  1. I have had my 'together' Mortgage with NRAM for 7 years. It comprises of £25K unsecured loan and £150K mortgage. I have never missed a payment or been late paying. However, I bought a new build house 7 years ago and we are only just climbing out of negative equity. The house is currently worth circa £180K and my liability is around £175K as it is an interest only product I have. I am paying 5.99% IIRC and what hurts is my next door neighbour (same LTV & property but different lender and rate) is paying £400 a month while I pay £750 a month.

     

    I want to change lenders as 5.99% is an insane amount but obviously, with only 5K in equity I'm lost as to which mortgage company might look to take the mortgage over.

     

    Can anybody point me in the right direction please?

  2. Interesting, I run a couple of businesses and was recently charged £40 by a DCA for their 'fees' in collecting an overdue account. I received no notification, just a letter demanding the overdue amount and £40 + interest. Are you saying they cannot do this?

  3. I offered and they said they wouldn't take payment as the DCA were dealing. I have been into them just now and she tried to add a £40 charge but I insisted my contract was with them and seeing as neither they nor I had received any comms from the DCA that they would accept the original outstanding payment, with interest and deem the matter settled. I walked away with them telling me they had accepted payment but that they would look into it properly on Monday. As far as I'm concerned that is an end to it. The DCA can sing for it seeing as neither I or the vet have heard from them regarding this matter.

  4. Just after some advice please. My vet bill was issued in late Sept and there was a discrepancy over the amount. It was amended and a new bill sent out whilst i was on holiday. When I got back it was lost in all the holiday post. Eventually (mid-Nov) my wife found it and sent a cheque (£71) from work via business post - usually arrives next working day. Now, my dog fell ill yesterday and I need a vet to see her so I called and they claim that my account has been passed to a DCA and there is nothing they can do!

     

    I called my bank and they said the cheque has not been processed and 'stopped' it for me. I called the vet back and offered immediate payment over the phone to be told they can't accept it as it is in the hands of their DCA as was passed to them on 28th Nov. It is now 28th Dec and I haven't had ANY comms from them whatsoever.

     

    I have checked the bill from the vet and it says nothing about accounts being passed to DCA's or anything like that. It merely states that overdue accounts will attract a 3% monthly charge.

     

    My question is this - are they able to pass over an account without any formal notification? I am in business myself and I send an invoice, first payment reminder, second payment reminder with statement and then a letter advising legal recourse if payment not received within 14 days. Surely they will be no different?

  5. About 5 years ago I struggled with some repayments on a loan of about £18K. HSBC were my bank whom the loan was with and they were very unhelpful, harrassing me 4 times a day, 7 days a week. I had money coming to me to clear the arrears but they wouldn't wait and issued a default for the full amount. Now, 5 years on I have my own business, a £70K a year income and still can't get credit. My business was built the hard way, not applying for finance but now I need to and this damn default seems to still be popping its head up. I have mobile phone contracts, a mortgage which I have never missed a payment on, credit cards etc but still hit problems when applying for even the smallest amount - even just £4K!

     

    Am I able to do anything to get rid of this stain? I still owe the default amount, less what I have been paying back but ironically have friends who, in this position went bankrupt and are credit clean now in less time than this has been going on.

     

    Please help!

  6. With retirement due in a few weeks a sum of money is due. An IVA has been in force and the debt management co have been paid a large proportion of the debt without default for a few years. Approx £31,000 is still outstanding and naturally, the retirement sum will not stretch to paying all of this. However, what figure is sensible to offer in full and final settlement of the debt?

  7. Jan 22 2008 MCS tried collecting £3500 from me saying my O/D had defaulted. I told them I was reclaiming bank charges from HSBC and received a letter from MCS stating that until the bank charge test case had been decided they would place a hold on ALL action. For some reason now they are sending letter after letter saying that HSBC have been in touch and that the charges are lawful and they have issued me with a final demand and are threatening court action. Now, as far as I am aware, the test case has not finished so how on earth can they start chasing money?? Anyone help with what I do now please?

  8. As title suggests really. Over 18 months 3 seperate DCA's have tried it on over an alleged debt. Each has been given a CCA request and not one was able to provide anything which suggests to me that the bank concerned are unable to provide anything. So, my question is this - how long do I have to keep doing this? Will the bank ever acknowledge they can't do anything and give up or do I have to repeat the whole process with every change of DCA (approx every 6 months) forever?

  9. My wife received a letter from this company saying they have taken ownership of her account which was with HSBC. I have never heard of them and it just seemed a bit strange that HSBC should 'sell' this debt on? Is it worth going down the route of sending a CCA? I believe the amount o/s was less than £1000 and she has been paying £25 p/m to HSBC (CL finance say they are happy to keep this payment arrangement).

  10. Well, I sent the letter as advised and had a letter back today from the DCA which said the following:

    "Dear Mr ......

     

    We acknowledge reciept of your recent letter from which your comments have been noted.

    In the circumstances we will take no further action and have returned your account for our clients attention.

     

    All future communications should be forwarded to our client."

     

    The client is Lloyds TSB in this instance. Does this mean the DCA cannot find the CCA and have decided to 'close' the file or am I missing something?
