not provide proposals to repay, legal action may be issued in the county court'.  Along with 'you have 30 days to respond'. Attached is a printout of an income and expenditure sheet.

    Okay I will ignore until anything arrives. Does the letter of claim come from the court?

    Yes I did actually move in 2018, after I made the last payment in Dec 17. But their mail has still found me, however i've not replied.

    I did send a CCA request to some company not sure who as it was way back might even be around 2013 if I had to guess. Can't recall if I did a SAR either. I think I totally put all this out of my mind!
     

    Update - I've just checked through some old papers and I did send a CCA request but it was 2009 and they came back with a photocopy of the agreement from 2001 (it was with GE money at the time). I dont think I sent off for a SAR.

  4. A little bit of background. I've had this Debt a long time, it was a Debenhams/Santander storecard, was maxed to about 5K around 2001/2002 when I was married (in my name and she spent!) then she left 

    with me and the debt (and lots of others).

     

    Long story short, interest took it up to 12K, and I paid when I could and got it down to 9K. 

     

    I've had phases where i've made payments and had phases

    where i've totally ignored the letters as they've gone from one creditor to the other (and back again).

     

    Over the last few years going back to 2009 when i've asked for help on here Ive had some good support.


    (So its been 4 years since i've come on here to post anything). The last company to have it was ARROW GLOBAL and since 2018 its been going back and forth to DRYDENS.

    Today I come for some advice. I've received a letter from DRYDENS FAIRFAX SOLICITORS and its similar to a letter i've had in the past

    Its a letter saying they've took over the balance and that i've no repayment arrangement in place. It also says 'our client may also be willing to consider an offer of a significantly reduced amount to settle your account'

    The bit thats unnerved me that i've never seen before in past letters is 'if we do not hear from you by 11th June we will issue you with a Letter of Claim on behalf of our client and full balance will remain due'

    Do I need to be worried?

  5. Ok I've travelled home and got the letter (rather than try to recount it from memory). This is it word for word.

     

    "We are instructed by our client Arrow Global limited to commence legal proceedings against you in the county court if you do not provide proposals for repayment of this debt by 6 June 2017"

     

    Then goes onto say

     

    "If we do not receive clear proposals to repay this debt by 6 June 2017 we will commence legal proceedings against you and a claim form will be issued for the full outstanding balance. "

     

    Should I ignore and still send off the CCA?

  6. I did feel intimated. I was 9 stone heavier and living on my nerves.

     

    I wish I could turn back the clock grrr.

    Ok I'll do that.

     

    The new firm drysdale fairfax said on their letter that arrow will start legal action if I don't send them repayment proposals before 2nd June should I just ignore that and wait to see what comes from the CCA?.

  7. No I didn't send arrow a CCA request to arrow, I did to the one previous as you'll see in the past posts.

     

    I know that was really foolish now.

    I can't recall :( I feel really stupid'.

     

     

    After I stopped paying they actually turned up at my door one day I lived in a flat at the time, and a neighbour let them in and they were stood at my front my door.

     

     

    I think that's why I probsbly why I didn't stop know I can't turn the clock back now :( That's a real shame.

     

    What do you think I could do?

    First off I want to say thank you for the help you guys give me, its been really helpful in the past.

     

    I've put my head in the sand again and its now fully out wanting to face this problem head on! PLEASE HELP!

     

    I've received letters recently saying the debt that was originally Debenhams > GE Money > Santander > Scotcall > Arrow has now being appointed to drysdenfairfax solicitors

     

    I still owe 9k. I lost my job 3 years ago, and i've become self employed, and only just started to get on my feet. I'll be really brutally honest, I stopped paying Scotch and moved

    address. Not actually on purpose, it just sort of happened, life changed, and I just got on with it.

     

    But i've realised this 9k isn't going to go away and I want to deal with it however possible. Without going into it, I was married once and it was in my name and my wife sort of just kept spending then left me! (with the debt) hence my reason for 'putting it off' I think. It was originally a 5k debenhams card which over time with interest became doubled and i've paid about 1500 off it (you'll be able to see the past dealings in this post)

     

    The original debt was from 2002 I think but i've been making payments on it over the years on/off, and i've paid something to them in the last couple of years. I did actually once do a CCA request this was about 3 or 4 years ago and sure enough they dug it out (I've misplaced it since!)

     

    I just got a letter this morning from dresdenfairfax solicitors to the effect of :-

     

    Our client arrow global - original creditor santander

    instructed by our client 'arrow' to commence legal proceedings in the county court if you don't provide proposal of repayment by 6 june

    then ... its not too late to stop the claim being issued. contact us to discuss.

     

    My questions are

     

    1. Where do I start?

    2. Should I just contact them and pay something every month to stop it going to court (I don't want it to go to court)

    3. Should I respond or ignore?

     

    Can anybody help ? I'm serious about tackling this debt now! as with all things they don't go away unless we deal with them!!

     

    Much much appreciated, I'm losing sleep over this one! :(

    No I haven't received one.

     

    I'll be really honest here. When arrow got back to me and the pressure was off, I kind of just kept paying. And head back in the sand. I was really worried because somebody mailed me (a so called friend) saying about new leglislation came out last year these demands.

     

    I'm going to go about and reclaim the charges very soon, changes in my life mean I have to pull my finger out, or head out of the sand, rather.

    Received my Credit Report at last.

     

    The debt shows on there, under Santander (not Arrow Global) - and the balance is wrong it says 12K but last statement from Santander says its about 10K, showing the payments scotcall have passed to them.

     

    Payment status says D D D D D D D, Default status, but I've been paying every month.

     

    Date account updated shows as 02/05/2013

     

    Then under account history

    - It shows an entry for each month going backwards so May 2013, Apr 2013 etc with the same 12K current balance on each line going back to 2009. I know from my latest Santander statement (Dec 12) its less than that.

     

    I'm currently waiting on the SRA back from Santander as advised, and still npthing from Arrow Global.

     

    oh btw, this Credit Report was from CallCredit

    I was paying Scotcall online on time every month.

     

    Its now 16th May, I have heard nothing from Arrow Global or anybody, I held on making payment this month to Scotcall (since it has been sold) and thought I'd pay the new owners.

     

    In the meantime on good advice of this forum, I've sent Santander a Subject access requestletter and asked CallCredit for a copy of my credit report.

     

    So I'm still waiting this long, wondering in my head what's arrow global doing? my debt is about 10K and worrying already that i'm going to get taken to court (even though i've been making regular payments) and be bled dry of any disposable cash.

     

    Miserable!
