    Basically I cancelled a payday loan & returned the funds the day I received them the company still want to claim the intrest for the full period from me.

     

    I applied for a loan with toothfairy finance, the following day I requested to cancel the loan (before the funds were received). The funds were returned the day they were received. They are still requesting the full £54 (2-week) charge & interest. I think that in light of the Unfair Terms and Contract Regulations that if a clause with such high charge for after cancellation were to exist it would be considered unfair.

     

    There's didn't seem to be any similar cases to someone cancelling a payday loan and not paying the interest.

  2. OK pounds till payday have charged me £59.00 for not paying on time, I haven't paid them yet but there going to call back next week for a payment, I don't want to pay it as it's way too high.

     

    I was wondering does the same rule apply to payday loan companies that banks must adhere to? Can I say the NSF fee is unfair as the banking ones are.

     

    There's no way I have to pay this right?

    I have taken something to court and they wish to defend i just wonder what my chances are heres my claim:

     

    Advertising that was Mis-sold to Mr F, Mr F is being charged quarterly for an advertisement that he believed to be a one of payment. He has also been overcharged on the first payment as he was advised the amount he would be paying would be a one off payment of £188.00 which would be reduced to £128.00 if he was to take out the advertising over the phone which was done. He has given the company in question no permission to set up a switch board payment system on his card to deduct further payments which they have done quarterly causing charges on the account which are now also being claimed for. Formal request for reimbursement was made on 10/10/2008.
    They intend to defend the case I just wonder if this is a reasonable case?
  4. I took out insurance with Prestige all was good then I sold my car and had to write a letter to cancel my insurance all done fine, I get a letter back saying I have to pay the outstanding balance of £423.99! :eek:

    My total premium was £1223.54 or something like that.

    Now I had the insurance for two months, which on there cancellation rights would be 40% of the premium payable which I thought was 40% of 1223= 489 minus my deposit of 314.00 paying £175 which I would be fine with. But they want 15% of any premium outstanding as commission witch would be £184 + £45 cancellation fee, so all in all I'm being bullied into paying £738 for a £1223 per year policy, I only had for two months, this can't be fair. If anyone knows anything please tell me because I think I am being scammed I cant afford one payment of £424 :sad:
