Hi to you all....well you probably wont be surprised by what i am going to say.....on saturday i received a letter from Connaught confirming that the stat demand on behalf of 1st credit has been removed...I posted them a reply on thursday(thanks to Canbrilla's wording), they would have received on friday and replied Friday for saturday delivery...wow these people:rolleyes:.....

    the wording stated that they didnt know the debt was in dispute and they have withdrawn the SD, closed their files and would forward everything to 1st credit....do you think this is the end of it? should i wait to see if 1st credit contact me or should i make the first move?;)

  2. i appreciate your offer...I know its dawnting and not an ideal!...but hey ho I've got to get on with it.....i just want these people to sqwirm in their own sxxx....

    what do you think coz i didnt pay the £1...should I send another request for my credit agreement and pay the fee....dont want them wriggling out of this on a techniqicality.

    you know i have read on this forum that many times, but i dont even know if they have a legit assigned the debt.....it's so many years ago i cant remember.

    in basic....i didnt know until 2004 i even had the debt and not heard from them until 2008.....with a letter followed 10 days later an SD....

    I have responded to them yesterday about the SD requiring again my CA..disputed the debt and demanded they remove there intent of legal action.....if they do send me the CA now...what would that mean to me? and what does it mean when i hear is the credit agreement executed? (signed by me?) would the statute barred still stand?

     

    a complete novice in these situations and may need some advice with some legal jargon on my set as side defence if if you dont mind?:cool:

  3. thank you so much nicklea....i feel i a little happier today.....my only concern is that the court wont accept my reasons for set a side which are:

    over 6 years (10 yrs i think)

    not heard from them until 2004 then 2008

    not received a copy of credit agreement requested 2004 (would it be a good enough reason for them not to send C A if i didnt send the £1? i didnt know i had to when i contacted them in 2004)

    dont know what the debt is for

    never heard of 1st credit until 2004

     

    do you think it's enough?....I pick some jargon speach from other links to help me complete for the form and pray from there!:rolleyes:

  4. If you know which court take it straight there4 you can get the affidavit sworn at the same tine with the court staff.

     

    o the SD it didnt state what court....i work 50 miles away from where i live so the court near work would be easier for me or do i need to do it near my home town?

    do you think i should still send them the letter babybear?

  5. your welcome canbrilla.....may be you could help me or some one out there....I got some advice from babybear and am ashamed to say didnt follow it (bogged down with work and didnt get round to it) I should have sent them a letter re statute barred....2004 and 2008 I received a letter from Connaught asking me to contact them (2004 i did and didnt hear anything). 2008 received a letter threatening a statuory demand....last night when i got back from work was a posted SD....got to say it doesnt look very official but after all it's worried me......

    could someone please tell me what i need to do know...I go on holiday in 2 weeks and worried being away could effect any processes.

     

    the SD tells me i have 18 days to set aside and the debt i think is at least 10 years old, i dont know what its for so could you tell me is this grounds to set aside? if so what should my next move be? do i directly contact courts? or as the SD says to call them?....could you send me what i need to say.....help please didnt sleep a wink last night...:confused:

  6. Hi this is my first time here too and would like to say...what a great site...3 days after reading the forums I want to say, thanks, thanks for putting my mind at rest. But i need someone to tell me direct and heres my story......

     

    years ago sometime in 2000 ( could have even been 1998/1999) i must have taken out a loan ( not for the 2k they are asking for, i know that for sure) Dont know who with or for what (shameful)...years later after kids and a divorce, September 2004 I received a letter from Connaught addressed to my old marital name and interesting enough it stated Dear Sir, clearly I am a women, anyway they said they want £1935.58, like you citifinancial (not got a clue who these are) asking me to call them to arrange a convenient time and date to service.

    I did call them and told them i didnt know who they where and what was the debt for...believe it or not, they couldnt tell me....so i asked them to send me the original agreement i signed. Didnt hear a dicky.

    some 4 years later April 2008, i received yet another letter to Dear Sir telling me that they intend to issue a SD (again) and could i contact them within 7 days....

    3 days later I am in a quandery whether to make contact again to request the original agreement or to just ignore it?

     

    please please can someone tell me what i should do for the best...?

    (my new hubby doesnt know about this and wont be impressed if i have to pay 2k from my old life) urghhh !!!!

     

    will these people ever go away or do i need to arrange to pay it?
