  1. It was only me that went as my partner was at work (doing 12 hour shifts at the mo!). I had to take my youngest child with me (he's 2) and he wasn't exactly quiet during the hearing, but the judge didn't seem to mind. When you do get to the hearing as Ell-enn informed me, make sure you speak slowly and clearly to the judge. State your case as clearly as you can and emphasise the fact that you are making payments as often as you can and that the house is on the market at the minute. The judge will look at the facts and make his/her decision based on them but at the end of the day he/she should be a fair minded individual and fingers crossed, things hopefully will go your way.

    I'm sorry I can't be more helpful than that as it's up to the judge but I'll be thinking of you tomorrow.

  3. Hi Biddy, thanks for that. SPML were opposing what we had offered but the judge saw our side anyway. After reading your thread, I think you have a good chance as you seem to be making payments as often as you can, due to our circumstances, we hadn't been able to pay anything in nearly a year! Framework are a free service providing free representation like the CAB but I'm not sure what areas they work in, I'm in Nottinghamshire. Have you tried your local CAB to see if they could help you out in the court? It may be worth a shot, I was lucky with Framework as they were already there when I got there.

    Fingers and toes are crossed for you tomorrow, I really hope it goes well for you.

  5. Hi everyone, sorry I didn't get back to you all yesterday, my computer's playing up really badly! Anyway........WE WON!!! The judge was really nice and the lady from Framework who represented me was absolutely fantastic. SPML's agency solicitor was really helpful too although he had to oppose the application, but before the hearing he even rang SPML to ask if they would consider the app considering I had already made a payment. But anyway, the judge ruled in our favour and suspended the warrant on the terms that we had to pay the CMI plus the 200 I had offered each month.

     

    I would just like to say a massive thankyou to Ell-enn, your support and help was really very very greatly appreciated and thanks to OLIVE and everyone else who helped me through this forum, you're all fantastic! And I will definitely be donating to the site, it really is a lifesaver!!

  7. Hiya Ell-enn, I forgot to ask if they have any CAB reps so I'm going to ask when I get there. I'm setting off in 10 minutes so I can be there half an hour or so early. Wish me luck!!! I've never shook so much in my life, I'm terrified, mainly because before I paid this months mortgage, it's nearly a year since the last payment and I'm worried that will go against us. But another couple of hours and I'll know either way, I'll let you all know how I get on.

    Also when I actually go to a hearing are children allowed in the room as I will most likely have my 2 year old son with me as it will be highly unlikely I would be able to get a babysitter during the day.
